About this file

This document describes the Orange County District Attorney's Office Public Works Unit, established in June 2011 within the Workers Compensation Insurance Unit to oversee public works contractors and protect prevailing wages and employee benefits. The unit investigates and prosecutes contractors and their agents for prevailing wage violations and workers' compensation fraud in coordination with the Department of Industrial Relations, Employment Development Department, California Department of Insurance, and Contractor State License Board. The document provides detailed information on California Labor Code Section 1776 requirements for certified payroll records that contractors and subcontractors must maintain, including employee names, addresses, social security numbers, work classifications, hours worked, and actual wages paid. All payroll records must be verified under penalty of perjury and submitted on forms provided by the Division of Labor Standards Enforcement or containing equivalent information.

The document outlines common violations prosecuted by the unit, including Labor Code 1778 (taking or receiving wages from workers on public works projects), Penal Code 115 (false and forged instruments), Insurance Code 11760 and 11880 (premium fraud and misrepresentation to insurance companies), and Unemployment Insurance Code violations related to payroll tax reporting and payment. Since its establishment in June 2011, the unit has filed charges against defendants in 42 cases, served 80+ search warrants, and obtained 4 grand jury indictments. Convictions and sentences range from 90 days to 7 years 4 months, with cases involving general contractors, subcontractors across various trades, and office personnel. Contact information is provided for Deputy District Attorney Raymund Diaz and Investigator Eddie Gomez, along with an insurance fraud hotline number for reporting violations.
