Solicitation OPM15‐13‐R‐0002 Question & Answers

Provided below are the questions and answers on Solicitation OPM15-13-R-0002

1) When will payment for completed assignments occur? Will payment be dependent on

OPM’s review of the work or final completion and delivery of the case?

Response: Contractors may submit an invoice for payment once all items on the task order are completed and accepted by the Government (RFP Section G.4).

Invoicing and payment are not dependent on case completion as these are item based tasked orders.

2) If developed activities or sources are found in the same coverage area:

a) Do they need to be treated as extensions or can they be treated as Add Items in PIPS?

Response: Treat as extensions and forward activity/source information to the Contracting Officer’s Representative (COR). The COR will determine how to cover.

b) If treated as extensions, will the work be assigned back to the contractor who developed the work?

Response: The COR will decide if developed work will be covered by Federal Investigators or by Contract Investigators. If the developed activity is to be worked by the contractor, a new Task Order will be created to address new work.

c) If treated as an Add Item, do they need to be approved by the SAC before they are worked and if approved, will they be paid on the same schedule as the other CLINS?

Response: Any ‘add’ items will be ordered on a separate task order.

3) What types of preprinted forms or materials will be provided by OPM?

Response: OPM will provide cooperation brochures and door hangers. All other letterhead, business cards, fax cover sheets, etc. must be approved by OPM.

Submission for approval will be through the COR.

4) Will OPM also provide maintenance for the laptops and printers issued by OPM? Are the printers and laptops only issued to investigators or to PMO staff as well? Are there any costs associated with damaged or lost/stolen laptops/printers issued by OPM?

Response: OPM will cover the cost of maintenance for computers and printers. A maximum of 6 computers may be provided to any contractor (RFP Section C.4(a)(5)). Lost, stolen and/or damaged equipment could result in costs to the contractor. Final determination of the associated costs will be determined by OPM.

5) In order to conduct a quality review of the work submitted by the contractor’s investigators, please address the following:

a) Will OPM provide access in PIPS to a “case review” menu for contractor quality review staff?

Response: OPM will be reviewing all work as it is transmitted by the contractor staff; however, if requested, OPM will provide a review option for the contract company.

b) Will reports be available via OPM’s Dashboard or other EPIC systems that would alert the contractor’s review staff that work was ready for a quality check?

Response: Yes. If requested a report can be provided via an email link showing the contractor all work pending review for their ORG.

c) Once complete, would the contractor’s quality review staff “release” these items to OPM for final review?

Response: Yes. Once the quality review is complete by the contract company, it will be released to OPM for final review.

d) Is there a diagram or outline OPM can provide of this process?

Response: None to date

6) What record databases of state and local law agencies does OPM use in the Fayetteville Duty

Station that would be made available to the contractor?

Response: None. Any and all centralized database searches will remain with the Federal staff for completion.

7) How will items be assigned to the contractor?

Response: Once the task order is finalized, items will be assigned to the contractor in PIPS by the COR.

a) Will the contractor be using OPM’s ORG structure in PIPS?

Response: Contractors will be utilizing the OPM ORG structure. A separate Investigative Unit will be established for each Contractor.

b) If so, will the contractor be given a universal company USER ID when assigned work that the contractor can then reassign to OPM approved contractor resources in the area of work?

Response: Each contract company will be assigned an ORG and each contract employee will be assigned a SID. The ORG will then be able to assign it to a SID.

c) Can OPM provide a diagram or outline of how work will be assigned to the contractor and then from the contractor to the field investigators working for that contractor?

Response: A diagram of the flow of the work is attached to this Amendment.

8) Will the contractor need special permissions or IT resources (other than the laptops and printers provided by OPM) to access the case management reports mentioned in the SOW?

Response: The contractor will not be permitted to perform any work on the resulting contract outside of the OPM provided hardware and software. All required case management reports will be available on the OPM issued laptops.

9) Is there any fee to OPM associated with obtaining OPM approval for investigators who are already cleared (completed, current investigation SSBI/SSBI-PR) or for investigators who’s SSBI-PR’s are submitted through OPM (SOW, p33, H.13.a)?

Response: There is no fee in the situation referenced.

10) How does OPM see itself allowing a contractor to use a computer system owned and operated by the contractor? What types of information would be allowed in the contractor’s system?

Response: The contractor will not be permitted to perform any work on the resulting contract outside of the OPM provided hardware and software.

11) Please verify that this is an SCA contract?

Response: Verified. FAR 52.222-41, Service Contract Act 1965 is incorporated by reference in Section I of the solicitation. Wage determination 2000-0309, Rev. 23 is included as an attachment.

Response: Task Orders will be created based on demand for extra capacity. Each

16) What is the estimated value of the contract?

Response: The total maximum value of all task orders awarded under this RFP will be

$220,000. (RFP Section B.2)

17) What is the period of performance?

Response: The period of performance of this contract is 12 months from the date of award or until all funds are exhausted, whichever occurs first. (RFP Section F.4).

18) Will Training be on site or on line?

19) Will there be 100% review of ROIs?

Response: Yes. All work completed will be reviewed by COR.

20) After award of the contract, will the task orders be awarded based upon price?

Response: Task orders will be assigned based upon quality, timeliness, current contractor capacity, and price. (RFP Section B.2).

21) What is the term of the contract?

Background Investigation services outlined in said Solicitation. Reference RFP Section I.2 (52.209-1 – Qualifications Requirements)

Response: To be considered for award, any offeror must submit a proposal package in in accordance with the requirements of RFP Section L. To address the specific section of the RFP; vendors maintained in the competitive range will be required to complete the Contractor Assessment. The Contractor Assessment will be utilized to determine the training requirements of the proposed investigative staff. Contractors will be notified of the results and anticipated training requirements of the proposed staff. Vendors who wish to withdraw from the procurement process at this point will be permitted.

(RFP Section M.8)

25) Are the Resumes included in the Technical Volume page count? Is there a page limit per resume?

Response: Resumes are not included in the Technical Volume page count. There is no limit on pages per resume.

26) Please clarify where organization should be in the outline, under Factor 1 or under Factor 2

Response: The contractor’s organization will be evaluated under Technical Evaluation Factor M.3(a)(5) as well as M.3(b) (Factors 1 & 2). Various factors of the organization will be rated under each. (RFP Section M.3)

27) a) Are the resumes included in the page count or can they be an attachment?

Response: Resumes are not included in the Technical Volume page count. There is no limit on pages per resume.

Response: Past Performance Information is not included in the Technical Volume page count.

c) For past performance, can you confirm that you are looking for 3 past performances (within 3 years) and unlimited additional past performances of relevance in the past 5 years if the contractor chooses to add those?

Response: OPM is seeking a list of the three most recent contracts completed

(within the last three years) for work that is closely related to this requirement. In addition, offerors may submit other past performance references occurring within the last five years that was not already included as a closely related reference. (RFP L.4(l)(6)&(7))

28) In Section L.4.l.1.a.ii, the RFP states that “[The technical proposal] will be divided into clearly marked sections/subsections, following the outline of this SOW, and address all of the information requested in the particular section/subsection of the SOW”. Section C.2, Scope of Work, includes an outline that maps to the Evaluation Factors for Technical Merit defined in Section M.3.a. Can we assume that Section L.4.l.1.a.ii and the “SOW” refers to Section C.2, Scope of Work, and the outline therein?

Response: The statement of work is not limited to RFP Section C.2. The Statement of

Work is RFP Section C in its entirety. Specifically, RFP Section C is titled

“SECTION C – DESCRIPTIONS/SPECIFICATIONS/SOW.”

29) Given the short term and small size of this contract, resources to be allocated will be on a part time or shared basis. Does the government require the contractor (per the OPM-FIS Security Manual)to have a sequestered area for processing OPM Background Investigations;

to include slab to slab construction with a cipher lock entrance door where only OPM approved individuals can enter?

Response: Any resulting contract will not eliminate or reduce the security requirements contained in the FIS Security Manual. Contractors will be evaluated on their Plan to Control Investigative Materials/Security (RFP

Section M.3(4)). Specific attention should be brought to the requirements contained in the FIS Security Manual, Appendix D Policy on the Protection of Personally Identifiable Information (PII), Section 3.0 for physical security requirements of PII.

30) Please confirm that the cover pages, table of contents, Resumes, Quality Control Plan, Plan to Control Investigative Materials and Organization and Management Plan are "corporate plans" or are otherwise not included in the technical volume 50 page limit.

Response: Each item specifically listed in question 30 is not considered to be part of the technical proposal and is thereby not subject to the fifty (50) page limitation.

** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, Page 4 of 6Wage Determination: 2000-0309, 23 daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

** NOTES APPLYING TO THIS WAGE DETERMINATION **

Under the policy and guidance contained in All Agency Memorandum No. 159, the Wage and Hour Division does not recognize, for section 4(c) purposes, prospective wage rates and fringe benefit provisions that are effective only upon such contingencies as "approval of Wage and Hour, issuance of a wage determination, incorporation of the wage determination in the contract, adjusting the contract price, etc." (The relevant CBA section) in the collective bargaining agreement between (the parties) contains contingency language that Wage and Hour does not recognize as reflecting "arm's length negotiation" under section 4(c) of the Act and 29 C.F.R. 5.11(a) of the regulations. This wage determination therefore reflects the actual CBA wage rates and fringe benefits paid under the predecessor contract.

The duties of employees under job titles listed are those described in the "Service Contract Act Directory of Occupations", Fifth Edition, April 2006, unless otherwise indicated. Copies of the Directory are available on the Internet. A links to the Directory may be found on the WHD home page at http://www.dol.gov/esa/whd/ or through the Wage Determinations On- Line (WDOL) Web site at http://wdol.gov/.

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined. Such conforming process shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees. The conformed classification, wage rate, and/or fringe benefits shall be retroactive to the commencement date of the contract. {See Section 4.6 (C)(vi)} When multiple wage determinations are included in a contract, a separate SF 1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award, the contractor prepares a written report listing in order proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, for review. (See section 4.6(b)

(2) of Regulations 29 CFR Part 4).

4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF 1444 or bond paper.

When preparing a conformance request, the "Service Contract Act Directory of Occupations" (the Directory) should be used to compare job definitions to insure that duties requested are not performed by a classification already listed in the wage

Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination.
