4. Authority Cited: (FAR 6.303-2(b)(4)) 10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or

Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) FAR 6.303-2(b)(5) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. The particular brand name, product, or a feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or

FOR OFFICIAL USE ONLY – J&A No. 19-1715 cannot be modified to meet, the agency’s needs. The initial procurement of the Northrup Grumman BioSled biometric hardware device was purchased under the Rapid Execution Vehicle IDIQ contract and subsequent devices under the Targeted Requirements Execution IDIQ Contract. Northrup Grumman offers a device that provides a unique capability to USSOCOM Special Operations Forces and require enterprise software support in order to maintain an operational capability on the BioSled biometric devices.

The Northrup Grumman BioSled is a proprietary system and Northrup Grumman is the sole vendor of the capability, as well as the only vendor able to maintain the system’s software as utilized at USSOCOM. The Northrup Grumman BioSled biometric software is specific to the BioSled biometric collection device, and is unique to the BioSled as it is the only tool that provides the required combination of obtaining, packaging, and transmitting of biometric information into the authoritative database. In addition, the software was validated by meeting compliancy standards when tested against the authoritative database. The BioSled software is proprietary to Northrup Grumman and not available from any other vendors. Selecting any other software support provider for the Northrup Grumman BioSled would result in increases costs and a degradation of mission due to the fact that the BioSled is the most current biometric device capability that meets USSOCOM’s requirement for collecting and matching biometrics to an authoritative database.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6) & (11)) A notice was or was not publicized as required by FAR 5.2. If a notice was not publicized, the exception cited under FAR 5.202(a)(1) through (13) was(a)(6).

7. Market Research: (FAR 6.303-2(b)(8)) HQ USSOCOM makes every effort and is constantly reviewing the market to adhere to the process of competing acquisitions. Based upon market research conducted on http://www.marketresearch.com and http://www.thomasregister.com on 4 April 2019, no other vendor besides Northrup Grumman can offer an enterprise software support that meets USSOCOM’s requirement for obtaining, packaging, and transmitting of biometric information as no other entities can provide support for this software exists at this time.

Additionally, a Sources Sought was placed on FBO for 20 days and provided no viable sources. The Northrup Grumman BioSled software is proprietary and Northrup Grumman is the sole vendor of this capability, as well as the only vendor able to maintain Special Operations Forces biometric equipment. Northrup Grumman has confirmed that they are indeed the only entity able to supply and perform maintenance on the BioSled equipment.

8. Other Authorities/Factors: (FAR 6.303-2(b)(9)) None

9. Interested Sources: (FAR 6.303-2(b)(10)) (There are currently no other authorized resellers of the proprietary Northrup Grumman

BioSled biometric software.
