NORFOLK VA 23511-3392
IN REPLY REFER TO
Code 245I 20 August 2019
J&A# 19738
JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the Agency and Contracting Activity.
a. Agency Name: Forward Deployed Regional Maintenance Center (FDRMC)
b. Contracting Activity: Department of the Navy, Naval Supply Systems Command (NAVSUP)
Fleet Logistics Center (FLC) Norfolk Contracting Department, Code 245I
1968 Gilbert Street, Suite 600 Norfolk, VA 23511-3392
2. Description of the Action Being Approved.
This action is for the award of a contract on a sole source basis to CACI, Inc. – Federal (CACI) for visit support team services in support of the FDRMC’s detachments in Rota, Spain and Manama, Bahrain.
This proposed action will result in the award of a new cost-plus-fixed-fee contract with an approximate one-year base period of performance, beginning on 07 September 2019 and continuing through 31 August 2020. The contract will also contain four one-year option periods and a six-month option period pursuant to FAR clause 52.217-8, Option to Extend Services. The estimated value of the base period is , and the total value with all options is .
3. Description of Supplies/Services.
This requirement is for visit support team services in support of FDRMC. FDRMC’s headquarters are in Naples, Italy, with detachments in Rota, Spain and Manama, Bahrain. FDRMC supports the four guided missile destroyers homeported in Rota, Spain and approximately fourteen coastal patrol and mine countermeasures ships homeported in Manama, Bahrain. FDRMC also supports the Aegis Ashore Missile Defense System (AAMDS) in Deveselu, Romania. These ships and the Aegis shore site require periodic readiness assessments provided through contracted services. Fiscal year (FY) 2019 Operations and Maintenance, Navy (O&MN) funds will be utilized for this action.
Given the critical nature of the services described above, FDRMC cannot accept any lapse in support. CACI has personnel in place to support the Navy and is the only contractor in position to prevent such a lapse. Therefore, issuance of this proposed sole source action is necessary to ensure that FDRMC’s mission requirements continue to be met.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), - Only One Responsible Source, as implemented by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
The support to be provided under the authority requested by this J&A is critical and is necessary in order for the Navy to continue its mission. The conduct of assessments for the forward-deployed vessels in Spain and Bahrain is mission-critical and in direct support of Navy mission readiness. The Navy would be at risk of serious injury should
Source Selection Information – See FAR 2.101 and 3.104 2 there be a lapse in services. Performance is scheduled to begin on/around 07 September 2019 based on vessel availability and there are no alternatives to meet the Navy’s requirements.
This requirement is a follow-on to an existing task order from multiple award, indefinite-delivery contract N0018915D0033, administered by the Mid-Atlantic Regional Maintenance Center (MARMC). The incumbent is AECOM (formerly URS Federal Services, Inc.). The existing task order is scheduled to expire on 30 September 2019 and MARMC is unable to provide contracting support to FDRMC on future requirements. The existing contract was solicited using full and open competition. offerors submitted proposals
; awards were made to the three large businesses.
The contracting officer originally solicited this requirement competitively among all SeaPort Next Generation (NxG) contract holders, inclusive of both large and small businesses. On 17 June 2019, the contracting officer posted a Request for Information (RFI)/sources sought notice along with a draft performance work statement to the Seaport NxG portal. The RFI closed on 20 June 2019. A total of representatives from companies viewed the RFI, submitted formal responses.
The contracting officer issued Seaport NxG solicitation N0018919R3517 on 26 June 2019, which ultimately closed on 19 July 2019. No offerors submitted proposals.
To facilitate further interest and competition, the contracting officer posted a RFI/sources sought notice to the Navy Electronic Commerce Online and Federal Business Opportunities websites from 07 August 2019 to 09 August 2019 to identify any interested parties in the open market. The following companies submitted responses, with the corresponding capability determinations:
Due to the lack of interest from the SeaPort NxG contract holders and in the larger commercial marketplace despite attempts to solicit competitively, the contracting officer has determined it appropriate to pursue a sole source contract with CACI.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The contracting officer conducted market research in accordance with Part 10. Market research was performed through a review of the previous acquisition, discussions with the requiring activity and potential service providers, and through RFI/sources sought notices.
Source Selection Information – See FAR 2.101 and 3.104 3
As detailed elsewhere in this document, attempts to solicit competitively have been unsuccessful. Subsequent to the attempt to solicit competitively within the Seaport NxG portal, the contracting officer posted a RFI/sources sought notice to the Navy Electronic Commerce Online and Federal Business Opportunities websites on 07 August 2019 to identify any interested parties in the open market.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than CACI to provide the required services.
7. Determination of Fair and Reasonable Cost.
The contracting officer will determine the anticipated cost to the Government of the services covered by this J&A to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
As stated herein, CACI is the only contractor that possesses the necessary qualifications to immediately provide continued support of the required services without a negative impact to the Navy.
The Government expects to review its performance specification to determine if it can be adjusted to increase competition for any future acquisitions of these services.
