Computer Aided Dental Prosthetic Items J&A #17-10155
JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification for other than full and open competition, specifically the use of brand name descriptions, is executed by the Naval Medical Logistics Command, Fort Detrick, Maryland in order to meet Defense Health Agency requirements.
2. Nature and/or description of the action being approved.
The Government intends to issue a solicitation for computer aided dental prosthetic items that contain the following brand name descriptions:
• Exocad software
• Nobel Biocare and Biomet
The items are required at various Department of Navy (DoN) locations.
3. Description of the supplies or services required to meet the agency’s needs.
The Naval Area Dental Laboratories and the National Postgraduate Dental School Bethesda are in need of a contract for various dental prosthetic items, including both design and manufacturing services. Currently, each site has a manufacturing contract with a local contractor. By establishing a larger contract to address the needs of both the Dental Laboratories and the Dental School, along with few Naval medical treatment facilities (MTF’s), time can be saved in the implant production process and costs reduced to the Government, all while maintaining the DoN’s high quality of patient care.
The DoN requires a contractor that is capable of milling or printing dental prosthetics utilizing Exocad software, in order to provide Nobel Biocare Internal Tri-lobe and external hex interface, or Biomet 3i system’s internal hex and external interface restorative components and equipment that are in compliance with BUMEDINST 6630.3B. Items to be delivered include crowns, bridges, abutments, dental models, and implant frameworks/connections made of various materials as specified in the design file.
The following sites require computer-aided dental prosthesis manufacturing services: National Postgraduate Dental School Bethesda, Norfolk Area Dental Laboratories, San Diego Area Dental Laboratories, Federal Health Care Center Great Lakes, Walter Reed National Military Medical Center, Naval Medical Center (NMC) Portsmouth, NMC San Diego, United States Naval Hospital (USNH) Naples, USNH Rota, Naval Health Clinic (NHC) New England, NHC Pearl Harbor, NHC Quantico, Naval Hospital (NH) Camp Lejeune, and NH Camp Pendleton. The Government intends to award two indefinite-delivery indefinite-quantity contracts for the required items, one contract for East Coast sites and one contract for West Coast sites, with a period of performance from 01 August 2017 through 31 July 2021. The total estimated dollar value of the resultant contracts is $3,000,000.00. It is anticipated that Fiscal Year 17 O&M funding will be utilized to fund the initial delivery orders.
4. Identification of the statutory authority permitting other than full and open competition.
FAR § 13.106-1(b)(2) - Brand Name Only.
The procedures in FAR subpart 13.5 will be used in accordance with 41 U.S.C. 1901.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Exocad is the dental computer aided design (CAD) software package used across the DoN. The design files sent to the contractor will be in Exocad format; therefore, contractors are required to have an Exocad license in order to receive the files. The contractor cannot produce the required items without the design files. Use of a different brand
Computer Aided Dental Prosthetic Items J&A #17-10155 of software would require replacing the existing Exocad software package across the entire DoN or maintaining several different software packages, which is not only burdensome to the Government from an administrative and maintenance aspect, but is also cost prohibitive and would create delays in patient care.
In accordance with BUMEDINST 6630.3B, implants must have an implant-abutment mating surface compatible with the Nobel Biocare Internal Tri-lobe and external hex interface, or Biomet 3i system’s internal hex and external interface restorative components and equipment. Producing these prosthetic items can only be accomplished by utilizing the Exocad data files provided by the DoN. This instruction was released to establish consistency within the Navy due to the large number of associated parts, including screwdrivers and wrenches, necessary for the restoration. Standardization of implant components is critical to providing cost-effective treatment and maintenance. Furthermore, this standardization of Nobel Biocare and Biomet, along with the utilization of only Exocad software, across the DoN will reduce delays in patient care.
Accordingly, Exocad, Nobel Biocare, and Biomet are the only qualified brands for this contract in order to realize cost savings to the Government, decrease delays in patient care, provide high quality care to the patient, and reduce administrative and maintenance burdens. Therefore, it is in the best interest of the Government to proceed with the use of brand name descriptions.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
While the procurement will include brand name descriptions, competition is expected as multiple sources can comply with the requirements. The requirement was synopsized on FedBizOpps and the solicitation will be posted to the same website for a minimum of 30 calendar days.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Prior to award, the Contracting Officer will make a determination that the award price(s) are fair and reasonable. It is anticipated that competition will be used to establish price reasonableness.
8. Description of the market research conducted and the results or a statement of the reason market research was not conducted.
Market research was conducted and as noted above, multiple sources are available to provide the required brand name items. Several sources, see #10 below, have already expressed an interest in the acquisition.
9. Any other facts supporting the use of other than full and open competition.
None
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
The following sources have responded to the synopsis indicating interest in the acquisition: G&H Dental Arts, Inc., Burbank Dental Laboratory, IDOC Dental Lab, Inc., McClurkin Ceramic, Nash Dental Lab, Inc., and Cornerstone Dental Lab. The Government also identified Imagine Milling Technologies LLC and the Argent Corporation as potential sources.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
For future requirements, market research will be conducted to identify potential sources.
12. Points of contact.
