About this file
This is an urgent notification document from the New York State Office for People With Developmental Disabilities (OPWDD) regarding mandatory contractor registration requirements for Article 8 public works projects. Effective December 30, 2024, all contractors and subcontractors must be registered with the New York State Department of Labor (NYSDOL) prior to submitting bids on covered public works projects. The registration requirement applies to both new bids and ongoing work, with a transition period for projects where bids were due before December 30, 2024, but work commences after that date. Bidders must provide their valid NYSDOL registration number in the designated space on bid forms at the time of submission; failure to provide verifiable registration will result in bid disqualification. Registration is currently open, and applicants should note that NYSDOL estimates approximately 3-4 weeks for application review and Certificate of Registration issuance.
When submitting bids to OPWDD for Article 8 public works contracts, vendors must include a copy of their NYSDOL certificate of registration along with their proposal. Subcontractors are not permitted without written OPWDD approval. Prevailing wages must be paid on all NYS public works projects. Additional guidance and frequently asked questions are available on the NYSDOL website, and contractors with further questions may contact the Bureau of Public Work and Prevailing Wage at 518-457-5589 or labor.sm.pwask@labor.ny.gov. This registration requirement ensures compliance with New York State Labor Law 220-i and applies to all contractors seeking to participate in OPWDD's procurement opportunities.
