5. Demonstration that the Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Design Build, LLC is the one source with the required equipment, soures, capability, and competency to provide the service effective September 1, 2020 without delay.

Design Build, poseses a thorough understanding of the cleaning and disinfecting processes, areas to be cleaned and is already mobilized. The VACHS has an unusual and compelling need for these services, and failure to obtain such services in a timely manner will result in a situation in which there is a threat of immediate harm to health, welfare, and safety of life.

Furthermore, the mission could be compromised if patient safety and well being are threatened due to potential safety and infection issues that may arise if these services are not provided.

PM Part 813.5 SAP for Certain Commercial Items Page 3 of 4 Original Date: 08/30/17 Revision 02 Date: 08/04/2020 this requirement, market research was not conducted. A bridge contract with incumnbent contractor is being proposed as a stop gap measure until the new competitive follow on contract is awarded.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

There is no sufficient time to allow a long term Janitorial Services contract, before the current contract expires (on August 31, 2020). In order to allow for the award of the Long term Janitorial Services contract, and the transition between the current contractor and the new contractor, a short term bridge contract must be awarded. The technical review board that is currently evaluating the proposals of the new long term follow on contract has been adversely impacted by the COVID 19 National Emergency and the different atmospheric systems, such as Tropical Storms Isaias and Laura, during this active and irregular hurricane season. Thus, delaying the timely and effective source selection team evaluation process.

Due to these reasons it is advisable to keep the current contractor until the process to select a new contractor is completed.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The current vendor for these services in our facility, Design Build, LLC.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This is for a short term bridge contract, which will allow sufficient time for a long term competitive follow on contract, set aside to SDVOSB to be awarded. To avoid interruption of janitorial services it is in the best interest of the Government to award a contract to the incumbent Design Build, LLC, while the long term process is awarded.
