DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION IN REPLY REFER TO:

LJ&A_18_0358

LIMITED SOURCE JUSTIFICATION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ

2. Nature and/or Description of Action being Approved.

This justification and approval authorizes and approves on a limited competition bases the issuance of a Fixed-price five (5) year Indefinite Delivery Indefinite Quantity (IDIQ) contract for Eventide Inc., (Eventide) NexLog 740 data recorder brand name equipment. This acquisition will be issued on Federal Business Opportunity website as a limited competition between the Original Equipment Manufacturer and its authorized distributors via the FedBid.com website for participation in a reverse auction.

3. Description of the Supplies or Services Required to Meet the Agency’s Needs (including the estimated value).

NAWCAD, Ship & Air Integrated Warfare, AIR-4.11.3, is tasked to support the Arleigh Burke-class destroyer DDG-51 shipbuilding program by procuring and integrating Eventide NexLog 740 data recorders into the ship’s communications systems. Older data recorders on older ships are failing, and need to be replaced with more modern, capable, and reliable data recorders. This procurement is for various Eventide NexLog 740 data recorder equipment required to meet the needs of the Fleet.

Total $63.0 $167.8 $167.8 $146.9 $147.0 $147.0 $839.5

4. Identification of the Justification Rationale (see FAR 8.405-6(b)) and, if applicable, a Demonstration of the Proposed Contractor's Unique Qualifications to Provide the Required Supply or Service.

FAR 8.405-6(b), Items peculiar to one manufacturer

5. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value

Consistent with FAR 8.404(d).

The Eventide NexLog 740 data recorder is a commercial off the shelf item, and is the only data recorder that is technically acceptable for use in the Arleigh Burke-class destroyer DDG-51 shipbuilding program.

The Eventide NexLog 740 was evaluated against three (3) other recorders for use in the RD-674D

Recorder Reproducer. Based on evaluation results, the U.S. Coast Guard recommended the NexLog 740 data recorder for use in the DDG-51 shipbuilding program. It has passed Military Specification (MIL-S)- 901D shock testing and Military Standard (MIL-STD)-167-1A mechanical vibration testing essential for the operations environment. The MIL-S-901D testing was completed 27 March 2014 and MIL-STD-167-1A testing was completed 7 January 2015. MIL-S-901D and MIL-STD-167-1A are shipboard environmental tests and ensure that equipment placed on ships can survive in the unique environment. MIL-S-901D ensures the equipment does not become a hazard to personnel if the ship undergoes a shock event (i.e.

coming in contact with another ship). MIL-STD-167-1A simulates the environmental loads equipment will undergo on a ship throughout its lifecycle and ensures its sustainability.

The Eventide NexLog 740 data recorder is a part of the design package that has been provided to shipbuilders as part of a multi-year procurement of ships by the U.S. Navy. If another vendor were to manufacture the Eventide NexLog 740 data recorder, the Government would experience changes to the shipbuilders’ contracted designs, and incur undesirable and non-budgeted charges for post-contract design changes to the ships of approximately $100K and a one (1) year delay in schedule. The NexLog 740 is a critical component of the RD-674D Recorder Reproducer. Any changes to the NexLog 740 data recorder would nullify the shock and vibe certifications and also result in changes to the RD-674D Recorder Reproducer. The design data for the RD-674D Recorder Reproducer has been provided to the shipbuilders and changes in design require an Engineering Change Proposal (ECP) to incorporate them into the shipbuilder’s design. A retest, redesign, and ECP will result in an estimated 30 month delay in schedule.

6. A Description of the Market Research Conducted among Schedule Holders and the Results or a

Statement of the Reason Market Research was not Conducted.

Market research was conducted via Internet searches on Google and General Services Administration which identified numerous manufacturers and vendors such as Puget Sound Instrument Company, Vista Com, El Paso Communication Systems, Inc., Honeywell International Inc., Onset Computer Corporation, Goserco, Inc., and Carolina Recording Systems, LLC and none were found that passed the required MIL-S- 901D shock testing and MIL-STD-167-1A mechanical vibration testing, and met the form, fit, and function of the obsolete equipment which it is replacing.

This requirement will be a limited competition for the required Eventide brand name data recorders via the FedBid website. In accordance with FAR 12, Streamlined Acquisitions for Commercial Items, a combined synopsis/solicitation will be posted.

7. Any other Facts Supporting the Justification.

In accordance with FAR 15.305(a)(1), competition establishes price reasonableness. Therefore, when contracting on a firm-fixed basis, comparison of the proposed prices will usually satisfy the requirements to perform a price analysis, and a cost analysis need not be performed. In addition, Certified Cost or Pricing Data is not required in accordance with FAR 15.403(c)(1)(i).

8. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers that Preclude the Agency from Meeting the Requirements of FAR 8.405-1 and FAR 8.405-2 before any Subsequent Acquisition for the Supplies or Services is Made.

For the reasons stated above, at this time, only Eventide Brand Name NexLog 740 data recorders can meet the requirements of this effort. The Government will continue to evaluate other technologies that would allow future competition by attending industry trade shows and hosting on-site vendor visits to learn more about specific manufacturers and products and conduct market research to determine if there are any future vendors that have the capability to meet this requirement.
