JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING ACTIVITY

2. DESCRIPTION OF THE ACTION BEING APPROVED:

This justification seeks approval for the sole source firm fixed price procurement for USS Howard DDG-83 emergent dry docking to be awarded to Vigor, 5555 N Channel Ave, Portland, OR 97217

3. DESCRIPTION OF SUPPLIES/SERVICES:

I. Execute an emergent dry-docking of USS HOWARD DDG-83 to accomplish the following repairs to the

Port Controllable Pitch Propeller (CPP) System (C3 CASREP Initial DTG 092012ZAPR15 last update

(#47) 080326ZAUG16). Once approved, the contractor shall be responsible to provide the following services:

1. NAVSEA Certified Dry Dock

2. Office space/parking for MT

3. Temporary Services (Air, Power, Water, VCHT, Telephone, etc)

4. Defuel and refuel

5. Remove & Replace Port Hub

6. Remove & Replace Aft Port Oil Distribution (OD) Box

7. Repair or Replace Port Valve Control Rods

8. Repair or Replace Port Shafts

9. Accomplish a CPP Lube Oil Flush

10. Accomplish all operational test

11. Containment of Starboard Propeller

Due to saltwater contamination of the Port CPP system, USS HOWARD DDG-83 intermittingly loses pitch control during high speed aggressive maneuvers which significantly degrades its ability to accomplish mission requirements. These repairs must be accomplished prior to the ship’s scheduled deployment in APR 2017.

II. Accomplish mandatory repairs associated with major Departure from Specifications (DFS) expiring prior to the ship’s next deployment APR 2017:

1. Structural repairs in the following spaces:

a. AUX #1: 4-126-0-E (Exp. Date: 10/20/16)

b. AUX #2: 4-220-0-E (Exp. Date: 10/20/16)

c. Sonar equipment room #3 - 3-18-0-Q (Exp. Date: 12/13/16)

2. Weld repairs:

a. Exhaust collectors: 1B (MER#1) (Exp. Date: 10/18/16)

b. Exhaust collectors: 2B, and 2A (MER#2) (Exp. Date: 10/31/2016)

III. Accomplish mandatory repairs which were originally scheduled to be completed during an extended

CMAV (18OCT16 – 07JAN17). The CMAV has been replaced with this emergent docking. There is no other maintenance period prior to the ship’s deployment (APR 2017) to accomplish these mandatory repairs.

1. Structural repairs in the following spaces:

a. Power supply conversion room: 3-126-2-Q (major DFS Exp. Date: 6/30/17)

b. Sonar cooling room: 4-42-0-Q (major DFS Exp. Date: 6/30/17)

2. Support services for SPY Array resurfacing.

IV. PERIOD OF PERFORMANCE: September 30, 2016 – December 9, 2016

V. LOCATION: Vigor, 5555 N Channel Ave, Portland, OR. 97217

VI. Total estimated value of this acquisition is $ 7,251,000.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETION

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1), unusual and compelling urgency, as implemented by FAR 6.302-2 (b).

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

USS HOWARD DDG-83 is an operational naval asset operating at reduced capacity due to saltwater contamination of the Port CPP system causing the ship to intermittingly lose pitch control during high speed aggressive maneuvers. Waterborne repairs accomplished in FEB 2016 have been proven unsuccessful as the

HOWARD again experienced a loss of pitch control while participating in Rim of the Pacific (RIMPAC)

Exercises on 21 Jun 2016. This engineering casualty has caused the ship to lose full or experience partial loss of maneuvering capabilities resulting in potentially serious injury to the vessel and its crew, leaving the Navy no choice but to execute an emergency dry docking to investigate, repair or replace the Port CPP system.

USS HOWARD is also currently operating under its final extension for maintenance to DFSs. Mandatory repairs associated with major DFSs expiring prior to the ship’s next deployment must be accomplished to maintain the structural integrity of the ship.

Because of the urgency of these requirements and the non-availability of dry docks, there is no reasonable expectation of obtaining proposals from other potential sources.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS

PRACTIBLE:

Information on hand indicates that a search of available docks done on 28 July 2016, BAE dry docks located in

San Diego and Hawaii as well as the NASSCO dry dock located in San Diego will be occupied during the period of performance. A market survey was conducted for this requirement in the attempt to identify a qualified and available West Coast dry dock (First notice: 3 Aug - 9 Aug; Second notice: 16 Aug - 23 Aug). The SWRMC

Dock Master advised that docking a DDG in the US Navy Graving dock is not achievable because the known depth of the entrance to the dock does not support the draft of a DDG class ship. Dry Dock #4 at Pearl Harbor

Naval Shipyard is not available due to docking repairs with an estimated completion date of Nov 2016. Based on prior purchase history and experience, there is no reasonable expectation of identifying other potential sources that can provide the services required.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The contracting officer will determine that the anticipated cost of this acquisition will be fair and reasonable based on cost analysis to be conducted pursuant to FAR Part 15. The Contractor will be requested to provide a commercial cost list for the supplies required and prior sales history for the same items so that a more detailed review of pricing can be performed to ascertain the reasonableness of current offered pricing. Additionally, the

Contracting Officer will review historical actuals for the same or similar items in order to determine fair and reasonable cost.

8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:

This requirement is a sole source request due to the urgency and the availability of other sources is limited. There are currently no known sources to foster competition for these repairs. The US Navy does not own the data rights and cannot produce sufficient technical data to open up competition between other contractors.
