SUMMARY OF CHANGES:
SECTION C - DESCRIPTIONS AND SPECIFICATIONS
The following have been modified:
STATEMENT OF WORK
0.0. INTRODUCTION
The Naval Surface Warfare Center Philadelphia Division (NSWCPD) is a Department of Defense entity responsible for research and development, test and evaluation, engineering and fleet support organization for the Navy’s ships, submarines, military watercraft and unmanned vehicles. This requirement is for NSWCPD Code 437, which is responsible for procuring subsea hydraulic actuators for a U.S. Navy application.
0.1. BACKGROUND
The U.S. Navy has a need for a technical data package for multi-stage and single stage hydraulic actuators which will be used in a subsea application on a U.S Navy System. The single-stage design will require both a port and starboard variant. In addition, The U.S. Navy has a need for prototype units for each multi-stage and single stage hydraulic actuator design which will be used in a subsea application on a U.S Navy System.
Detailed design requirements can be found in Section 3 of the Statement of Work (SOW).
0.2. SCOPE OF WORK
The contractor shall provide one (1) single-stage design (inclusive of each variant) and one (1) multi-stage design for hydraulic actuators in accordance with Section 3 of the SOW. The base contract shall culminate with the delivery of a production level Technical Data Package (TDP) per CDRL B001, testing and acceptance procedures per CDRL A005, and logistic and design documentation for each design as defined in CDRLs A004, A006, A007, and A008. More detail for these CDRLs can be found in Section 4. All data rights related to these CDRLs and the TDPs (CDRL B001) shall become the property of the Government at the time of delivery.
During the course of design development, the contractor shall support two (2) design reviews at their location.
The Preliminary Design Review (PDR) shall be scheduled by the contractor No Later Than (NLT) fourteen
(14) weeks after date of contract award once the design concept and analysis are mature enough to proceed into detailed design. The PDR shall be scheduled such that changes in the design based on government feedback have minimal schedule impacts. The Critical Design Review (CDR) shall be scheduled NLT twenty-four (24) weeks after date of contract award and shall serve as the final review of the design, Technical Data Package, and CDRLs. The content expected at both of these reviews is outlined in CDRL A002 in Section 4 of this document.
In addition to the design reviews, the contractor shall be available for informal working meetings with NAVSEA and NSWCPD technical personnel to be held as mutually agreed to discuss the direction, progress, and/or problems which occur during execution of this effort.
At the Government’s discretion, Option Year 1 may be invoked in which the contractor shall produce and deliver one (1) multi-stage design, and two (2) single-stage designs, one (1) of each variant. This option shall include all costs associated with the procurement of manufacturing and testing equipment needed to fully produce and test the actuators. After passing all required testing, actuators ordered under this option shall be delivered to the Government sixty (60) weeks after the option is exercised. In addition, the contractor shall deliver the Quality Assurance Program Plan (CDRL A009) no later than thirty (30) day before production work is scheduled to begin.
The contractor shall perform first article and qualification acceptance testing on all actuators produced under this option per the approved procedures generated during the base contract. Should any changes be needed due to issues found during testing, the contractor shall perform these design changes, update all technical documentation, produce new actuators meeting the updated design(s), and rerun all testing at no additional cost to the government. Only with approval from the Government shall the previously tested actuator(s) be modified to be in conformance with the new design and accepted in place of a new actuator(s). The Government shall be invited and allowed access to witness all testing.

SECTION I - CONTRACT CLAUSES
The following have been modified:
52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor once CLINs 0001 and 0002 have been submitted and evaluated. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
(End of clause)
NOTE:
As per FAR 12.207, Exercise of Option, the Contracting Officer may exercise Option Year 1 (CLIN 0003) only after determining that the requirement covered by the option fulfills an existing Government need and is the most advantageous method of fulfilling the Government’s need. The Contracting Officer will also take into consideration price and other factors when making this determination.
Upon timely submittal of CLINs 0001, Technical Data Package (TDP) for Single Stage Actuator, and CLIN 0002, Technical Data Package (TDP) for Multi Stage Actuator, in accordance with the Statement of Work, Attachment 1 and CDRLs A004 through A008 and B001, the Government reserves the right to exercise Option Year 1. It should be noted that if this RFP results in more than one (1) award, the Government also reserves the right to exercise one
(1) or both of the awardees’ options as per the below evaluation procedures.
The exercise of Option Year 1 will be determined based on a technical evaluation of the following factor:
OPTION YEAR 1 TECHNICAL EVALUATION FACTOR
FACTOR 1
Design Complexity of CLIN 0001 and CLIN 0002 Technical Data Packages (TDP) in accordance with the Statement of Work in Section C, Attachment 1 and CDRLS A004 through A008 and B001
FACTOR 2 Price of CLIN 0003
FACTOR 1 - DESIGN COMPLEXITY OF CLIN 0001 AND CLIN 0002 TECHNICAL DATA PACKAGES
The Government will evaluate the design complexity of the delivered Technical Data Packages (TDP) for CLINs 0001 and 0002 relating to manufacturability, maintainability, and ease of installation of the option prototype. In accordance with B001, designs that show a reduced number of parts and commonality among parts will be rated more favorably then designs that do not illustrate this design functionality. Offerors whose design show ease of maintenance and ease of installation will be evaluated more favorably then designs that do not show this capability.
EVALUATION APPROACH
The Government will utilize the subjective best value, tradeoff process when evaluating the above technical factor.
This process allows for a tradeoff between the above non-price factor and the price of CLIN 0003, and allows the Government to accept other than the lowest priced proposal or other than the highest technically rated TDP to result in the exercise of Option Year 1.
PRICE OF CLIN 0003
The Government will evaluate the price of CLIN 0003 for the exercise of Option Year 1.
RELATIVE IMPORTANCE OF EVALUATION FACTORS – OPTION YEAR 1
All evaluation factors other than price, are approximately equal to price. However, when the non-price factors are rated more equally between offerors, price becomes more of a deciding factor in determining best value.
OPTION EVALUATION INSTRUCTIONS
The Government intends to evaluate the TDPs and exercise Option Year 1 without communications/discussions with awardees. Additionally, it should noted that the Government reserves the right of flexibility in conducting the evaluation as is necessary to assure that the exercise of the option is in the Government's best interest, including reserving the right to conduct communications/discussions with the awardees.
