MEMORANDUM FOR SIMPLIFIED ACQUISITIONS (<$100K)

From: Nikolaos M. Kritikos, PPE USNS WALLY SCHIRRA (T-AKE-8) To: Contracting Officer, Military Sealift Fleet Support Command

Subject: JUSTIFICATION FOR URGENT ACQUISITION Reference: (a) Procurement Request No(s): N2319812_______________________________

(b) Federal Acquisition Regulation 6.302-2/13.106

2. URGENCY: This justification is provided to support contracting without full and open competition for subject requirement as authorized by 10 U.S.C. 2304(c) (2) in that the supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the government.

The determination for urgency for subject requirement is based on the following -

Date on which the requirement was first identified: 28 December 2011___________________________

Date on which the requirement was submitted: 28 December 2011______________________________

If the above two dates are more than one week, in difference, explain the delay in submitting the requirement: ___________________________________________________________________________

Date item needs to be onboard or required period of performance (not the date that the contractor provided when you conducted market research, but your actual REQUIRED date: 09 January 2012

Explanation of why delivery by that date is required:

The impact to the mission (i.e., the specific harm) if the materials or services are not received by the stated delivery date; The USNS WALLY SCHIRRA is requesting assistance for procuring the services for Lead Based Paint Surveys.

· NASSCO Shipbuilders have discovered that some of the Areas/Spaces onboard AKE-8 exceeds the Acceptable Lead Level Requirements. The special circumstances and conditions that exist validating the requirement as “urgent”:

USNS WALLY SCHIRRA cannot continue deployment in the Guam AOR, without having ALL the Areas/Spaces inspected for Lead Paint; this is a ship’s safety issue!

· The rationale for the priority assigned: 1 day schedule procurement to be accomplished – required so ship can certify mission support.

Estimated production lead time for the item, i.e., how long will it take the contractor to produce the item once the contract is awarded: Available for Immediately Delivery
