About this file

This document is a justification and approval for other than full and open competition. The Transportation Security Administration requires continued access to Osprey Flight Solutions' flight data, alerts, threat and risk metrics, and real-time reports to perform its aviation risk assessment mission. Osprey is the only known contractor that provides this capability, which includes over 17,000 daily aviation safety and security alerts tagged by category. The tool also allows analysts to conduct customized searches and analyze trends over periods ranging from one day to three years. Continued use of Osprey's solution is necessary for the TSA to have the same common operating picture as the Federal Aviation Administration and other aviation stakeholders in order to work closely on flight routes and security measures while avoiding delays in alerting and risk identification.

U.S. Department of Homeland Security Justification and Approval for Other Than Full and Open Competition

Office of the Chief Procurement Officer Version 3.2

Page 2 of flight planning software; providing a visual of the common operating picture at any moment in time.

The tool must tag all of the data by Ping Type with categorizations that include accidents, Air & Air Defense Activity, Air Patrol & Air Intercept, Airport/Airbase attack, Airstrike, Aviation Safety Event, Aviation Security Event, Biosafety, Civil Aviation Notice, Corruption, Crime, Cyber Event, Inflight Attack, Lasting Event, Missile Launch, Projective Event, Social Unrest, Unmanned Aerial Vehicle Event, Weapons Cache & Trafficking as well as Weapons test. These tags are applied to all pings and alerts that are entered into their platform. These tags in turn enable analysts to enter the platform and conduct their individualized research by running searches on an airport, country or region of choice, creating a custom period of search anywhere from one day to three years and then filtering by multiple or one single ping type. This autonomy gives analyst the freedom to not only assess the picture of risk in a certain area during a selected period of time but also allows the analyst to make their own assessments based on trends they are viewing in the data.

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the FAR Subpart 6.302-1 entitled, Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5.

acquisition requires use of the authority cited. Osprey is the only known contractor that provides the flight data, alerts, threat and risk metrics, and real-time reports required by I&A to perform its aviation risk assessment mission. Access to TSA early warning of aviation security events in real-time. Osprey is the primary flight data tool used by the Federal Aviation Administration (FAA) and many other federal and civil aviation stakeholders. As TSA continues working closely with the FAA on flight routes, and aviation security measures, it is imperative that TSA does so using the same common operating picture used by the FAA and other aviation security stakeholders.

Without tool, TSA must wait several hours after an event has occurred before actionable information begins to come in from the field, and additional risk can be measured.

Delays in alerting also interrupt the identification of risk mitigation strategies associated with that event and potential follow on events.

In view of the considerations highlighted above, continuation of through other than full and open competition is fully consistent with 41 U.S.C.3304(a)(1) and FAR Subpart 6.302-1 because there is only one responsible source and no other supplies or services will satisfy TSA requirements.
