The following have been modified:
PART XI
PART XI. FAR 52.212-2 EVALUATION -- COMMERCIAL ITEMS (OCT 2014) (tailored pursuant to FAR 12.302(a))
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose technically acceptable proposal with acceptable past performance represents the lowest price to the Government. Award preferences for U.S. Flag vessels, for vessels enrolled in the Voluntary Intermodal Sealift Program (VISA, at 75 FEDERAL REGISTER 52594-52595, 26 August 2010, or most current reference) and for VISA Participants (see sec. VI.A.2. of VISA) will be applied to the Government's evaluation of offers. Award will be made, if at all, to an offeror in the highest priority (among those offers received) set forth in sec. III.A.3. of VISA, in accordance with the award criteria set forth below. After factoring in the award preferences, the Government will first evaluate offerors' prices, and then evaluate the apparent lowest-priced proposal for acceptability under the technical and past performance factors. If the Government evaluates the lowest -price offeror as unacceptable, the Government will then consider the acceptability of the next lowest-price offeror, continuing this process as necessary. The Government reserves the right to enter into discussions at the Contracting Officer's discretion; the Government incorporates all portions of FAR 15.306 herein by reference, including 15.306(c)(2) limiting the competitive range for efficiency.
(b) In selecting the lowest-priced, technically acceptable offer, the following factors will be considered:
Technical
| Subfactor 1 – Vessel minimum requirements |
| Subfactor 2 - Quality Management System |
Past Performance Price
(c) Technical. The offeror’s proposal will be evaluated based on technical capability of vessels proposed as set forth in the PWS (Attachment E).
(d) Past Performance.
The past performance evaluation will assess the offeror’s probability of meeting the solicitation requirements. To develop an overall rating, the Government’s evaluation will take into account relevant information submitted by each offeror as part of its proposal and the Government’s assessment and evaluation of other sources of information. Other sources of information for past performance may include, but are not limited to, Past Performance Information Retrieval System (PPIRS) reports, the Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Report System (ESRS), other databases, questionnaires and interviews.
(1) The Government will consider the recency and relevancy of past performance information compared to the requirements detailed in the PWS, the source of the information, the context of the data and general trends in the offeror’s performance and any associated risk.
(2) The Government will consider the extent of the offeror’s ability to perform a previous contract successfully in the areas of; (a) quality of product or services; (b) timeliness or scheduling of supplies/deliveries; (c) business relations/customer satisfaction; (d) key personnel and staffing (including subcontractors); and (e) cost controls (COST CONTRACTS ONLY).
(3) The Government will consider the company itself, predecessor companies, key personnel who have relevant experience and subcontractors who will perform major or critical aspects of the requirement.
(4) For all offerors, the Government will consider historical compliance with the requirements of FAR 52.219-8 (Utilization of Small Business Concerns). If the solicitation is full and open: In addition, for large businesses, the Government will consider historical compliance with the requirements of FAR 52.219-9 (Small Business Subcontracting Plan) and DFARS 252.219-7003 (Small Business Subcontracting Plan, DOD Requirements).
The Government reserves the right to consider Past Performance Questionnaires received after the due date for receipt of proposals. The Government reserves the right to contact references for verification or additional information and the right to consider other relevant past performance information. The Government may call customers, whether or not provided by the offeror, to inquire about the offeror’s past performance. The Government does not assume the duty to search for data to cure the problems it finds with the information provided by the offeror. The burden of providing thorough and complete past performance information remains with the offeror.
In accordance with FAR 15.305(a) (2) (iv), an offeror without a record of relevant past performance or for whom information on past performance is not available, will not be evaluated favorably or unfavorably on past performance.
(e) Price.
0. The offeror’s price proposal will be evaluated based on the value of the charter hire rates offered for the entire charter period, cost of fuel, and any other costs set forth in the offer as determined in the Basic Pricing Data Sheet (Attachment IX(G)). For evaluation purposes each period of performance will consist of the number of days specified in the individual solicitation. Fuel calculations will be based upon (A)__358__ (number of) days underway laden at the speed specified in the individual solicitation (DRYTIME Box 66 & 68), (B)____0___ (number of) days underway ballast at the speed specified in the individual solicitation (DRYTIME Box 67 and 69) and (C)__1431__ (number of) days in port idle (DRYTIME Box 71). This will represent the overall cost to the Government.
0. Fuel consumption calculations will be made using the following Defense Logistics Agency Energy (DLA-E) standard prices and appropriate fuel conversion factors. The rates to be used are as specified in the individual solicitation:
MGO/MDO - $744.11 PER METRIC TON
IFO - 180 $465.95 PER METRIC TON
IFO - 380 $461.81PER METRIC TON
0. Note: Bunker C will be equated to IFO-380, if necessary. If a Vessel to be offered consumes fuel other than the above, the Offeror shall request, prior to offers being received, that rates for that fuel be posted via an amendment.
0. Fuel conversion factors are as follows:
MGO/MDO - 7.507 barrels per metric ton IFO - 180 - 6.526 barrels per metric ton IFO - 380 - 6.468 barrels per metric ton
(f) Reserved.
(g) Options. The Government will evaluate offers for award purposes by adding the total price for all options (including 52.217-8 OPTION TO EXTEND SERVICES) to the total price for the basic requirement. The Option 5 charter hire rate will be used to evaluate the FAR 52.217-8 option. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(h) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
