1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Command Southwest (NAVFAC SW), Facilities
Engineering and Acquisition Division (FEAD), Naval Base Coronado (NBC), California (CA).
2. Description of the Action Being Approved.
Request authority to limit competition pursuant to the authority of 10 U.S.C. § 2304 (c)(1), as implemented by
Federal Acquisition Regulation (FAR) 13.106-1(b) “Soliciting from a Single Source” and 13.501(a), “Sole
Source (including brand name) Acquisitions.” The proposed contract, N62473-19-C-0808, is for the continued lease, maintenance and removal of a relocatable facility at Naval Amphibious Base (NAB), NBC. 4. Statutory Authority Permitting Other Than Full and Open Competition.
The proposed action will be conducted without providing for full and open competition pursuant to the authority of Title 10 U.S.C. § 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 13.106-1(b)
“Soliciting from a Single Source” and 13.501(a), “Sole Source (including brand name) Acquisitions.”
5. Rationale Justifying Use of Cited Statutory Authority.
This procurement will be conducted in accordance with FAR Part 12 and FAR Part 13. This procurement is a direct follow-on acquisition to N62473-15-C-1225. In September 2015, FEAD Coronado executed an 8(a) sole source award to Sand Point Services, LLC. The original contract included an initial construction portion of the facility and options to lease the facility on a yearly basis through 31 March 2019. The final unexercised option was for the removal of the facility. There are no remaining options for the continued lease of the facility. The
Navy needs the continued performance of Sand Point Services, LLC, formerly an 8(a) concern and currently a small business concern. The new contract will continue the lease of the facility from Sand Point Services, LLC in accordance with the CNIC waiver extension and provide for the removal of the facility at the end of this contract.
The Navy would duplicate the initial construction price of approximately for the required facility if a competitive procurement was conducted for this contract action. This price was derived using the CLIN structure from the original contract, which itemized the construction, lease and removal portions of the
Performance Work Statement (PWS). The Government would also experience unacceptable delays of approximately ten months if a competitive procurement was conducted for this contract action. The estimated ten month delay is unacceptable because the facility serves as a mission critical
. The facility provides vital training to the prior to deploying overseas. The estimated ten month delay is based on NAVFACSW’s published procurement lead time for the current acquisition of approximately three months. In addition, the time to construct the original facility was seven months, as measured from date of award of the original contract to Government acceptance of the facility for occupation.
Therefore, awarding a competitive contract would result in a substantial duplication of cost in the amount of to the Government that would not be recouped through competition and result in unacceptable delays of ten months to the NSW community.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The following market research reports and acquisition documents were reviewed as part of this acquisition’s market research: FEAD Coronado conducted market research in September 2015 for the current contract
N62473-15-C-1225 as well as in April of 2018 for contract N62473-18-C-0609; another 8(a) relocatable facility contract on Naval Base Coronado. FEAD Coronado is familiar with the marketplace for relocatable buildings.
No additional market research was conducted because of the reasons discussed in section 5. Because of the facts above, no other efforts were made to solicit offers. The proposed contract action will be synopsized in accordance with FAR 5.201 and 12.603. The approved justification will be included in accordance with FAR
13.501(a)(1)(iii).
7. Determination of Fair and Reasonable Cost.
Based on the historic cost information currently available, the Contracting Officer has adequate information to ensure that the cost to the Government for this action will be fair and reasonable, based on an
Independent Government Estimate (IGE) and historical data.
8. Actions to Remove Barriers to Future Competition.
The Government will support competition for future acquisitions of relocatable facilities.
File details come from the government source that posted it.
