This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on NECO (https://www.neco.navy.mil).
DESCRIPTION
The RFQ number is N68836-18-R-0021. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-95 and DFARS Publication Notice 20161222. It is the responsibility of the Contractor to be familiar with the applicable clauses and provisions. The NAICS code is 332312 and the Small Business Standard in number of employees is 500. The Small Business Office concurs with the set-aside decision.

The T-6 aircraft dimensions are 33 feet and 5 inches wingtip span, 33 feet and 4 inches in length, and 10 feet and 8 inches in height.
Warranted for 15 years minimum.
All aircraft shelter frames shall be galvanized, all structural steel painted, and other metals to be suitably coated to resist damage and corrosion in service.
Shades shall be certified by a Professional Engineer to conform to Uniform Building Code.

DESCRIPTION OF REQUIREMENTS
Aircraft Protective Equipment Protective Shades for T-6 and T-44 Aircraft
1.0. SCOPE:
The Contractor shall provide shelters (sun shades) or aircraft protective equipment to cover and protect aircraft from ultraviolet (UV) rays and the avionics from heat damage for Chief of Naval Air Training (CNATRA) at Naval Air Station Corpus Christi, TX. In order to accomplish this requirement, the Contractor shall be required to obtain a NAS Corpus Christi Field flight line driver’s license, have the ability to use, and provide portable radios. Similarly, Contractors shall pass a written exam approved by NAS Corpus Christi for Runway Orientation Class for access (Flight Line pass) in order to operate all equipment required to complete this requirement.

1.3. Project Description and Location:
This project requires the design, fabrication, and installation of protective shades, designated as Aircraft Protective Equipment (APE), to cover T-6B turboprop aircraft and T-44 multi-engine aircraft at Naval Air Station (NAS) Corpus Christi, TX. The purpose is to protect aircraft from sun exposure and possible hail damage. A double APE shall hold (2) two parked aircraft and the single APE shall hold (1) one parked aircraft (see attachment B). The site plan is for the following:
· (31) Double (cover) APE’s that accommodate 62 T-6 training aircraft to be built along rows Alpha through Echo.
· (7) Single (covered) APE’s that accommodate (7) seven T-6 training aircraft to be built along rows Alpha through Echo.
· (34) Single (covered) APEs that accommodate 34 T-44 training aircraft on rows Echo through India adjacent to hangars 56, 57 and 58.

1.4. Dimensions and Clearances:
Minimum clearances as required by the U.S. Navy are 10 feet wingtip clearance and 3 feet vertical clearance between the highest point of the aircraft and the underside of the shade supporting structure. All minimum clearances are measured to the interior of the shelter. The minimum height shall be maintained for the full width and length of the shade. Aircraft shelters shall comply with the following dimensions:

· The T-6 aircraft dimensions are 33 feet and 5 inches’ wingtip span, 33 feet and 4 inches in length, and 10 feet and 8 inches in height.
· T-6 aircraft height is 10 feet and 8 inches (+ 5 feet, required clearance over the height of the aircraft) equal 15 feet and 8 inches.

T-44 Aircraft:
· The T-44 aircraft dimensions are 50 feet and 3-inch wingspan, 35 feet and 6 inches in length, and 14 feet and 3 inches in height. The required vertical clearance is 5 feet over the height of the aircraft.
· The T-44 aircraft height is 14 feet and 3 inches (+ 5 feet, required vertical clearance over the height of the aircraft) equal 17 feet and 3 inches.

APE Dimensions:
T-6 Single APE:
· Maximum height of shelter, 17 feet
· T-6 width is 33 feet and 4 inches
· In the single shelter the wing tip to virtual interior wall surface shall be no less than 10 feet
· T-6 single shelter interior width required is 53 feet and 4 inches
· Shelter shall conform to existing aircraft layout on the apron
· No space requirements between the shelters Refer to T-6 APE dimension in attachment “B and C”
T-6 Double APE:
· Maximum height of 17 feet
· In the double shelter the wing tip to wing tip shall be no less than 10 feet
· In the double shelter the wing tip to virtual interior wall surface shall be no less than 10 feet
· T-6 double shelter interior width required is 96 feet and 8 inches
· Shelter shall conform to existing aircraft layout on the apron
· No space requirements between the shelters Refer to T-6 APE dimension in attachment “B and C”
T-44 Single APE:
· Maximum height of shelter, 25 feet
· T-44 width is 50 feet and 3 inches
· In the single shelter the wing tip to virtual interior wall surface shall be no less than 10 feet
· T-44 single shelter interior width required is 70 feet and 3 inches
· Shelter shall conform to existing aircraft layout on the apron
· No space requirements between the shelters Refer to T-44 APE dimension in attachment “B and D”
Max height of structure shall not to exceed 17' for T-6 and 25' for T-44. Refer to attachments “B, C, and D”
Design shall ensure Navy clearance requirements are as required by NAS Corpus Christi Base Operations.
1.5. Coverage:
Overhead coverage is the primary objective of the covers. Ends shall be open. Side coverage is not required, but, if normally provided as a standard feature of the structure, sides shall have a 10-foot vertical clear opening minimum. All shades shall be drive-thru configuration with no obstructions in the ends below the minimum interior height.

1.6 Description Requirements
The Contractor shall:
1. APE’s shall be warranted for 15 years. Minimum grab tensile strength shall be 650 lbs/sq. in. Fabric shall meet or exceed Polyvinyl chloride (PVC) coated polyester with flame retardant UV inhabitant material that conforms with NFPA 701 and ASTM E84 standards.
2. All aircraft shelter frames shall be galvanized, all structural steel painted, and other metals to be suitably coated to resist damage and corrosion in service. Contractor is to provide copy of warranty on coatings. Shades shall be certified by a Professional Engineer to conform to Uniform Building Code. The steel should meet ASTM A123/A123 due to the proximity to salt water.
3. All connections, fabrication, workmanship, erection, and details shall be IAW AISC Manual of Steel Construction as applicable to the proposed solution. All tabs and mounting plates shall be hot-dipped galvanized before welding. All welds shall be hand brushed with 97 percent zinc cold galvanizing. All connections shall be ASTM A325 structural grade minimum 5/8” bolts or better. All hardware shall meet ASTM A153/A154 due to the proximity of salt water.
4. Shades and structure shall be designed to withstand sustained wind of 149 M.P.H in compliance with the UFC 3-301-01, page 74, table E-1, 1 June 2013, Change 3, 12 September 2016. Design wind speed requirement for Corpus Christi are listed as; Risk Category II, 149 MPH. The shades shall be designed to withstand hail up to 1.5 inches in diameter with fabric in place.
5. The parking apron where the APE’s shall be erected, consists of asphalt (47 for T6 aircraft and 16 T-44 aircraft) and concrete. The concrete section varies in thickness from 6-12 inch Portland concrete. Asphalt thickness is undefined. The Contractor shall have a Professional Engineer design and certify the methods of connection between the shade and the concrete and the shade and asphalt. The Government Engineer will review and approve the designs prior to the beginning of installation. The Contractor shall be responsible for load testing the structure and connection in all areas to meet the description requirements of this section. APEs shall be anchored to meet the standards of the description requirements. Industry standards will be taken into consideration. Additionally, the Contractor shall coordinate with the Government Engineer for the following: (a) inspection of shelter connections prior to continuing with the remaining shelter installation, (b) for inspection of completed structures prior to installation of fabric, and (c) upon completion of installation (including fabric). IAW all ASIC and ASTM industry standards.
6. In the occurrence that any or all of the load tests fails to meet description requirements, building codes, or any other deficiency discovered by the Government Engineers, the Government will issue a stop-work order and or delay of work immediately IAW FAR 42.1303 and 42.1304. At that point, the CNATRA at NAS Corpus Christi will begin the evolution to contract/subcontract (through the appropriate contract activity, such as NAVFAC) any and all construction work that may be required to complete current contract conditions and or meet or exceed the description requirements.
1.7. Installation:
The Contractor shall submit a site plan for set up not later than 30 days ARO. The site plan shall be coordinated with the TPOC for site safety and facility engineers to establish an acceptable work plan which shall include a work phasing plan, CAD drawing layout of shades, and location of continuous FOD fence around the work perimeter. Work phasing shall be coordinated with the TPOC for the local activity to allow adequate parking for aircraft during set up of the shades. The Contractor shall complete set-up and Government acceptance (IAW FAR Part 46) of one shelter (APE) before proceeding to the next (APE) phase. Site clean-up shall be continuous. No performance or work shall begin until the Government Engineer approves of site plan.
1.8. Lightning protection:
Shelter solution shall include lightening protection as part of installation. Lightening protection shall be meet or exceed UL Lightning protection systems and conform with NFPA 780 standards.
1.9. Maintenance manual:
The Contractor shall provide the Government with detailed, written procedures for mandatory preventative maintenance of the shades to preclude voidance of the warranty and to extend the service life of the shades.
1.10. Shipping and storage:
The Contractor shall be responsible for shipping and delivery. The Government will provide appropriate staging areas for materials and equipment on the facility, however the Contractor is responsible for receipt of material and the safety/security of materials and equipment whether stored or installed, until accepted by the Government.
1.11. Delivery:
The Contractor shall propose a delivery schedule that supports the proposed phased installation plan. CAD drawings are required 30 days after ARO. If, the Government Engineer rejects the first submittal of CAD drawings, the Contractor shall have 30 days to resubmit for Government approval. No performance or work shall begin until the Government Engineer approves of CAD drawings. Delivery and installation shall begin no later than 90 days ARO and completed no later than 180 days ARO. The proposed delivery and installation phasing plan shall be approved by the TPOC.
1.12. Delivery Phasing:
Phasing and installation will be worked around flight schedules.
1.13. Management and Administration:
The Contracting Officer (KO) has ultimate authority for administration of this contract. The KO may delegate authority to a Technical Point of Contact (TPOC), and or other Government representatives associated with specific functions.
2.0. WORK RESTRICTIONS:
2.1. Special Scheduling Requirements:
Have materials, equipment, and personnel required to perform the work at the site prior to the commencement of the work.
The Contractor shall conduct operations so as to cause the least possible interference with normal operations of the activity.
Permission to interrupt any activity roads, railroads, and/or utility service shall be requested in writing a minimum of 15 calendar days prior to the desired date of interruption.
2.2. Flight Line Driver’s License:
Personnel driving on the flight line shall be required to get a NAS Corpus Christi Field flight line driver’s license. Coordinate with the TPOC.
2.3. Contractor Employment Eligibility Verification:
IAW FAR Clause 52.222-54 – “Employment Eligibility Verification.” Contractors and subcontractors are required to abide by Department of Homeland Security requirements for verification of worker employment eligibility. This is in support of detection and apprehension of illegal alien/undocumented workers. To this end, base access procedures for badge issuance include on-site verification of base sponsorship and supporting documentation. Contractors who choose not to participate in the program will be required to obtain daily business passes at the pass office. Badges/passes are the property of the Government and must be displayed as required by the Installation Security Department. It is the sole responsibility of the Contractor to see that all badges issued to their employees are returned in accordance with these provisions. Upon expiration of the contract, all employees' passes and badges shall be deactivated and the base access privileges revoked until such time base access is again required/authorized. Due diligence on your part in screening employees is required because the Government is not responsible for work Delays or Stoppages caused by the Contractor/sub-contractor's failure to comply with registration and access requirements, nor is the Government responsible for program fees lost due to ineligible personnel. Also be aware, that the Contracting Officer is required to consider debarment proceedings where repeated or egregious violations of access control requirements are found. In addition to these provisions the Contractor shall also comply with all additional base procedures for applying to obtain commercial passes for entry to this facility. To obtain additional information regarding base access, please contact the pass and ID office at 361-961-1356.
It should be recognized that requirements for security and base access varies between bases as well as between various locations within individual bases. It is incumbent on the Contractor to ascertain the current security and base access requirements appropriate to the project location and incorporate the cost, if any, for compliance to said requirements into Contractor's proposal. Lack of knowledge of current requirements does not constitute a basis for an adjustment to the contract. Should requirements change during the construction timeframe, Contractor may be eligible, subject to documentation acceptable to the Government, for an adjustment to the contract.
Contractor personnel employed on the Activity shall become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. A Safety, fire, traffic, and security required information/regulations will be provided at Kick-off meeting. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment shall be conspicuously marked for identification.
2.4. Defense Biometric Identification System (DBIDS):
The Defense Biometric Identification System (DBIDS) is a DoD-owned and operated system developed by Defense Manpower Data Center as a force protection program to manage personnel identity and access at DoD installations. DBIDS is a network database system designed to easily verify access authorization of personnel entering military installations by using barcodes and fingerprint biometric identifications.
In order to obtain base access, an individual need to acquire DoD sponsorship, have a thorough identity check, be properly vetted, and have a legitimate reason for base access. Identity checks require a passport or a Real ID Act-compliant state driver's license. Vetting occurs when the individual's background and ID are compared against authoritative criminal justice data bases, and the individual has a letter or official document from the sponsoring organization which articulates the reason for access. When the above criteria are satisfactorily met, DBIDs credentials are issued.

2.5. Subcontractors and Personnel Contacts:
Furnish a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
2.6. No Smoking Policy:
The Contractor shall comply with local command smoking policies and workforce requirements. The Contractor shall also comply with all Federal statutes, laws, and regulations to implement a DFWP as well as work force requirements and local command policies. Smoking is prohibited within and outside of all buildings on installations except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The TPOC will identify designated smoking areas.
2.7. Working Hours:
Working hours will be coordinated with the TPOC at NAS Corpus Christi. The core hours of operation are between 0730-1630.
2.8. Federal Holidays:
The below list contains the holidays that are observed by the Government. Contractors will not be permitted on station during federal holidays.

3.0. SPECIAL PROJECT PROCEDURES:
3.1. REFERENCES:

3.2. DEFINITIONS:
The significance of the following definitions is to provide situational awareness to the Contractor.
3.2.1. Safety Precaution Areas:
“Safety Precaution Areas” means those portions of approach-departure clearance zones and transitional zones where placement of objects incident to contract performance might result in vertical projections at or above the approach-departure clearance, or the transitional surface.
a) The “approach-departure clearance surface” is an extension of the primary surface and the clear zone at each end of each runway, for a distance of 50,000 feet, first along an inclined (glide angle) and then along a horizontal plane, both flaring symmetrically about the runway centerline extended.
1. The “inclined plane” (glide angle) begins in the clear zone 200 feet past the end of the runway (and primary surface) at the same elevation as the end of the runway. It continues upward at a slope of 50:1 ((1) one foot vertically for each 50 feet horizontally) to an elevation of 500 feet above the established airfield elevation. At that point the plane becomes horizontal, continuing at that same uniform elevation to a point 50,000 feet longitudinally from the beginning of the inclined plane (glide angle) and ending there.
2. The width of the surface at the beginning of the “inclined plane” (glide angle) is the same as the width of the clear zone. It then flares uniformly, reaching the maximum width of 16,000 feet at the end.
b) The “approach-departure clearance zone” is the ground area under the approach-departure clearance surface.
c) The “transitional surface” is a sideways extension of all primary surfaces, clear zones, and approach departure clearance surfaces along inclined planes.
1. The “inclined plane” in each case begins at the edge of the surface.
2. The “slope of the incline plane” is 7:1 ((1) one foot vertically for each (7) seven feet horizontally). It continues to the point of intersection with the —
i. “Inner horizontal surface” (which is the horizontal plane 150 feet above the established airfield elevation); or
ii. “Outer horizontal surface” (which is the horizontal plane 500 feet above the established airfield elevation), whichever is applicable.
d) d. The “transitional zone” is the ground area under the transitional surface. (It adjoins the primary surface, clear zone, and approach-departure clearance zone.)
3.2.2. SUBMITTALS:
The “G” designation stands for Government. Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for Contractor Quality Control approval. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with DOD UFGS, Section 01 33 00: The "G" designation identifies the submittals that need to be reviewed by the Government (the TPOC) for approval prior to proceeding with work. The following Submittals are to be submitted to the Government for approval within 30 days of contract award. If the Government disapproves a Submittal by the Contractor, the Contractor shall submit a revised submittal within 30 days of rejection notification by the Government.

4.0. EXECUTION:
4.1. HAZARDS TO AIRFIELD OPERATION:
In addition to "DFARS 252.236-7005, Airfield Safety Precautions," the following paragraphs apply.
4.2. Work in Proximity to Runways and landing Strips:
Accomplish all construction work on the runways, taxiways, and parking aprons and in the end zones of the runways and 75 feet to each side of the runways and taxiways, the landing strip, 75 feet to each side thereof, and on the taxiways and parking aprons with extreme care regarding the operation of aircraft.
Cooperate closely, and coordinate with the Operations Officer and the TPOC. Park equipment in an area designated by the TPOC. Parking of equipment, vehicles, or any type of storage overnight or for any extended period of time in the proximity of the landing areas or taxiways is strictly prohibited. Leave no material in areas where extreme care is to be taken regarding the operation of aircraft.
4.3. Schedule of Work/Aircraft Operating Schedules:
Scheduled work shall conform to aircraft operating schedules. In the event of emergency, intense operational demands, adverse wind conditions, and other such unforeseen difficulties, the Contractor shall cease operations at the specified locations in the aircraft operational area for the safety of the Contractor and military personnel and Government property. Submit a schedule of the work to the TPOC for transmittal to the Operations Officer describing the work to be accomplished; the location of the work, noting distances from the ends of landing areas, taxiways, landing strips and buildings and other structures as necessary; and dates and hours during which the work is to be accomplished. Keep the approved schedule of work current, and notify the TPOC of any changes prior to beginning each day's work.
Prior to commencement of work, submit the following to the TPOC for transmittal to the Operations Officer:
· Existing Conditions Survey
· Construction Operations Plan
· Safety Plan
· Heavy Equipment and Vehicle List
Where flying is controlled, additional permission shall be obtained from the control tower operator to enter a landing area unless such area is marked as hazardous to aircraft.
4.4. Daytime Markings:
During daylight, mark stationary and mobile equipment with international orange and white checkered flags, mark the material, and work with yellow flags or yellow rotating flashing light.
Vehicles operating in the landing area must be identified by means of a flag on a staff attached to and flying above the vehicle. Flag size must be not less than (3) three feet square and consist of a checkered pattern of international orange and white squares not less than (1) one foot on each side. Flags varying in any dimension by not more than 10 percent of the specified dimensions are considered to comply with the stated requirements.
4.5. Nighttime Markings:
During nighttime, which begins (2) two hours before sundown and ends (2) two hours after sunrise, mark stationary and mobile equipment and material, and work with battery-operated, low-intensity, red flasher lights. Department of Transportation (DOT) tape is required on each pole with green and red wayfinding signs.
Where the Operations Officer, determines that the red flasher lights may confuse pilots approaching for landings, the Contracting Officer may direct that the red flasher lights be left off or that the color of the lights be changed.
Light construction and installation shall comply with FAA AC 70/7460-1.
Lights shall be operational during periods of reduced visibility, darkness, and as directed by the Contracting Officer.
No separate payments will be made for lighting and protection necessitated by the safety provisions.
4.6. Excavation:
Open only those trenches for which material is on hand and ready for placing therein. As soon as possible after the material has been placed and work approved, backfill and compact the trenches as specified.
Maintain landing areas at all times free from hazards, holes, material piles, or projecting shoulders that might damage tires or landing gear. Paved surfaces must be kept clean at all times and free from small stones or other objects which could cause damage to propellers, craft, and personnel.
4.7. Contractor Safety Precautions:
The Contractor is on notice that aircraft operations will produce extremely high noise levels and will induce vibrations in pavements, structures, and equipment in the vicinity, and may result in high velocity flying debris in the area. The Contractor shall be responsible for providing all necessary personal protective equipment such as eye protection, ear/hearing protection, and any and all other safety equipment for his/her personnel protection. The purpose for insuring personal protective equipment is to eliminate hazards, potential injuries, accidents.
The Contractor is solely responsible for compliance of all safety regulations of employees’ while working on Government owned facilities. All accidents which may arise out of, or in connection with, performance of services required herein which result in injury, death, or property damage, shall be reported in writing to the Contracting Officer and cognizant Technical Point of Contact within twenty-four hours of such occurrence. Reports shall provide full details of the accident, including statements from witnesses. The fore-going procedures shall also apply to any claim made by a third party against the Contractor as a result of any accident that occurs in connection with performance under this contract.
Boundary areas for hazardous work locations and restrictions are defined in FAA AC 150/5300-13.
Construction activity within the limits of the boundary areas without approval of the Contracting Officer is prohibited.
Provide a minimum of (2) two aviation red or high intensity white obstruction lights on temporary structures (including cranes) over 30 meter 100 feet above ground level.
4.8. Foreign Object Damage (FOD):
Aircraft and aircraft engines are subject to FOD from debris and waste material lying on airfield pavements. The Contractor shall remove all such materials that may appear on operational aircraft pavements due to the Contractor’s operation. The Contractor shall also install a temporary barricade at the Contractor’s expense to control the spread of FOD potential debris into operational areas. Remove barricades when no longer required. Barricades shall be designed to withstand jet blast from taxing aircraft.
4.9. Radio Contact:
Provide necessary battery powered portable radios. During work within the airfield area, the Contractor shall have an operator (who speaks fluent English) available for radio contact with the tower at all times. Radio frequency must be approved by the tower.
Radio may be checked out from the tower each workday for communication.
4.10 Equipment Operators:
All Equipment & vehicle operators shall attend class and pass a written exam approved by NAS Corpus Christi for Runway Orientation Class for access (Flight Line Pass). Class schedule will be promulgated by the TPOC; length of class is approximately 2.0 hours.

CLAUSES INCORPORATED BY FULL TEXT
52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)
(a) Definition. As used in this provision-- Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.
(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.207-4 ECONOMIC PURCHASE QUANTITY--SUPPLIES (AUG 1987)
(a) Offerors are invited to state an opinion on whether the quantity(ies) of supplies on which bids, proposals or quotes are requested in this solicitation is (are) economically advantageous to the Government. _________________________________________________________________________ _________________________________________________________________________ _________________________________________________________________________
Each offeror who believes that acquisitions in different quantities would be more advantageous is invited to recommend an economic purchase quantity. If different quantities are recommended, a total and a unit price must be quoted for applicable items. An economic purchase quantity is that quantity at which a significant price break occurs. If there are significant price breaks at different quantity points, this information is desired as well.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.
