SAP SINGLE SOURCE JUSTIFICATION

AUG 2018

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN

ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD,

RFQ NO. N62478-19-T-2594, LEASE OF SKID MOUNTED DIESEL

ENGINE/FIRE PUMP AT NCTAMS BUILDING 440, NAVFAC HAWAII, OAHU,

HAWAII

Encl: (1) Market Survey dated 6/17/19

I. BACKGROUND:

A. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

B. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

A. NAVFAC-HI, Potable Water Department has an existing unrepairable Skid Mounted Diesel Engine/Fire Pump at NCTAMS Building 440 which provides fire protection services. This issue is an on-going open JBPHH & NAVFAC-HI, CCIR (Commanders Critical Information Requirements) due to lack of fire protection redundancy. The equipment serves as a redundant fire protection component to multiple mission critical facilities at NCTAMS, Oahu, Hawaii

B. In addition to the above unit, a temporary portable fire pump unit is currently on site to provide emergency backup services until a permanent replacement unit can be procured and installed in place of the unrepairable unit. This backup unit is currently rented under Purchase Order No. N0060419P4084 issued by Fleet Logistics Center, Pearl Harbor and will expire on 7 August 2019. NAVFAC Hawaii Utilities Department (PRJ361) requests continued rental/lease of the backup unit until a new Skid Mounted Diesel Engine/Fire Pump can be installed (which is in the process of being purchased and projected to arrive approximately 25 November 2019).

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING:

A. _X_ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

[Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government’s need.]

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. X OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.

a. Pacific Pump and Power, 91-503 Nukuawa St, Kapolei, HI, is the only vendor located on the island of Oahu that can meet the needs and specifications of the government’s requirements.

b. NAVFAC Hawaii OPC61 conducted market research by querying internet websites (Google, Yelp) for pump rental vendors located in Hawaii. Specific portable fire pump/diesel engine criteria was used in all queries which resulted in three companies as shown on enclosure (1). No other vendor in Hawaii could be located to meet needed specifications. Other vendors outside of Hawaii (located on the continental U.S) were also contacted with the hope of locating possible Hawaii affliates, however no Hawaii affiliates were available. NAVFAC Hawaii contacted the three firms on enclosure (1) and none of them are capable of providing the required fire pump. Due to the unique specifications (portable, horizontal split case, single stage fire pump, 1760 rpm diesel, type water, 1250 gpm, 65’ hd, 1760 rpm), a unit of equal or comparable specifications must be met.

c. Based on the above, Pacific Pump and Power is the only firm capable of providing the required redundant fire-fighting protection unit to NCTAMS, Hawaii’s fire protection system at this time.

B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

C. ____ UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. If appropriate, include any additional pertinent information.

None.
