JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL
AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).
2. Description of the Action Being Approved: This is a justification for work to be provided by the Original Equipment Manufacturers (OEM) for the Work Items (WIs) listed below of the Statement of Work (SOW) for the Post-Shakedown and Dry-Docking (PSA/DD) of the USNS CARSON CITY (T-EPF 7) under RFP N32205-17-R-4500. This Justification is covering only the portion of the acquisition which an OEM Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.

• 401 – Renew NAVIBS/Radio Safety Survey
• 501 – Perform Annual Stern Ramp Maintenance
• 507 – Installation of Fuel Sensors and Transmitters
• 513 – Support Store Crane Modification and Annual Maintenance
• 601 – Marine Evacuation System and Life Raft Annual Certification
• 603 – Firefighting System Annual Certification
• 604 – Rescue Boat and Davit Annual Inspection
• 904 – Cathodic Monitoring System Inspection and Maintenance
• 905 – Remove and Inspect Water Jet Assembly
• 906 – Inspect and Repair UW Hull Coating
• 910 – Remove and Inspect Water Jets and Seat Rings
3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WIs 401, 501, 507, 513, 601, 603, 604, 904, 905, 906, and 910 for a 60 day PSA/DD availability, the estimated dollar value of the eleven WIs is $1,228,560.00, which will be funded utilizing FY 17 Operations & Maintenance funds.
4. Statutory Authority Permitting Other Than Full and Open Competition:
10 U.S.C 2304 (c)(l), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR6.302-l(a).
5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts for highly specialized equipment is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-EPF class of vessels. The required OEM authorized field technical service representatives and OEM parts also maintain all OEM warranties, ensures equipment reliability, crew safety and applicable ABS/USCG certifications.
A. WI 401, Renew NAVIES/Radio Safety Survey
The OEM for the Navigation Equipment identified in the SOW is Northrop Grumman Maritime Systems (Sperry). Sperry has access to business sensitive technical manuals, drawings and software proprietary rights. The Expeditionary Fast Transport Class Vessel has a unique Navigational Integrated Bridge System (NAVIES) consisting of Northrop Grumman Sperry equipment and integrated to High Speed Craft ABS regulations. No other single vendor has the proprietary rights and experience at this stage of the T-EPF program.
B. WI 501, Perform Annual Stem Ramp Maintenance
Lake Shore Systems Inc. is the OEM for the T-EPF Class Stern Ramp System. Restrictive rights include access to business sensitive technical manuals, drawings, proprietary rights to software. The T-EPF Stern Ramp is unique and only exists on this class of vessel. Similar cargo gear companies do not have the required technical data, software licensing and OEM repair parts to review, test, and repair these systems. Only Lake Shore Systems Inc.
representatives may work on or make adjustments to the equipment without voiding the warranty.
C. WI 507, Installation of Fuel Sensors and Transmitters
The OEM for the Fuel Meters is Emerson Process Management. Per the work item specification 7.10, an Authorized Emerson service representative will be required to perform initial configuration, set up and calibration of new fuel meters. Factory authorized service representatives provide proprietary technical data/drawings and knowledge of the software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability and certification therefore precluding consideration of a service offered by another company.
D. WI 513, Support Store Crane Modification and Annual Maintenance
Appleton Marine is the OEM of the T-EPF Class Cargo Crane. Restrictive rights include access to business sensitive technical manuals, drawings, proprietary rights to software.
Similar cargo crane companies do not have the required technical data, software licensing and OEM repair parts to review, test, and repair these systems. Only Appleton Marine representatives may work on or make adjustments to the equipment without voiding the warranty.
E. WI 601, Marine Evacuation System and Life Raft Annual Certification
The OEM for the Marine Evacuation System is Life Raft Systems Australia (LSA). Per the work item specification 7.4, an Authorized LSA Service Representative will be required to perform annual inspection, disassembly and reassembly and certification of the life raft system. Factory authorized service representatives provide proprietary technical data/drawings, knowledge of life rafts and trained personnel. This maintains all OEM warranties, ensures equipment reliability and certification of this life saving appliance therefore precluding consideration of a service offered by another by another company.
F. WI 603, Firefighting Systems Annual Certification
The OEM for the firefighting system of the T-EPF class is Hiller Systems Inc. The OEM for the fire detection system is Honeywell. Per the work item specification 7.8, authorized Hiller and Honeywell Service Representatives will be required to perform annual inspection, servicing, testing and certification of the firefighting and detection system.
OEM authorized service representatives provide proprietary technical data/drawings, knowledge of equipment and trained personnel which are only available from the OEM authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of these lifesaving appliances therefore precluding consideration of a service offered by another by another company.
G. WI 604, Rescue Boat and Davit Annual Inspection
The OEM for the Rescue Boat is Fast RSQ. The OEM for the boat davit is Ned Deck Marine. Per the work item specification 7.1, an authorized service representative will be required to perform annual inspection, maintenance and certification of the rescue boat and davit. OEM authorized service representatives provide proprietary technical data/drawings, knowledge of boat and davit, trained personnel which are only available from the OEM authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of these lifesaving appliances therefore precluding consideration of a service offered by another by another company.
H. WI 904, Cathodic Monitoring System Inspection and Maintenance
The OEM for the Cathodic Monitoring System is Cathelco. Per the work item specification 7.2, authorized Cathelco Service Representatives will be required to perform annual inspection, servicing, testing and certification of the Cathodic Monitoring system. OEM authorized service representative provide proprietary technical data/drawings, knowledge of equipment and trained personnel which are only available from the OEM authorized service rep. Due to the vessels thin aluminum hull, the proper operation of this cathodic monitoring system is essential to the hulls integrity. This maintains all OEM warranties, ensures equipment reliability and certification of these hull protection appliances therefore precluding consideration of a service offered by another by another company.
I. WI 905, Remove and Inspect Water Jet Assembly; WI 910, Remove and Inspect three Water Jets and Seat Rings
Wartsila Defense Inc. is the OEM of the T-EPF Class Main Propulsion Water jet. Per work item 905 and 910 specifications 7.1, authorized Wartsila Defense service representatives will be required to perform removal, inspection, servicing, and reinstallation of the water jet.
OEM authorized service representatives provide proprietary technical data/drawings, knowledge of equipment, and trained personnel which are only available from the OEM authorized service rep. The propulsion water jets are critical equipment as they are the only method for the ship to move or maneuver under its own power. This maintains all OEM warranties, ensures equipment reliability and certification of these lifesaving appliances therefore precluding consideration of a service offered by another by another company.
J. WI 906, Inspect and Repair UW Hull Coating
The OEMs for the underwater hull paint is International Paint LLC. Per the work item specification 7.1, International Paint Manufacturer’s technical representative will provide the services to oversee all hull painting. An authorized International paint representative will be required to perform surface inspections, testing, and advise of application of the paint system. OEM authorized paint representatives provide proprietary technical data and knowledge of paint and application equipment which is only available from the paint manufacturer’s OEM authorized paint rep. Due to the vessel’s thin aluminum hull, the proper paint system protection is essential to the hulls integrity. The painting systems also offer anti-fouling properties essential to the vessel’s required high speed capability. This maintains all OEM warranties, ensures paint system reliability and certification of these hull protection systems therefore precluding consideration of a service offered by another by another company.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract for the PSA/DD availability to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related WI.
The proposed contract was synopsized on the FEDBIZOPS website on 27 September 2016.
The following shipyards expressed interest in this requirement: Detyens Shipyard Inc.; BAE Systems Norfolk Ship Repair Inc.; BAE Systems Southeast Shipyards Mobile LLC; BAE Systems Southeast Shipyards Jacksonville LLC; and World Marine of Alabama, LLC. No additional market research was conducted as it is not practicable for the reasons discussed in paragraph 5 above, for any OEM other than the OEM listed per WIs cannot provide the required supplies and services.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A is fair and reasonable in accordance with FAR Part 15.404-1.
8. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
