J&A Number: 16-0334

DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

IN REPLY REFER TO:

LIMITED SOURCE JUSTIFICATION

J&A Number: 16-0334

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Nature and/or Description of Action Being Approved.

This acquisition is being conducted under the authority of the Multiple-Award Schedule Program. The Department of Navy (DoN) has issued a policy mandating only the Naval Supply System Command (NAVSUP) suite of strategically sourced Blanket Purchase Agreements (BPAs) be used for ordering office, dorm and quarters, child development, and industrial and institutional furniture falling within the scope of specific SINs. This justification and approval authorizes and approves a Navy BPA order be issued, under one of the strategically sourced BPAs, for Lista International brand calibration workstations for the NAVAIR Calibration Laboratory located at the Fleet Reserve Center Southeast (FRCSE), Jacksonville FL.

3. Description of the Supplies or Services Required to Meet the Agency’s Needs (including the estimated value).

This procurement entails one hundred and twenty-three (123) Lista brand workstations in five (5) different configurations and associated accessories with an estimated value of $203,000. Workstations shall arrive assembled and ready-to-use after a four (4) to five (5) week lead time.

4. Identification of the Justification Rationale (see FAR 8.405-6(b)) and, if applicable, a Demonstration of the Proposed Contractor's Unique Qualifications to Provide the Required Supply or Service.

FAR 8.405-6(b), Items peculiar to one manufacturer.

Lista International is the industry leader in technical lab workbenches. The FRCE Jacksonville lab utilizes sensitive electrical components that require integral static dissipative capability to prevent irrevocable damage to equipment and personnel. Lista International products are required to match the existing products within the lab.

5. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with FAR 8.404(d).

Two BPA vendors; LC Industries. Inc. Durham, NC and Modern Business Equipment, Inc., Augusta GA, have been identified that offer the required Lista workbenches. Priced offers are expected from these two vendors. Award will be made on the basis of competition and to the lowest priced technically acceptable offeror.

6. A Description of the Market Research Conducted among Schedule Holders and the Results or a Statement of the Reason Market Research was not Conducted.

Lista International Navy Furniture BPA N00189-11-A-0110 expired and was not replaced with another BPA. According to Lista International there are no authorized Lista distributors among those on the Navy Furniture BPA list of vendors. LC Industries, however, is able to provide Lista products through their Navy BPA N00189-11-A-0109. A Request for Information (RFI) was issued to find out if any other BPA holder could provide the furniture. Three companies responded; Techni-Tool, Inc., Starboard Technology and BenchPro,Inc., none of which are BPA holders. BPA vendors under SINs 711 2 Worksurfaces, Workstations, Computer Furniture and Accessories and under SIN 71 310 Industrial and Institutional Furniture were contacted with the RFI information. Another vendor listed under SIN 711 2, Modern Business Equipment, Inc., Augusta GA, responded stating that they could meet the requirement through their BPA N00189-11-A-0114.

Concurrent with the RFI issuance, the Federal Prison Industries was contacted to determine if they would submit a quote in response to a possible competitive procurement, as required by FAR 8.602 (a) (1). They responded via email on 28 April 2016 stating that UNICOR would “not be responding to this opportunity”.

7. Any Other Facts Supporting the Justification.

N/A

8. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers that Preclude the Agency from Meeting the Requirements of FAR 8.405-1 and FAR 8.405-2 before any Subsequent Acquisition for the Supplies or Services is Made.

The DoN utilizes mandatory BPAs for furniture requirements. Therefore, solicitations for furniture procurements are restricted to vendors identified on the DoN Furniture BPA vendor list maintained by NAVSUP Fleet Logistics Center (FLC Norfolk) through the DoN Strategic Sourcing Program. Any subsequent acquisition for this requirement will be solicited among the listed vendors.
