GOVERNMENT RESPONSE: Facilities maintenance is considered renovation projects and routine PMs of the buildings internal systems.

All other projects are considered construction or a capital project.

Examples for construction and capital projects designation would be Main Utilities repair or replacement, external and internal construction that would be considered structural. Projects of this nature will fall under the jurisdiction of NAVFAC (Naval Facilities Engineering Command). Facilities Maintenance involves such tasks as erecting temporary/non-structural walls, electrical work excluding mainline utilities, plumbing work excluding main supply, drop ceiling installation, painting interior walls and doors.

CONTRACTOR QUESTION 7: How many spaces exist for facilities personnel? What are those spaces for?

GOVERNMENT RESPONSE: There are several spaces within LF-18 and CEP-200 for our Facilities Workforce, Currently in LF-18 there is the Carpenter shop which provides computer workstations for the carpenters and site lead, also this shop provides a full service wood shop located to the rear of the space. The Pipe Shop provides Computer workstations for the HVAC maintenance personnel, the plumber, the painter, electrician journeyman, and the locksmith. This shop also provides tool and equipment storage for the inhabiting tradespeople. The Electricians shop provides a computer workstation for the master electrician, and tool and equipment storage. The Facilities DPAS office provides a computer workstation for the Architect, as well as space for printing equipment and plans storage.

Currently within CEP-200 there is a phone shop which provides the phone technician a computer workstation and storage for equipment and tools. Also there is an electricians shop that provides a computer workstation and storage for equipment and tools.

CONTRACTOR QUESTION 6: How does the Government differentiate between construction and facilities maintenance?

CONTRACTOR QUESTION 5: We have a strategic partner interested in working with us on this project, and they have existing personnel in place that meet the specified clearance requirements. However, [ . . .] would like to take the lead, and while the management personnel we have would clearly qualify for clearance, the solicitation states that these clearances must be in place within 60 days of award. It is our understanding that this process typically takes longer than 60 days, so our question is whether you, as the contracting officer and sponsor, have the ability to “fast-track” the application so that we can meet the 60 day deadline.

GOVERNMENT RESPONSE: The Government does not have a way to "fast-track" security clearance applications.

CONTRACTOR QUESTION 4: Instructions to Quoters, paragraph 4.a.ii.2.b, page 25, requires a Resume for each candidate proposed in Staffing Matrix.

In accordance with FAR 52.222-17 (E.O. 13495) we intend to make offers of right of first refusal to all qualified incumbent employees working on the current contract. Obtaining resumes from the incumbent workforce in the time allotted before the deadline for proposal submittal is prohibitive and gives a decided advantage to the incumbent. Also, obtaining resumes from non-incumbent candidates, who are already cleared SECRET and possess the required State of Virginia certifications as outlined in the PWS, to be submitted by the proposal due date, is prohibitive and offers a decided advantage to the incumbent. Proposing job descriptions and outlining how an offeror will recruit, screen and retained qualified, cleared personnel, could be an acceptable alternative; leveling the playing field for all offerors. Will the Government please re-consider the requirement for Resumes to be submitted as part of the Technical Proposal?

-CLARIFICATION-

We are asking for the government to remove from the proposal requirements the submission of resumes for all staff members proposed in our staffing plan for the following reasons:

The RFP states that we must include, in our proposals, resumes for each candidate we are proposing in our staffing plan (4.a.ii.2.b, page 25).

However, FAR 52.222-17 (E.O. 13495) is also referenced in the RFP, requiring right of first refusal to incumbent employees.

Requiring both resumes and right of first refusal, limits competition because the RFP does not give us contact information for the incumbent workforce. Even with the contact information, the timeframe for the proposal is prohibitive for proposers to approach these incumbent employees and receive their resumes. The exception is the incumbent contractor, who presumably already has the resumes for all of its staff members on file.

There is not sufficient time to advertise for and receive resumes from all of the required, qualified non-incumbent people and ensure that they can be hired for proposed positions within the proposal timeframe.

Finally, it would be disingenuous of us to advertise for and propose nonincumbent personnel, when we know that at least some of the incumbent personnel will be hired for the contract as per FAR

GOVERNMENT RESPONSE: The contractor shall comply with FAR 52.222.17, Nondisplacement of Qualified Workers. Please note that the incumbent contractor’s employees may elect to refuse any job offers provided by the successor contractor. Thus, to ensure a smooth transition, the quoters shall provide a staffing plan with resumes of possible candidates meeting the Solicitation’s minimum requirements that clearly demonstrates the quoter has the capability to begin and sustain operations at all times. Please also note that some new requirements have been incorporated in the new Performance Work Statement (PWS) to comply with applicable laws, regulations, and policies; see PWS in Solicitation for all requirements.

GOVERNMENT RESPONSE: Software is the Tracer Summit

CONTRACTOR QUESTION 17: Does the contractor need to obtain an FCL clearance by award?

GOVERNMENT RESPONSE: An FCL must be obtained by award.

SCA.

CONTRACTOR QUESTION 19: If a contractor is teaming, is quote limited to only 3 past performance examples?

CONTRACTOR QUESTION 20: Is there a difference in number of employees between the current contract and what this solicitation anticipates?

GOVERNMENT RESPONSE: The level of effort remains the same as minimum projected skill level breakout stated in PWS. The positions of the locksmith and additional electricians are additional.

CONTRACTOR QUESTION 23: Which positions require a secret clearance?

GOVERNMENT RESPONSE: See answer to Question 3. All labor categories listed in PWS require a Secret clearance. Questions about any additional clearances needed by the Contractor should be brought to the Defense Security Service (DSS) who provides clearances to contractors.

CONTRACTOR QUESTION 24: Will the Government please clarify which billets are to be staffed at the Apprentice, Journeyman or Master level, as Apprentice and Journeyman are not used consistently?

This has a significant impact because 3.1.6 statesman Journeyman and above require a VA State License.

For example:

• 3.1.6 Contractor personnel at the Journeymen level or above shall possess current, active Virginia State license(s) appropriate for their trade.

• 3.2.3 Electrician Apprentice. 3.2.3.1 The Contractor shall provide Journeyman Level Electrician support

• 3.2.7 Heating, Ventilation, and Air-Conditioning (HVAC) Mechanic Apprentice. 3.2.7.1 The Contractor shall provide Journeyman level HVAC/Plumbing technician support.

• Section 11. Education and Certifications o There is no mention of the Electrician Apprentice in this section.

o Tasks at sub-paragraphs 3.2.7 are those of an HVAC Apprentice requiring proof of appropriate Freon certification(s).

• Section 15.3 Indicates that two of the three Electricians and one of the HVAC technicians should be Journeyman, however it does not clarify the certification level of the remaining electrician and HVAC Tech.

GOVERNMENT RESPONSE: The Government recognizes the confusion between Virginia licensing language and PWS. The Government has revised the PWS to clarify the difference between billets; Journeymen and Apprentice have been identified in each applicable labor category. The Government has also removed the requirement for the HVAC Apprentice to obtain Freon certification(s).

Please see revised Solicitation.

CONTRACTOR QUESTION 89: With the release of the Responses to Questions on February 1 for the above referenced solicitation, the government has still been unable to provide a complete inventory listing for all items that require maintenance for this effort. This makes is extremely difficult to determine how we should determine the proposed cost, as these are usually by inventory information provided. IT appears this may give an undue advantage to the incumbent, as they have current FTE listing, equipment inventory, etc. Would the government consider providing at least providing an estimated # of personnel provided for this effort and extending the due date an additional 5 business days?

GOVERNMENT RESPONSE: An extension is not being considered at this time. Overall equipment inventory was answered in Question 13.

The Contractor should propose based on Full Time Equivalent (FTE) breakdown provided in the PWS.

CONTRACTOR QUESTION 86: On the Past Performance Questionnaire we are proposing a project where we had 25% of the work share as a subcontractor to the Prime. Question we have the Prime Contractor doing Part 4 and wanted to make sure that is acceptable as they were the contracting activity to us. Or do we go back to the the Federal Contracting Agency?

GOVERNMENT RESPONSE: It is acceptable for the Prime to fill out Part IV.

CONTRACTOR QUESTION 87: Must a contractor receive past performance questionnaires from only a Contracting Officer and Program Manager as stated on the Past Performance Questionnaire Part IV?

GOVERNMENT RESPONSE: An extension is not being considered at this time. As of today, all bidder questions have been answered.

CONTRACTOR QUESTION 83: Line item #9 lists “Laborer.” Section

15.2, “CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES”

line item #9 shows the labor category “Laborer;” however, in section 3.2, “Job trade Requirements,” no labor category is identified as “Laborer” and there is no job description for a Laborer. How should bidders proceed in regard to section 15.2, line item #9 “Laborer”?

GOVERNMENT RESPONSE: Please see answer to Question 40.

CONTRACTOR QUESTION 84: What do the numbers in the column entitled “Projected Level of Effort” mean? Are these numbers the quantity of Full Time Equivalents (FTEs) required to be provided under each labor category for the contract as a whole, or are they the quantity of Full Time Equivalents (FTEs) required to be provided under each of the Mission Essential Functions labor categories only? Is there a reason why the labor categories listed in section 15.3 do not match the labor categories in section 15.2, and can you explain the discrepancy so Contractors ensure they bid mission-essential and non-mission-essential labor categories correctly?

GOVERNMENT RESPONSE: Government has revised Mission Essential and Breakout to match. Please see update in PWS 15.3

CONTRACTOR QUESTION 85: 52.222-62, Paid Sick Leave Under Executive Order 13706 (JAN 2017) (E.O. 13706) [is unchecked]. Does the Government intend the Paid Sick Leave Under Executive Order 13706 requirement to remain unchecked?

Does this sentence in section 4 use the term “working hours” to mean “core working hours” or “normal working hours”?

GOVERNMENT RESPONSE: MARMC working hours refer to "core hours." Please see PWS clarification update to section 4 in amended Solicitation.

CONTRACTOR QUESTION 82: "Government Furnished Information (GFI) will consist of all applicable facilities documents currently available to MARMC." Will every FTE require a CAC card for access to MARMC and NAVFAC computer and network systems to access the GFI?
