Section C - Descriptions and Specifications
SCOPE OF WORK
PROJECT TITLE: Mechanical Bedding and Tree Planting at NAS Meridian (NASMER)_
1. GENERAL DESCRIPTION
a. The work to be performed is mechanical bedding which will improve the planting condition for loblolly pine seedlings. Since a tornado effected this area, mechanical bedding will move debris and will prepare a planting bed that will increase the survival of the loblolly pine seedlings.
b. The work to be performed under this contract consists the planting of loblolly pine bare-root seedlings to be furnished by the contractor:
41,520 – Loblolly pine seedlings
A total of 80 acres will be planted of Loblolly pine bare-root seedlings at NAS Meridian. The pine seedlings will be planted on 6’x 14’ spacing at 519 trees per acre. Contractor shall furnish all labor, seedlings, supervision, tools, materials, equipment, and transportation necessary to perform the planting work. Areas are specified on attached maps.
2. LOCATION
All work will be performed on the tornado-damaged area that is located east of the intersection of Rabbit and Campground Road.
3. MINOR MATERIALS AND WORK
Minor materials and work not specifically mentioned herein but necessary for the proper completion of the specified work shall be furnished without additional cost to the Government.
4. EXISTING WORK

5. WORK SCHEDULE
a. Some work must be performed this calendar year 2019 with all work completed by 28 Feb 2020.
b. All access of personal and equipment must be coordinated with Security and the FEAD department.
c. Work outside regular working hours requires Contracting Officer approval. Approval will be granted if working outside regular working hours is determined to be in the best interest of the government. Make application 3 days prior to such work to allow arrangement to be made by the Government for inspecting the work in progress.
d. If the Contractor encounters difficulty in meeting the contract schedule and data requirements, or has knowledge that a situation is delaying or threatening to delay the delivery order, the Contractor shall notify the Contracting Officer in writing. This information shall not be construed as a waiver by the Government regarding delivery schedule, data, or rights provided by law.
6. FAC 5252.236-9305, AVAILABILITY OF UTILITIES (AUG 1991)
When available, the Government will furnish reasonable amounts of the following utilities for the work to be performed under this contract at no cost to the contractor. Information concerning the location of existing outlets may be secured from the OIC. The contractor shall provide and maintain, at his expense, the necessary service lines from existing Government outlets to the site of work.
Electric Water
Contractor Furnished Utilities. In the event that the Government is unable to provide the required types of utilities, the Contractor shall, at his expense, arrange for the required utilities.
Telephone Lines. Telephone lines for the sole use of the Contractor will not be available.
Government telephones shall not be used for personal reasons.
7. CONSTRUCTION SCHEDULE
Within 15 days after receipt of the Notice of Award, prepare and submit to the Contracting Officer for approval a construction schedule in the form of a progress chart.
8. SUBMITTAL PROCEDURES
a. Submit contractor permits and licensing, personnel information, and administrative submittals presented for review and approval. One copy will be returned to the contractor, three will be retained for government use. Contract Clauses "FAR 52.236-5, Material and Workmanship," paragraph (b) and "FAR 52.236-21, Specifications and Drawings for Construction," paragraphs (d), (e), and (f) apply to all "submittals."
b. Except as specified otherwise, allow a review period, beginning with receipt by the approving authority, that includes at least 20 working days for Contracting Officer approval. The period of review for submittals with Contracting Officer approval begins when the Government receives the submittal from the Contractor. The period of review for each re-submittal is the same as for the initial submittal.
c. Variations from contract requirements will be considered where advantageous to the Government. When proposing a variation:
(1) ALWAYS submit the required submittal for the item specified in the contract.
(2) Submit a written request to the Contracting Officer identifying the proposed variation separately. Include documentation of why the variation is desirable and beneficial to the Government. If lower cost is a benefit, also include an estimate of the cost saving.
(3) When submitting a variation for approval, the Contractor warrants the Contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of the work. In addition to the normal submittal review period, 10 working days will be allowed for consideration by the Government of any submittal with variations
d. Determine and verify field measurements, materials, field construction criteria; review each submittal; and check and coordinate each submittal with requirements of the work and Contract documents.
e. Ensure no work has begun until submittals for that work have been returned as "approved," or "approved as noted.
9. SUBMISSION OF OPERATION AND MAINTENANCE DATA
a. Submit three copies of Operation and Maintenance (O&M) Data/Manuals that are specifically applicable to this contract. Provide supplier/manufacturers' O&M information specified herein for the components, assemblies, subassemblies, attachments, accessories, and supplier warranty data. The items for which O&M Data/Manuals are required are listed in the technical sections, which specify those particular items. Include an index preceding each submittal. Submit in accordance with this section and section titled "Submittal Procedures."
b. Submit manuals in hard cover binders with labels. Labels shall identify the contract number, title, location, and contractors name. Include contractor and supplier warranty data in manuals.
c. O&M Data Manuals are to be submitted to the Contracting Officer for review and acceptance.
Submit data specified for a given item within 30 calendar days after the item is delivered to the contract site. In the event the Contractor fails to deliver O&M Data/Manuals within the time limits set forth above, the Contracting Officer may withhold from progress payments 50 percent of the price of the item with which such O&M Data/Manuals are associated.
10. QUALITY CONTROL
The contractor is responsible for the quality of the work performed. A quality control report is required for each day that work is performed and for every seven consecutive calendar days of no work and on the last day of a no-work period. Account for each calendar day throughout the life of the Contract. The reporting of work shall be identified by terminology consistent with the construction schedule. Contractor Quality Control Reports are to be prepared, signed and dated by the QC Manager appointed by the contractor.
11. FAC 5252.236-9303, ACCIDENT PREVENTION (JUN 1994)
(a) In order to provide safety controls for protection to the life and health of employees and other persons; for prevention of damage to property, materials, supplies, and equipment; and for avoidance of work interruptions in the performance of this contract, the Contractor shall comply with all pertinent provisions of Corps of Engineers Manual, EM 385-1-1, entitled “Safety and Health Requirements Manual” as amended, and will also take or cause to be taken such additional measures as the Contracting Officer may determine to be reasonably necessary for the purpose.
(b) The Contractor will maintain an accurate record of, and will report to the Contracting Officer in the manner and on the forms prescribed by the Contracting officer, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies and equipment incident to work performed under this contract.
(c) The Contracting Officer will notify the Contractor of any noncompliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the Contractor or his representative at the site of the work, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of work until satisfactory corrective action has been taken. The Contractor shall make no part of the time lost due to any such stop orders the subject of claim for extension of time or for excess costs or damages.
(d) Compliance with the provisions of this article by subcontractors will be the responsibility of the Contractor.
(e) Prior to commencement of the work, the Contractor may be required to:
(1) submit in writing his proposals for effectuation provision for accident prevention;
(2) meet in conference with representatives of the Contracting Officer to discuss and develop mutual understandings relative to administration of the overall safety program.
12. WASTE MANAGEMENT
Comply with all Federal, State, and Local regulations to include but not limited to the following:
a. Hazardous Solid Waste. All waste generated that meets the definition of hazardous waste, must be handled, accumulated, stored, moved and disposed of in accordance with RCRA regulations for Large Quantity Generators (LOG). In accordance with the NAS Meridian Hazardous Waste Management Plan all hazardous waste shall be accumulated, in contractor-supplied containers at approved accumulation sites. When containers are full or when work is complete the contractor will transfer accumulated waste, fill records, and Material Safety Data Sheets (MSDS) to the NAS Meridian’s less than 90-day storage area for disposal.
b. Non-Hazardous Solid Waste. All non-hazardous waste must be disposed of in regulated landfills in accordance with RCRA regulations. Copies of tipping documents shall be provided to the contract manager/ROICC for accountability and reporting purposes.
c. Training. Personnel handling hazardous waste must have all requisite training required by RCRA, OSHA, and DOT regulations. Training Records must be available for review.
d. Reporting/Documentation. Prior to commencement of work submit in writing a plan consisting of:
(1) An index of hazardous materials to be introduced to the site. Each hazardous material must receive approval prior to bringing onto the job site. The index must agree with list provided in the below listed clause, “Hazardous Material Inventory And Usage Log”.
(2) A copy of all MSDS, Material Safety Data Sheets for hazardous materials listed in the index of the plan along with anticipated quantities by container size. Post a copy of all Material Safety Data Sheets at the work site where the products will be used.
(3) A plan for protecting personnel and property during the transport, storage and use of the materials.
(4) Procedures for spill response and disposal.
(5) Approved labeling system to identify contents on all containers on site.
(6) Personnel training plan.
(7) A list of hazardous waste which may be generated and waste management procedures coinciding with the below listed clause, “Waste Management”.
13. HAZARDOUS MATERIAL INVENTORY AND USAGE LOG.
a. What to report: Typical materials requiring MSDS and quantity reporting include, but not limited to, oil and latex based painting and caulking products, solvents, adhesives, aerosol, and petroleum products.
b. When to report:
1. Initial. Before onsite work commences the Contractor shall submit a MSDS and estimated quantities to be used for each hazardous material to the Contracting Officer prior to bringing the material on base.
2. Progress. An updated monthly report is required with each invoice submitted for payment.
3. Final. A final report is required either, by the tenth of the month following the completion of work, or with the final invoice, which ever occurs first.
A. The final report will indicate the maximum quantity of each material that was present at the site at any time, the amount of each material that was used during the project and the final disposition of unused quantities.
B. The Contractor shall ensure that hazardous materials are utilized in a manner that will minimize the amount of hazardous waste that is generated.
C. The Contractor shall certify that all hazardous materials removed from the site are hazardous materials and do not meet the definition of hazardous waste per 40 CFR 261.
c. Use the form, “Contractor Monthly Hazardous Material Inventory And Usage Log” provided by the ROICC for reporting.
14. WARRANTY
The mechanical bedding and tree planting must be performed to the description specification and at the areas shown on the attached map.
15. DISPOSITION OF REMOVED MATERIALS
a. All trash, debris and unusable materials shall be cleaned up at the end of each workday and disposed of by removing completely from government property.
16. REGULATIONS
Contractor personnel employed on the Station shall become familiar with and obey Station regulations, shall keep within the limits of the work (and avenues of ingress and egress), and shall not enter any restricted areas unless required to do so and are cleared for such entry. Contractor equipment shall be conspicuously marked for identification.
17. UTILITY OUTAGES AND EXCAVATING
a. Responsibility for Utility Locating. The contractor shall be responsible for locating and marking all underground utilities before the permit is approved. Underground utilities include electric, gas, sanitary, water, phone, and communication cable (both wire and optical), etc.
b. Before any digging or utility outages are accomplished, the Contractor shall apply for a digging permit or outage request from Public Works Department via the Contract Surveillance Representative.
UTILITY STRIKES
It is the desire of NAVFAC to partner in every way with the contractor to assist in the avoidance of underground utility strikes. These utility strikes cause contract delays, costs and interruptions to mission support, but could also result in serious injuries or even fatalities to employees. It is expected of every Government contractor to exercise due diligence in making every possible effort to protect Government property and obey the guidance outlined in the EM‐385, “Army Corps of Engineers Safety Manual.” To this end, underground utility strikes on projects that are deemed to be due to contractor negligence shall be documented with the following actions to be taken on each construction contract:
1) The following clauses are hereby incorporated into the contract, with the sections pertinent to this directive highlighted below for contractor reference:
a. 52.236‐5, Material and Workmanship
i. "Contracting Officer may require the Contractor to remove any employee deemed incompetent, careless or otherwise objectionable."
b. 52.236‐9, Protection of Existing Vegetation, Structures, Equipment, Utilities and Improvements
i. "The Contractor shall repair any damage resulting from failure to comply with requirements of the contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor."
c. FAR 42.1503, Contractor Performance Procedures.
i. This clause allows the Contracting Officer to issue interim or final Marginal or Unsatisfactory CPARS rating if relevant overall.
2) If an underground utility is struck ‐ Upon determination of contractor fault or negligence the following actions will be enacted:
a. After the 1st strike: The contractor will immediately repair the utility AND the responsible employee will be removed from the project.
b. After the 2nd strike: The contractor will immediately repair the utility AND the responsible employee with 1st line supervisor will be removed from the project.
c. After the 3rd strike: The contractor will immediately repair the utility AND the employee, 1st line supervisor and superintendent will be removed from the project; AND the company leadership must meet with NAVFAC Leadership with corrective actions before work can restart.
4) In accordance with the above contract clauses, the Contractor will not be compensated for any costs related to any of these actions.
5) All contractor employee removals shall be reported to the Chief of Contracting Office.

21. TECHNICAL SPECIFICATION
a) Mechanical Bedding. The work to be performed under this contract consists of shearing and bedding rows in 14 foot spacing with a dozer. All bedding will be performed along the contour of the land to reduce erosion where possible. Also, there is a gas line right of way on the tract and for no reason shall any equipment cross or drive on the line to eliminate a chance of damages.
Contractor shall furnish all labor, supervision, tools, materials, equipment, and transportation necessary to perform the work. Areas that will receive work are specified on attached maps. The date shall be coordinated with the Contracting Officer.
a) Tree Planting. Contractor shall hand plant Loblolly on 6’x 14’spacing (519 trees per acre) using dibble bars. The contractor will make a hole and planting the seedling without J-rooting. The hole will be back bladed and heeled in to eliminate any air pockets around the roots. Loblolly bare-root seedling planting shall occur from December 2019 thru February 2020 unless prevented by unseasonable drought or warm weather preventing dormancy. The date shall be coordinated with the Contracting Officer.

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:
HEALTH & WELFARE: $4.54 per hour up to 40 hours per week or $181.60 per week or $786.93 per month
HEALTH & WELFARE EO 13706: $4.22 per hour up to 40 hours per week or $168.80 per week or $731.47 per month*
*This rate is to be used only when compensating employees for performance on an SCA‐ covered contract also covered by EO 13706 Establishing Paid Sick Leave for Federal Contractors. A contractor may not receive credit toward its SCA obligations for any paid sick leave provided pursuant to EO 13706.
VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor; and 3 weeks after 10 years. Length of service includes the whole span of continuous service with the present contractor or successor wherever employed and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29 CFR 4.173)
HOLIDAYS: A minimum of ten paid holidays per year: New Year's Day Martin Luther King Jr.'s Birthday Washington's Birthday Memorial Day Independence Day Labor Day Columbus Day Veterans' Day Thanksgiving Day and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)
** UNIFORM ALLOWANCE **
If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract by the employer by the state or local law etc.) the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition where uniform cleaning and maintenance is made the responsibility of the employee all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount or the furnishing of contrary affirmative proof as to the actual cost) reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However in those instances where the uniforms furnished are made of ""wash and wear"" materials may be routinely washed and dried with other personal garments and do not require any special treatment such as dry cleaning daily washing or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract by the contractor by law or by the nature of the work there is no requirement that employees be reimbursed for uniform maintenance costs.
** NOTES APPLYING TO THIS WAGE DETERMINATION **
Under the policy and guidance contained in All Agency Memorandum No. 159 the Wage and Hour Division does not recognize for section 4(c) purposes prospective wage rates and fringe benefit provisions that are effective only upon such contingencies as ""approval of Wage and Hour issuance of a wage determination incorporation of the wage determination in the contract adjusting the contract price etc."" (The relevant CBA section) in the collective bargaining agreement between (the parties) contains contingency language that Wage and Hour does not recognize as reflecting ""arm's length negotiation"" under section 4(c) of the Act and 29 C.F.R. 5.11(a) of the regulations. This wage determination therefore reflects the actual CBA wage rates and fringe benefits paid under the predecessor contract.

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e. the work to be performed is not performed by any classification listed in the wage determination) be classified by the contractor so as to provide a reasonable relationship (i.e. appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification wage rate and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR 4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract a separate SF‐1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award the contractor prepares a written report listing in order the proposed classification title(s) a Federal grade equivalency (FGE) for each proposed classification(s) job description(s) and rationale for proposed wage rate(s) including information regarding the agreement or disagreement of the authorized representative of the employees involved or where there is no authorized representative the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action together with the agency's recommendations and pertinent information including the position of the contractor and the employees to the Wage and Hour Division U.S. Department of Labor for review (See 29 CFR 4.6(b)(2)(ii)).
4) Within 30 days of receipt the Wage and Hour Division approves modifies or disapproves the action via transmittal to the agency contracting officer or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour decision to the contractor.
6) The contractor informs the affected employees.
Information required by the Regulations must be submitted on SF‐1444 or bond paper.
When preparing a conformance request the ""Service Contract Act Directory of Occupations"" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember it is not the job title but the required tasks that determine whether a class is included in an established wage determination.
Conformances may not be used to artificially split combine or subdivide classifications listed in the wage determination."

(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

Section H - Special Contract Requirements
DBIDS
Pass and ID has recently moved to the DBIDS program and currently issues scan-able cards and paper passes. The requirements for access to the Installation have been modified to take advantage of the new system. The following will assist in smooth access to the installation.
Pass and ID hours are from 0600 to 1530, from 0600 to 0730 Pass and ID can only process current DIBIDS pass/card holders, or new drivers making deliveries to the installation. The Commercial Vehicle Gate is open from 0700 to 1500 for Commercial Vehicles.
The following actions are necessary for contractors to enter Naval Air Station Meridian:
New SECNAV 5512/1 (Background Forms) must be completed and turned in to Pass and ID by the individuals Base Sponsor at minimum 5 Business Days Prior. All individuals entering the installation will need to complete the following tasks:
1. Completing a SECNAV 5512/1
2. Provide two forms of Government ID, for example a Valid Driver’s License, Social Security Card, Current
Firearms Permit, or Hunting/Fishing License.
3. Provide proof of Current Insurance and Vehicle registration.
4. Be entered into the DBIDS system (takes about 5 to 10 minutes)
Pass and ID will no longer process SECNAV 5512/1 forms that are faxed or emailed from individuals or walk-ins, without prior approval from the Base Sponsor. For the purposes of base sponsorship, the contractor may list the Contracting Officer as a base sponsor. Pass and ID issues daily passes, but If a contractor is completing a project that will take more than one day, Pass and ID can issue an extended Pass at the request of the Contractor’s Base Sponsor no exceptions. Extended requests should include the name of the individuals to receive an extended pass and a start and end date.
