About this file
This is a Payment Bond document issued by the City of Santa Monica pursuant to California Civil Code Section 9550. The bond serves as a guarantee that the Principal contractor will fulfill payment obligations to all laborers, materialmen, subcontractors, and other parties involved in the performance of a contract awarded by the City. The bond is executed by both the Principal and a Surety and becomes effective upon contract award by the City. The instrument covers all work, materials, and equipment furnished in connection with the contracted services, as well as amounts due under the Unemployment Insurance Act. The Surety agrees that the bond remains in full force regardless of any changes, extensions, alterations, or modifications to the underlying contract or work scope and waives the right to receive notice of such modifications.
The bond amount is set at 100 percent of the proposal amount in dollars, as specified in the contract terms. The Surety's obligations are binding upon itself and its successors and assigns, jointly and severally. In the event of breach, the Surety agrees to pay reasonable attorney's fees as determined by the Court and included in any judgment rendered. The bond document requires notarial acknowledgement of the Surety and a Power of Attorney, which must be attached to the executed instrument. The bond is dated 2017 and requires signatures and corporate seals from authorized representatives of both the Principal and Surety, along with the Surety's mailing address and telephone number.
