About this file
No Contact Policy Summary
This is a No Contact Policy document applicable to the Massachusetts Probation Service, a department of the Massachusetts Trial Court, in relation to the Investigations Tracking System (ITS) procurement. The policy establishes restrictions on communications between bidders and Massachusetts Probation Service personnel during the procurement process to ensure fair competition and prevent conflicts of interest. The policy prohibits all contact regarding the solicitation between prospective vendors and any representative of the procuring agency, except through official channels such as written questions submitted during designated periods or attendance at authorized bidders' conferences. All inquiries and communications must be directed to the designated procurement contact, and any unauthorized contact may result in the bidder's disqualification from the procurement process.
The policy applies to all parties with a financial interest in the procurement, including prime contractors, subcontractors, and consultants. Violations of the no contact policy are serious and can result in immediate removal from consideration. The policy remains in effect throughout the entire procurement process, including the solicitation, evaluation, and award phases, and continues until a contract is fully executed. This measure is designed to maintain the integrity of the competitive procurement process and ensure that all bidders have equal access to information and opportunity without gaining unfair advantage through direct communications with agency decision-makers or staff.
