About this file

This is a Buy America Bidding Alternative document issued by the Delaware Department of Natural Resources and Environmental Control (DNREC) for Invitation to Bid (ITB) NAT26001-THWILDVIEW, which covers the design and complete construction of two elevated viewing platforms at the Ted Harvey Conservation Area. The project scope includes all materials, labor, site preparation, structural components, decking, railing systems, foundation work, and final acceptance. The platforms must comply with applicable building codes, accessibility requirements, and detailed technical specifications established for structural design and safety compliance. Project documents are available only through controlled access to qualified vendors and require prior contact with Amanda Delayo at DNREC's Division of Fish and Wildlife (302-592-9906 or dnrec.delawarebayshore@delaware.gov) at 89 Kings Highway, Dover, Delaware 19901. Specific proposal due dates, pre-bid meeting schedules, and question deadlines are contained within the restricted ITB document. The contract award is made to the lowest responsive and responsible bidder, and the contract term extends through completion of construction and final acceptance by DNREC.

Bids are submitted as lump-sum costs covering all design and construction expenses. Under 23 CFR 635.410(b)(3), bidders must submit both a base bid utilizing domestic construction materials and an alternate bid reflecting the use of foreign iron, steel, manufactured products, and construction materials. A waiver of Buy America requirements may be granted if the lowest overall total bid using domestic materials does not exceed 125 percent of the lowest overall total bid using foreign materials. Prevailing wage rates apply under the Delaware Department of Labor prevailing wage schedule effective March 13, 2026, with hourly rates applicable to 29 construction worker classifications across New Castle, Kent, and Sussex counties. Eight contractors and individuals appearing on the Delaware prevailing wage debarment list are prohibited from bidding. Delaware-based contractor preference applies where vendors qualify under state procurement policy. Project documents have been exempted from public disclosure under Delaware Code Title 29, Section 10002(o)(17)(a) based on public safety concerns, with contract documents released only upon acknowledgement of receipt.
