5.0 PROPOSALS

Offerors are required to submit both technical and price proposals. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. For this solicitation, the combinations of the technical submittals are equal in value to the price.

The technical proposal and the price proposal shall be submitted in separate volumes. The technical proposal shall not contain any cost/pricing information except for salary information provided on resumes.

Proposals are due no later than 2:00 p.m. (EDT) on Wednesday, April 30, 2010. Proposals shall be submitted to the following address:

NAVFAC Midwest PWD Crane – Acquisition Department Attn: Lorna Tribby (Code PRCR 22) NSA, Bldg 2516 300 Hwy 361 Crane, IN 47522-5082

The Government will award this solicitation to the single offeror whose proposal conforming to the solicitation will be the most advantageous to the Government, price and other factors considered:

TECHNICAL PROPOSAL: Offerors shall submit an original and three (3) copies of the Technical Proposal.

Pages must be singled sided 8 ½ " x 11" and may be formatted in landscape or portrait format. Pages may be single-spaced in any font size legible to the naked eye. Pages of print are defined as text, diagrams, pictures, charts, tables, maps, appendices to proposal, or forms. Tabs are required for all sections of the technical proposal.

In addition, the offeror may submit catalog cuts, brochures or other pre-printed material as long as the exact item to be incorporated is identified.

To facilitate the evaluation, the technical proposal should be sufficiently detailed and complete to clearly and fully demonstrate that the offeror has a thorough understanding of the requirements.

Extraneous information in the technical proposal may be construed as indicative of the offeror’s ignorance of the subject or a casual approach to the RFP. Statements that the prospective offeror understands and can or will comply with all specifications, statements paraphrasing the statement of work or parts thereof, and phrases such as “standard procedures will be employed” or “well known techniques will be used”, etc will be considered insufficient.

Elaborate brochures, binding, detailed artwork are unnecessary. The technical proposal shall be clear, concise and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet requirements. Offerors shall assume that the Government has no prior knowledge of their experience, and will base its evaluation on the information presented in the offeror’s proposal.

Proposals unrealistic in terms of technical or schedule commitments or unrealistically low in price will be considered lacking technical competence or comprehension of the complexity and risks of the contract requirements and may be rated as technically unacceptable.

Technical Evaluation Factors to be addressed in this solicitation are identified below:

Factor 1 – Electrical Narratives Subfactor 1A – Technical Approach Subfactor 1B – Management Approach Factor 2 – Experience Subfactor 2A – Construction Experience

Subfactor 2B – Environmental Compliance Experience Factor 3 – Safety Factor 4 – Past Performance

The distinction between experience and past performance is experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts. The relative order of importance of the non-cost/price evaluation factors is that technical factors (1, 2, and 3) are equal to each other and when combined are equal in importance to past performance (Factor 4). The combined non-cost/price factors are approximately equal to price.

1. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements: Offerors shall submit an original and three copies of the price proposal. The basis of price proposal shall be the exhibit line items (ELINS) for each of the contract periods. Offerors shall complete and submit the SF1442, SF1442 Continuation Page (Section 00010), and Exhibit Line Items for the entire project. The offeror shall provide a Bid Guarantee, as required by NFAS 5252.228-9302. In order to show the offeror’s ability to obtain adequate financial resources to support this project, the offeror shall submit a statement from a bank or other financial institution stating their available line of credit and that their accounts are in good standing. The offeror shall demonstrate the capability to bond individual projects valued up to $1,000,000.00 as well as the capability to bond up to $2,000,000.00 of projects within a 12-month time period. The offeror shall provide a letter from their bonding company that describes the contractors bonding capability.

Representations and certifications shall be completed on-line in accordance with FAR 52.204-8. In addition, complete and submit the information required in Section 00600 of the solicitation. Offerors shall indicate on the proposal that prices are valid for not less than sixty (60) days

(2) Basis of Evaluation: The Government will evaluate price based on the total price.

Total price consists of all line items for the base period plus all line items for both option periods. (The total price of Exhbits A, B, and C). The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section 00100 of the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(b) Technical Factors:

(1) Factor 1, Electrical Narratives:

Subfactor 1A: Technical Approach

(i) Solicitation Submittal Requirements: The technical approach narrative shall be limited to eight (8) single-sided pages plus the organizational chart. The information requested in items 1, 2, 3, and 4 below are included in this page limitation. The Offeror shall clearly demonstrate its understanding of and approach to accomplishing the complexity and magnitude of electrical services as described in the solicitation.

1. Provide a narrative describing roles, responsibilities, and contractual relationships within the offeror’s company and any subcontractors they intend to use (see FAR Subpart 9.6). The narrative shall also include a simple organizational chart that clearly identifies the lines of authority between the entities. If the experience of a significant subcontractor is being claimed in Factor 2, the firm must be named in the above narrative and organizational chart.

2. Offeror shall provide the qualifications for performing Electrical Construction and the qualifications of employees who will perform the electrical construction work. The offeror shall list training, certifications, and licenses for each employee. Proof of certification and licensing shall be submitted with the proposal. (Certificates and licensing documents will not count toward the eight page limit)

3. Offeror shall submit a typical GANTT Chart with the following items clearly identified. For purposes of the schedule, the contractor shall assume an award of 30 days after the bid date.

a. Critical Path

b. Assumed Contract Award Date

c. Building Occupancy Date (BOD)

d. Contract Completion Date (CCD)

e. Provide Construction Phasing in Schedule, including utility cutover/downtimes that may be required

Subfactor 1B: Management Ability

(i) Solicitation Submittal Requirements: The offeror shall demonstrate an in-depth understanding of the contract requirements. Evaluation will focus on the contractor’s ability in managing and executing a project of similar size and scope within a similar work environment. Factors to be considered include, project supervision, coordination of subcontractors, quality control, lead abatement system, ability to respond to unknown/unforeseen conditions, and an effective scheduling program that includes flexibility in meeting the customer's fluctuating schedule and providing a detailed contingency work plan.

1. Ability to coordinate and supervise work requirements as well as subcontractors at a single location and at multiple locations simultaneously

2. Provide a list of subcontractors and the type of work the subs will be performing. Include a letter of commitment from each identified subcontractor.

3. Quality control organization and quality control procedures that adequately assure high quality performance

4. Ability to respond to unknown/unforeseen conditions

5. Ability to complete the project within an acceptable schedule.

6. Scheduling program takes into account all foreseeable factors that will affect the completion of the project including but not limited to identification and monitoring of submittals, equipment/material purchases/delivery and the actual work activities

7. Scheduling program takes into account flexibility in meeting the customer's fluctuating schedule and providing a detailed contingency work plan. For example: the restrictions associated with Government and storage operations and working in restricted areas.

(2) Factor 2, Experience:

Subfactor 2A: Construction Experience

(i) Solicitation Submittal Requirements: Submit a maximum of five (5) construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as:

For this solicitation, a relevant project is one that involves various types of new electrical construction or electrical renovation projects, with minimal or no design required. A relevant project may also be a project that includes subcontractor experience. A relevant project is a firm fixed priced project with a cost range from approximately $100,000 to approximately $1 million. Projects involving hazardous atmosphere rating and explosive operations may be viewed more favorably.

Relevant projects that demonstrate experience with installing fiber and power (12.47KV, 480V or 120V) may be considered more favorably than those that do not demonstrate experience with installing fiber and power. Relevant projects that demonstrate experience with Electrical Sub Station Maintenance may be considered more favorably than those that do not demonstrate experience with Electrical Sub Station Experience. Offerors who submit relevant projects that demonstrate experience self-performing relevant features of work may receive a higher rating than those who do not demonstrate self-performance.

Submit a minimum of four (4) and a maximum of five (5) construction projects for the Offeror. This shall include a minimum of two (2) high voltage projects and a minimum of two (2) low voltage projects.

Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this RFP. A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment A) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: High Voltage, Sub Station maintenance, Fiber work, etc).

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract.

The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offer must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract.

(ii) Basis of Evaluation: The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five projects for construction. Any projects submitted in excess of the five (5) for Construction Experience will not be considered.

Subfactor 2B: Environmental Compliance Experience

(i) Solicitation Submittal Requirements: The Contractor shall:

a. Demonstrate knowledge and experience working in a solid waste management unit (SWMU) and applicable training (i.e. HAZWOPER 40 hr.)

b. Demonstrate knowledge and experience of hazardous material abatement, including, but not limited to lead, cadmium, chromium, asbestos, PCB, energetics and explosives. Provide narrative on asbestos abatement within a facility that has potentially unstable structure and energetic residues present.

c. Contractor shall provide narrative demonstrating knowledge of environmental regulations and the contractor’s solution to comply with those regulations within this project. This shall include, at a minimum, permitting, abatement, disposal requirements, and engineering field controls during construction. For any abatement requiring licensed personnel the contractor shall ensure that the personnel are licensed in the state the work will take place.

(ii) Basis of Evaluation: The basis of evaluation will include the Offeror’s demonstrated experience with environmental compliance as defined in the solicitation submittal requirements.

(3) Factor 3, Safety:

(i) Solicitation Submittal Requirements: The Offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each Contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR and DART Rates shall not be submitted for subcontractors.)

(1) Experience Modification Rate (EMR): For the three (3) previous complete calendar years (2011, 2012, and 2013), submit your EMR (which compares your company’s annual losses in insurance claims against its policy premiums over a three (3) year period). If you have no EMR, affirmatively state so and explain why. Any extenuating circumstances that affected the EMR and upward or downward trends should be addressed as part of this element. Lower EMRs will be given greater weight in the evaluation. EMRs shall be submitted on insurance company letterhead.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate:

For the three (3) previous complete calendar years (2011, 2012, and 2013), submit your OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If you cannot submit an OSHA DART Rate, affirmatively state so, and explain why. Any extenuating circumstances that affected the OSHA DART Rate data and upward or downward trends should be addressed as part of this element.

Lower OSHA DART Rates will be given greater weight in the evaluation.

(3) Technical Approach for Safety:

Describe the plan that the Offeror will implement to evaluate safety performance of potential subcontractors, as a part of the selection process for all levels of subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety narrative shall be limited to two pages.

(ii) Basis of Evaluation: The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The Government will evaluate the Offeror’s overall safety record, the Offeror’s plan to select and monitor subcontractors, any and innovative safety methods that the Offeror plans to implement for this procurement. The Government’s sources of information for evaluating safety may include, but are not limited to, OSHA, NAVFAC’s Enterprise Safety Applications Management System (ESAMS), and other related databases. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror. The evaluation will collectively consider the following:

- Experience Modification Rate (EMR)

- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate

- Offeror Technical Approach to Safety

- Other sources of information available to the Government

(1) Experience Modification Rate (EMR):

The Government will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward or downward trends and extenuating circumstances that impact the rating. Lower EMRs will be given greater weight in the evaluation.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate:

The Government will evaluate the OSHA DART Rate to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward or downward trends and extenuating circumstances that impact the rates. Lower OSHA DART Rates will be given greater weight in the evaluation.

(3) Technical Approach to Safety:

The Government will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project. The Government will also evaluate the narrative to determine the degree to which innovations are being proposed that may enhance safety on this procurement. Those Offerors whose plan demonstrates a commitment to hire subcontractors with a culture of safety and who propose innovative methods to enhance a safe working environment may be given greater weight in the evaluation.

(c) Past Performance

(1) Factor 4, Past Performance:

(i) Solicitation Submittal Requirements: If a completed Construction Contractor Appraisal Support System (CCASS) evaluation is available, it shall be submitted with the proposal for each project included in factor 2 for construction experience. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CCASS IS AVAILABLE. If there is not a completed CCASS evaluation then submit Past Performance Questionnaires (Attachment B) for each project included in Factor 2 for Construction Experience. The Offeror should provide completed Past Performance Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information.

However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Lorna Tribby, lorna.tribby@navy.mil.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2 – Experience. Offerors may also address any adverse past performance issues. Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information.

The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

Performance award or additional information submitted will not be considered.

(ii) Basis of Evaluation: This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 2 – Experience and past performance on other projects currently documented in known sources. More emphasis will be placed on more relevant projects. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s probability to successfully meet the requirements of the RFP.

Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive an Unknown Confidence rating.

However, offerors who successfully show relevant past performance will be viewed more favorably than those who do not.

6.0 BASIS FOR AWARD

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the

Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An “UNACCEPTABLE” rating in any subfactor results in the factor being rated “UNACCEPTABLE” and the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

Basis of Unit Prices – Exhibit Line Items:

a. Completion Time: Completion time for Exhibit Line Items unit prices tasks shall be negotiated between the Contractor and the Contracting Officer (or designated representative) at the time of the issuance of the Task Order. Negotiation of completion time shall be based on the amount of work on the Task Order, availability of materials, and estimates of labor-hours required per Engineering Performance Standards (EPS) or other estimating sources.

b. Pre-Priced Options: The Contractor shall submit pre-priced line items for option period #1

(Exhibit B) and option period #2 (Exhibit C). These pre-priced line items shall include all increases for labor, material, equipment, and other costs. The current Davis Bacon Act Wage Determination will be incorporated at the time the option is exercised. The pre-priced line items for each option period shall include any and all increases for labor costs. At the time the option is exercised, the Government will not negotiate a change to the pre-priced option period line items proposed by the Contractor as a result of changes to the Davis Bacon Act Wage Determination.

The Contractor shall include any anticipated changes in wages in the pre-priced line items for the option periods.

c. Accessories and Associated Work to Exhibit Line Items: All materials and labor necessary to accomplish the Exhibit Line Item shall be a part of the unit price bid unless specifically identified as not being a part of the unit price. When material is identified as “not being a part of the unit price” that material may be purchased under another EXHIBIT LINE ITEM or may be Government-furnished, at the Government’s discretion.

d. Unit Price for ELINs A400, B400, and C400 – Material and Equipment: Shall be for materials and equipment that is not specifically listed within other Exhibit Line Items. The Contractor shall provide such materials and/or equipment for repairs and maintenance as required by the Government for the maintenance, repair, and replacement of electrical components. The Contractors cost for material and equipment procured under this ELIN will be reimbursed at the invoice cost, plus a “Fixed Burden Rate”. “Fixed Burden Rate”is defined as additional cost, expressed as a percentage of the invoice cost for the Contractor’s handling and Overhead. The invoice cost is the supplier’s actual invoice for the materials and equipment purchased for incorporation in the contract-related repair. The Contractor shall provide a copy of the supplier’s invoices for material and equipment procured unde thei ELIN. Note: The amount listed in the exhibit line items is for proposal valuation purposed only and does not necessarily indicate any quantity of material/equipment required by the Government.

e. Unit Price for ELINs A401, B401, and C401 – Bond Cost for Payment and Performance

Bonds: Payment and Performance Bonds shall be the premium (percentage cost) to provide both payment and performance bonds on each task order. This bond premium will be used to calculate the bond cost on each task order. The bond cost for each task order will be computed by multiplying the bond premium times the total of the applicable exhibit line items. The bond cost will then be added to the applicable exhibit line item total to obtain the final task order amount.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror(s) within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

7.0 DISPOSITION OF PROPOSALS

After award, any excess copies of the proposal will not be returned to the offeror, but shall be destroyed by the Contracting Officer. No certificate of destruction will be issued.
