NO COST CONTRACT
NOTE: THIS IS A NO COST CONTRACT
There is no cost to the Government. The Flagship Publisher sells advertising to cover the costs and secure earnings.
The right to circulate the advertising in these publications to the DOD readership constitutes contractual consideration to pay for these DOD publications.
The publication becomes the property of the command upon delivery in accordance with the terms of the contract.
Navy Region Mid-Lant is an element of the United States Government. This agreement is a United States
Government contract authorized under the provisions of Department of Defense Instruction 5120.4 as an exception to the Government Printing and Binding Regulations published by the Congressional Joint Committee on Printing.
Although this contract is not subject to the Federal Acquisition Regulation (FAR) or the Defense FAR Supplement
(DFARS), FAR clauses useful in protecting the interests of the Government and implementing those provisions required by law are included in this contract.
PERFORMANCE WORK STATEMENT
NAVY REGION MID-ATLANTIC CIVILIAN ENTERPRISE NEWSPAPER
1.0 Introduction
As defined in Department of Defense Instruction 5120.4 and Secretary of the Navy Instruction 5720.44C (Public
Affairs Regulations), a civilian enterprise newspaper is published under written contract by a civilian concern exclusively in the interest of personnel within a particular Navy region at no cost to the United States government.
Its purpose is to provide Commander, Navy Region Mid-Atlantic (hereafter “Commander”) a primary means of communicating mission-essential information to members that fall under the regional command. The attached copy of the current newspaper is provided as an example for prospective Contractors, but it is in no way intended to limit future newspapers in terms of content, format or layout. THE FLAGSHIP currently has 900 distribution points, including on and off-base locations, as well as free home delivery available to active duty and retired military service members in the cities of Norfolk, Virginia Beach, Chesapeake and Portsmouth.
2.0 Provisions and Requirements
2.1 General Provisions;
2.1.1 - The Contractor shall publish a weekly civilian enterprise newspaper to provide news and command information to personnel of Navy Region Mid-Atlantic and surrounding naval activities. This publication is subject to the requirements of Department of Defense Instruction 5120.4 and Secretary of the Navy Instruction 5720.44C
(Public Affairs Regulations), all the provisions of those instructions apply to this contract whether they are explicitly stated in this contract or not, and to the conditions and agreements contained herein.
2.1.2 - The Contractor agrees to use the name “THE FLAGSHIP,” which is owned by the government, and no other name, on the newspaper as directed by the Commander during the life of the contract, unless otherwise directed by the Commander. Contractor further agrees not to contest ownership by the government of the name or to make any use directly or indirectly of the name or a name confusingly similar to that name on any publication it may independently produce either during or subsequent to the term of the contract. All uses of the name, (i.e.
sponsorships, trades, etc.) outside its use in the newspaper must be cleared by the Editor; Deputy Director of Public
Affairs, Navy Region Mid-Atlantic; or Director of Public Affairs, Navy Region Mid-Atlantic.
2.1.3 - Publication of THE FLAGSHIP shall be weekly. Each weekly issue published on Thursdays shall consist of not less than 24 pages and no more than 56 pages unless prior approval is granted by the Director of
Public Affairs, Navy Region Mid-Atlantic; Deputy Director of Public Affairs, Navy Region Mid-Atlantic; or Editor, who is the Contracting Officer Representative for this contract. Classified pages are to be included in the page count.
To allow for holidays, a maximum of 50 issues will be produced annually, as mutually determined.
2.1.4 - The-masthead of each issue shall carry the disclaimer in type no smaller than 6 points:
“Published by (name of Contractor), a private firm in no way connected with the Department of Defense or the
United States Navy, under exclusive written contract with the Commander, Navy Region Mid-Atlantic. This civilian enterprise newspaper is an authorized publication for members of the military services. Contents of the paper, including advertisements, are not necessarily the official views of, nor endorsed by, the U.S. Government, the
Department of Defense, or the Department of the Navy. The appearance of advertising in this publication, including inserts and supplements, does not constitute endorsement by the Department of Defense; the Navy; Commander, Navy Region Mid-Atlantic; or (name of commercial Contractor) of the products or services advertised. Everything advertised in this publication shall be made available for purchase, use, or patronage without regard to race, color, religion, gender, national origin, age, marital status, physical handicap, political affiliation, or any other non-merit factor of the purchaser, user, or patron. If a violation or rejection of this equal opportunity policy by an advertiser is confirmed, the contractor shall refuse to print advertising from that source until the violation is corrected. Editorial content is edited, prepared and provided by the Public Affairs Department of the Commander, Navy Region Mid-
Atlantic.”
2.1.5 - The masthead shall also contain the name and title of Commander, Navy Region Mid-Atlantic and the names, rates and ratings and editorial titles of military and civilian members assigned the duty of preparing the newspaper. The names and titles shall be listed in a section of the masthead entitled “Editorial Staff.” They shall be in type no smaller than 6 points.
2.1.6 - Editorial content shall be based on news releases, features, editorials and reports prepared by the
Department of Defense and Navy news-gathering agencies and the staff of Navy Region Mid-Atlantic. All other editorial material must be approved by the Editor, and will be printed on a space-available basis.
2.1.7 - In the interests of efficiency and economy, mechanization of the publishing process is essential. The
Contractor will provide computerized word-processing systems and layout stations as required. This will allow the automated transfer of layout and proof copy between the public affairs editorial staff and the Contractor. The newspaper staff shall consist of up to five members – four design workstations and two laptops are required (one for the editor and one for the designer). States Navy or its members. The Editor; Deputy Director of Public Affairs, Navy Region Mid-Atlantic; or Director of Public Affairs, Navy Region Mid-Atlantic reserves the right to refuse advertising space to any business for unethical or disreputable business practices that are not necessarily contrary to civil law.
2.2.5 - Be responsible for final proofreading of all editorial material throughout the newspaper, including supplements and special sections, and checking for accuracy, security and appropriateness of content.
2.3 The Contractor shall:
2.3.1 - Comply with the provisions of relevant Department of Defense and Navy directives and the provisions and requirements as contained herein.
2.3.2 - Use only the layout, editorial material and photographs provided by the Public Affairs Office for all sections, and only material approved by the Editor for special sections and supplements. Ensure that the Public

2.3.3 - Furnish the Public Affairs Office “dummy” layouts showing where all advertisements are to appear on the finished pages by Noon on Wednesday’s, or by close of business on Tuesdays during weeks shortened by holidays officially observed by government employees. The Contractor understands that delays in this deadline will result in delays in the editorial staff’s deadlines that may affect scheduled press times.
2.3.4 - Publish each issue of the newspaper in broadsheet format (6 equal columns) on a Standard 26.7# newsprint stock, or equivalent to industry standards in quality and size. Printing of newspaper must comply with industry environmental-friendly standards.
2.3.5 - Furnish trained personnel to assist in editing, design, makeup and layout of THE FLAGSHIP.

Credentials will be issued every five years and access privileges will be reviewed/renewed on an annual basis. The costs incurred to obtain Navy installation access of any kind are not reimbursable, and the price(s) paid for obtaining long-term DBIDS credentials will not be approved as a direct cost of this contract. Further information regarding DBIDS can be found at https://cnic.navy.mil/om/dbids.html (under
“Operations and Management”) or visit https://dbids.dmdc.mil.
2.3.6 - Receive approval by the Editor for all supplements and special sections to be published as part of
THE FLAGSHIP each year, printing no such section without prior approval. The Contractor understands that such approval, in the case of special sections or any other special consideration is a one-time-approval and that permission must be given in every case that goes beyond the scope of the standard three sections of THE
FLAGSHIP. In the absence of the Editor, approval must be received by the Assistant Editor; Deputy Director of
Public Affairs, Navy Region Mid-Atlantic; or Director of Public Affairs, Navy Region Mid-Atlantic.
2.3.7 - Layout all supplements of THE FLAGSHIP using style sheets, fonts, layout style and editorial style approved by the Editor. The Contractor shall also ensure that all such supplements are available for review by the editorial staff in appropriate time prior to the date which they must be sent to the printer. Finished editorial pages for such special sections must be delivered to the editorial staff a minimum of two working days prior to being sent to the printer so that they can be edited and corrections can be made.
2.3.8 - Propose a specific means for assignment of freelance reporters/photographers with a proven ability to effectively write and take compelling and appropriate images for THE FLAGSHIP, ensuring that each photographer hired is eligible for appropriate clearance to enter all area military bases. They will be required to wear and display credentials at all times while on the installation. 2.3.9 - Accommodate late-breaking news items after deadline.
2.3.10 - Propose a specific means to give the editorial staff the ability to download wire service photographs and stories as appropriate to accomplish THE FLAGSHIP mission of informing Sailors, family members, reservists and retirees about Hampton Roads base(s) actions in other parts of the world, or to provide visual information to go with local stories that may affect the intended audience. Additionally, access shall be granted to use/acquire photos taken by the Contractor for use in THE FLAGSHIP.
2.3.11 - Pay all costs associated with processed color separations.
2.3.12 - Print in each edition of the newspaper, an unrestricted number of photographs furnished by the
Public Affairs Office.
2.3.13 - Provide facilities and trained personnel to operate such equipment as may be necessary to produce the newspaper in a professional and acceptable manner.
2.3.14 - Solicit all advertising.
2.3.15 - Not sell advertising to the extent that it will force the Public Affairs staff to produce editorial content exceeding that required for the command communication mission of the newspaper.
2.3.16 - Not print advertising that glamorizes alcohol, tobacco and firearms or demonstrates service members partaking in alcoholic beverages, tobacco and firearms, in addition to logos of any company that promotes the consumption of alcoholic beverages in the newspaper or its supplements and special sections without the expressed permission of the Editor; Deputy Director of Public Affairs, Navy Region Mid-Atlantic; or Director of
Public Affairs, Navy Region Mid-Atlantic.
2.3.17 - Not solicit advertisements in the name of Navy Region Mid-Atlantic or the U.S. Navy. Active duty military and Department of Defense civilian personnel are prohibited from soliciting, endorsing, or accepting a payment for advertising.
2.3.18 - Ensure that the average quarterly amount of advertising content, measured in column inches, will not exceed 55 percent of the total newspaper. Advertising supplements to the paper will not count toward the overall percentage.
2.3.19 - Not accept for publication advertisements that are worded or phrased to give the reader the impression the U.S. Navy in any way endorses, guarantees or sponsors any product or service. Advertising that implies discrimination against any person because of race, color, religion, sex, national origin, age, marital status, physical handicap, political affiliation, or any other non-merit factor of the purchaser, user, or patron shall not be carried.
2.3.20 - Not enter into exclusive advertising agreements with any firm, broker, individual or organization, unless explicitly granted by the Director of Public Affairs, Navy Region Mid-Atlantic; Deputy Director of Public
Affairs, Navy Region Mid-Atlantic.
2.3.21 - Not distribute commercial enterprise comic or feature supplements without the approval of the
Director of Public Affairs Officer.
2.3.22 - Ensure that no advertisements debating policy or ideological subjects will be solicited or published in the newspaper. Including any political advertisements, or advertisement for a political party, candidate, or advocate a particular position on a political issue (see DoDI 5120.4).
2.3.23 - Allow the Editor (or in his/her absence the Assistant Editor; Director of Public Affairs, Navy
Region Mid-Atlantic; or Deputy Director of Public Affairs, Navy Region Mid-Atlantic) to review advertisements, including supplements and inserts, prior to publication to determine if they conform to accepted standards of good taste (as determined by Public Affairs) and propriety or contain anything which might cause the Commander, Navy
Region Mid-Atlantic to bar distribution of the newspaper on any installation in the region.
2.3.24 - Not solicit, knowingly accept, or publish advertising from firms or individuals whose business or premises have been placed off-limits to military personnel by competent military or civilian authorities. The Public
Affairs staff will furnish the Contractor a list of “off limits” establishments.
2.3.25 - Delete any advertisement before page proof approval by the Director of Public Affairs, Navy
Region Mid-Atlantic, wherein said advertisement was placed by, or promotes the goods or services of, a firm or individual who discriminates against a person(s) based on race, religion, national origin, sex, color, age, marital status, physical handicap, political affiliation or any other non-merit factor in the sole judgment of the Public Affairs
Officer, or whose premises have been declared “off limits” to military personnel by competent authority.
2.3.26 - Not conduct political opinion polls, surveys, or straw votes.
2.3.27 - Not accept advertisements which appear to be editorials or news stories without the expressed permission of the Editor; Deputy Director of Public Affairs, Navy Region Mid-Atlantic; or Director of Public
Affairs, Navy Region Mid-Atlantic. When said approval is granted, every effort will be made to avoid the perception that those advertisements are editorial content. In such rare cases where approval has been granted, these advertisements will be clearly labeled, top and bottom, as advertisements in a type size larger than the text type.
2.3.28 - Ensure advertisers observe all applicable local, state and federal laws in describing goods, services and commodities, and the terms of sale include guarantees and warranties. If credit terms are offered in such advertisements, a clear statement of the total cash prices as well as the total cost of the credit, including all charges, will be clearly shown in the company’s advertisements. If time payments are shown, the number of payments, the month of each and the time period will also be in a type size clearly readable in order that the reader can easily compute the dollar cost of the loan. Advertisements offering diamonds or other precious stones for sale should not depict the gems in greater than actual size unless a clear and conspicuous disclosure is made indicating that the illustration is an enlargement. Also, it is not permissible to state the weight of all diamonds contained in a piece of jewelry unless the weight figure is accompanied by the words “total weight” or similar words which indicate clearly that the weight shown is that of all the stones, not the center or largest stone. Additionally, adhere to general rules for advertising established in the standards of acceptability.
2.3.29 - Not sell advertising space prior to the date of award of the contract.
2.3.30 - Publish the newspaper on Thursday of each week, and furnish newspaper copies for distribution no later than 8 a.m. on the date of the publication. The first bundle of each issue will be delivered to the Public Affairs
Office on Wednesday of each print week.
2.3.31 - At no time may the number of issues of the newspaper being distributed off naval installations exceed 49 percent of the total copies distributed in a given week. The total number of copies published will generally be between 30,000-40,000, or higher, but at no time shall the number of issues published be less than
30,000. The Director of Public Affairs reserves the right, in coordination with the Contractor, to decrease/increase the number of copies to be delivered when necessitated by significant increases or decreases of military and civilian personnel at naval installations in the Hampton Roads areas, or in cases of extreme inclement weather.
2.3.32 – Coordinate with the Public Affairs staff delivery of newspapers and distribution locations of paper racks, on and off-base. All papers must be delivered to either approved newspaper racks, or to individual doors of base housing locations. The Contractor must, to the best of his/her ability, accommodate any on-base rack requests.
Delivery drivers are subject to the same conditions as in subparagraph 2.3.5A above.
2.3.33 - Provide a quarterly report of all on and off-base distribution locations to the Editor; Deputy
Director of Public Affairs, Navy Region Mid-Atlantic; or Director of Public Affairs, Navy Region Mid-Atlantic.
2.3.34 - Ensure that newspapers delivered to individual residences on-base or off-base are wrapped in plastic or otherwise protected when delivery is scheduled during periods of inclement weather.
2.3.35 - Change the publication date to take into account holidays which may fall on the said date or other significant events, provided that both parties mutually agree on the change.
2.3.36 - Prepare a section devoted to “Year in Review” for distribution on the first Thursday of the New
Year. No issue will be produced the last week of the calendar year, nor the first week of the New Year by the newspaper staff. The “Year in Review” issue will contain only previously approved editorial content and photographs.
2.3.37 - Not distribute a funded newspaper as an insert.
2.3.38 - Not distribute any other publication outside of the control of the Public Affairs Office editorial staff as an insert.
2.3.39 - Furnish full color pages on the fronts of each section of the newspaper (A1, B1 and C1) and at least one full color full page inside Section A, as applicable, for editorial content.
2.3.40 - Provide an unlimited number of Adobe Type 1 fonts, medium and bold, for headlines, outlines and copy. The point size will range from 4 points to 130 points. The primary body type will be determined by mutual agreement of the Editor and the Contractor, and the capabilities of the desktop publishing software in use. Once an acceptable range of fonts is decided upon, the fonts will be added to “style sheets” and all copy layouts in both the main paper and supplements will draw from these style sheets only, and the acceptable layout style set by the Editor will not be deviated from.
2.3.41 - Produce photo reproductions of the highest quality comparable to or exceeding local area daily newspapers.
2.3.42 - Provide adequate facilities for layout, production and publication of the newspaper in cases of extreme inclement weather, power outages and/or other natural disasters that require extended absence from the
Navy Region Mid-Atlantic Public Affairs Office.
2.3.43 - Not distribute the newspaper, or any part of the newspaper, as a supplement to or as an insert in any other newspaper or periodical.
2.3.44 - Produce a high quality, easily accessible, reader-friendly online version of THE FLAGSHIP each week, drawing on editorial content and photos from that week’s newspaper. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
