SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

SOLICITATION/CONTRACT FORM

The required response date/time has changed from 19-Jan-2017 03:30 PM to 18-Jan-2017 03:30 PM.

The following have been modified:

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.

(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Non-Price Factor – Technical Proposal

Subfactor – Technical Approach Staffing Plan and Key Personnel Quality Control Plan

Non-Price Factor – Past Performance Factor – Price

Evaluation of Non- Price Factor : Technical Proposal (Volume I)

The term “technical,” as used herein, refers to non-price factors other than past performance. The purpose of the technical factor is to assess whether the offeror’s technical approach will satisfy the Government’s minimum requirements based on their technical proposal submission.

Technical acceptability will be based on the Offeror’s ability to clearly demonstrate an understanding of the requirements outlined in the RFP and how its approach successfully accomplishes the minimum requirements and key performance task areas described in the Performance Work Statement (PWS). The approach shall address the following technical subfactors:

Approach to accomplishment of tasks defined within the requirements of the associated schedule as detailed within the PWS.

A quality control plan which addresses specific approach to the customer service related issues, facility requirements and recruiting, developing, training, and certifying of personnel to ensure compliancy with the

PWS.

Staffing plan which will be followed during contract performance and resumes of key personnel, to ensure day to day operational requirements are met in accordance with the PWS.

The source selection team shall evaluate the offeror’s proposal against these requirements to determine whether the proposal is acceptable or unacceptable, using the ratings and descriptions outlined herein.

In evaluating the technical portion of the proposals, the board members will evaluate the following technical factors and subfactors that establish the requirements of acceptability, as described in 52.212-2 of the RFP.

Note 1: If the Offeror’s proposal is determined unacceptable in any of the technical evaluation subfactors, the proposal may not be further considered for award, at the PCO’s discretion.

Note 2: The Offeror simply providing general statements or paraphrasing/parroting the PWS in whole or in any part may result in a rating of unacceptable.

Technical Subfactor I – Technical Approach

The offeror shall demonstrate their understanding of the requirements set forth in the PWS by submitting a technical approach. The Government will focus on whether the offeror has proposed an overall plan, methods, procedures and resources that are capable of accomplishing the requirements. Special resources, such as subcontractors, to obtain knowledge, skills and/or materials required to perform each of the tasks shall be addressed.

Note 1: Technical capabilitywill be determined solely on the content and merit of the information submitted in response to the RFP. Therefore, it is incumbent on the offeror to provide sufficient technical documentation in order for the government to make an adequate technical assessment of the offeror’s documentation. The offeror must meet or exceed all specifications listed in the performance work statement.

Technical Subfactor II – Staffing Plan and Key Personnel

The Offeror shall provide a staffing plan to ensure day to day operations are met in accordance with the Performance Work Statement (PWS). The staffing plan shall include the labor categories proposed, the number of hours proposed for each labor category per year, and the number of personnel assigned to each labor category. The proposal should state all applicable labor categories subject to the service contract act and identify the applicable wage determination.

Key personnel include Operations Manager, Quality Control Manager and Customer Service Representative. One qualified individual may hold up to two (2) key personnel positions. All proposed key personnel must meet the minimum qualifications as detailed below and are required to submit resumes. Resumes shall be in reverse chronological order with the most recent dates of employment first, identifying the company or agency, period of employment, and job description/responsibilities of the individual.

Resumes shall include as a minimum, the employee's educational background, training and specific experiences that are directly related to the requirements of the PWS and clearly demonstrate the relationship between each proposed individual's relevant qualifications and the tasks to be performed by that individual.

Each resume shall indicate whether the individual is a current employee of the firm or a prospective new hire.

Additionally, if proposing prospective new hires the offeror needs to provide documentation of a signed letter of intent from the prospective employee(s) that they will work for that offeror should the offeror be the awardee of this contract effort.

Operations Manager who will oversee the warehouse- minimum five (5) years of experience (including three (3) years working with the Department of Defense (DoD)) in Household Goods Packing and Crating or similar type of work including, but is not limited to, receipt, storage, inventory and issue of multi-line high volume items, customer services and personnel management to include employee training and supervision.

Quality Control Manager who will oversee the crew/team - minimum five (5) years of experience (including three

(3) years working with the Department of Defense (DoD)) in Household Goods Packing and Crating or similar type of work including, but is not limited to, receipt, storage, inventory and issue of multi-line high volume items, customer service and personnel management to include employee training and supervision.

Customer Service Representative - minimum experience of three (3) years work experience in the movement of Department of Defense (DoD) sponsored Household Goods shipment customers and resolution of claims or demonstrated capability of similar experience.

Technical Subfactor III – Quality Control Plan

The Offeror shall provide a quality control plan which express an understanding of the RFP requirements as well as demonstrate how that plan will successfully accomplish the requirements. The quality control plan should address the following:

Specific approach to ensure compliance with the quality standards set forth in the PWS and associated DTR

4500.9R appendices, to include but not be limited to contractor facilities as outlined in Appendix D and E

Describe approach to customer service related issues to include but not be limited to contacting customers to ensure awareness of household goods movement process (i.e. establishing pick-up/delivery/pre-move survey time), and key personnel addressing problems/issues that occur prior to, during or after movement of goods

Provide an approach to personnel recruiting, development, and retention that demonstrates the offeror's plan to minimize staff turnover. In addition, describe the method and procedure used to ensure up-to-date applicable training, licensing, and certification, is provided to or required of all individuals identified on the staffing plan.

Note 1: The above bullets provide guidance for what should be addressed in the approach and are not considered to be sub-factors nor should this be considered an all-inclusive list.

Evaluation of Non-Price Factor : Past Performance (Volume II)

Past Performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. The past performance proposal will be evaluated based on the relevance and the recency, in relation to the specific requirement being procured and how well the offeror performed those past contracts.

In order to facilitate the Government’s evaluation of this factor, the Offeror is required to provide information on three (3) previous contracts whose effort was relevant to the effort required by this solicitation; the contracts provided should have been performed within the last five (5) years of the solicitation closing date. Evaluation will focus only on work experience already performed. Yet-to-be performed work and experience prior to the last five

(5) years will not be considered. Offerors may submit performance data regarding current contract performance as long as a minimum of one (1) year of performance has been completed as of the closing date of the solicitation.

If subcontractor experience is provided as part of the three most relevant contracts/orders, it will be given consideration relative to the percentage of the level of effort being provided by that particular subcontractor in the offer submitted. The contracts will be evaluated in the aggregate in order to allow Offerors who may not have the entire scope or complexity of the experience under one individual contract or task order to still be considered acceptable if experience with the full scope and complexity of the requirement can be demonstrated within the allotted number of contracts as described above.

Offerors who describe similar contracts and subcontracts should provide a detailed explanation demonstrating the similarity of the contracts, in terms of scope, complexity, and magnitude, to the requirements of the RFP for purposes of the relevancy review. Scope, magnitude, and complexity are defined as follows:

Scope: Experience in the areas defined in the Performance Work Statement (PWS).

Magnitude: The measure of the similarity of the dollar value of actually performed work that exists between the PWS and the Offeror’s contracts. Magnitude will be evaluated on the dollar amount of work actually performed under the contract or contracts, individually or in the aggregate, during the relevant five-year period established by the solicitation.

Complexity: Is the measure of similarity of technical and managerial intricacy and required coordination of efforts and disciplines that exist in the PWS and the Offeror’s performance on other contracts. For complexity, not only will the tasks performed be considered, but also the Offeror’s ability to coordinate the (tasks) (e.g. concurrent performance requirements).

This information shall be provided by the submission of Attachment 2 – Past Performance Information Form. The Past Performance Information Questionnaire shall be completed in its entirety and one copy submitted 10 days prior to the closing of the solicitation. In addition, to the information requested above, the offerors shall contact their past performance references and request that each reference complete Attachment 3 – Past Performance Questionnaire Template and fax or e-mail the completed survey form directly to Gavin Tsukamoto and Jeen Chu, NAVSUP Fleet Logistics Center Pearl Harbor, 1942 Gaffney Street, Suite 100, JBPHH, HI, 96860, e-mail:

gavin.tsukamoto@navy.mil and jeen.chu@navy.mil, Fax Number: 808-473-3524, BEFORE THE DUE DATE OF THIS SOLICTIATION. The Government may consider questionnaires received after the due date of the solicitation. The Government reserves the right to contact references for verification or additional information.

The Government may verify past performance information. The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews and existing data sources to include but be not limited to Past Performance Information Retrieval Systems (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Contractor Performance Assessment Reporting (CPARS), or other databases. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. This past performance information will be used for the evaluation of past performance. The evaluation team will review this past performance information and determine the quality and usefulness as it applies to the performance competence assessment.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown or neutral past performance. In the context of acceptability/unacceptability, “neutral rating” shall be considered “acceptable.”

Technical Rating Tables

Technical Approach Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown (See note above).

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Price Analysis Price Proposals will be evaluated in accordance with FAR 15.404-1(b), Price Analysis. Price analysis will be used to determine the total evaluated price, which is the amount of the base plus all option periods, to support the selection of the lowest priced, technically acceptable offeror. If the PAT finds that the information on proposed prices or previous contracts is not available or is insufficient to determine that the price is fair and reasonable, the PCO may use the cost analysis technique and request for other than certified cost or pricing data for evaluating the reasonableness of the offered prices.

The proposed prices for each CLIN shall correlate with prices proposed on Attachment (1), Pricing Worksheet.

A price breakdown of all cost elements to include direct labor categories/disciplines, direct labor hours, base rates, source of base rates (i.e. wage determination ) escalations, fringe benefits rate, overhead rate, general and administrative (G&A) rate, profit factor and/or any other applicable information to support proposed prices may be requested if needed to determine the price fair and reasonable. The unburdened direct labor rate paid to each non-exempt employee shall also be included if requested. The PCO may evaluate any and all information submitted by the offeror to support the reasonableness of prices proposed.

The Government will evaluate proposals for award purposes, by adding the total price for all options to include the Option to Extend Services (which shall be calculated as half the value of option year three (3)), to the total price for the base period of performance. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

In evaluating the price portion of the proposal, the PCO will evaluate the Offeror’s proposed price for completeness (all cells applicable filled out) and reasonableness. An unduly low price may be considered a performance risk when it’s determined that the low price is not based on a more efficient method of performing the work.

AWARD

Upon completion of the source selection evaluation, award will be made to the Offeror whose proposal, conforming to the solicitation requirements, is deemed the best value to the Government, considering all the lowest priced technically acceptable evaluation criteria as stated in the solicitation.

The Government intends to award the contract without discussions. The establishment of a competitive range is not anticipated. Accordingly, each Offeror should submit its most favorable terms from a cost/price and technical standpoint. However, the Government reserves the right to establish a competitive range and conduct discussions if later determined by the PCO to be necessary. If it is determined that discussions are necessary then they will be conducted IAW FAR Subpart 15.3.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Technical and past performance, when combined, are __________

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
