JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Surface Warfare Center, Crane Division, Expeditionary Integration Contract Branch, 0233.

2. Description of the Action Being Approved

Award of a contract with options on a sole source basis to FLIR Systems Incorporated (FSI), Government Systems, 25 Esquire Road, North Billerica, MA 01862-2598 (Cage Code 3UVR3) for Handheld Long Range Thermal Imager Sensor Systems (HHSS) (Part Number 26662-202) in support of United States Marine Corps.

3. Description of Supplies/Services

This requirement is a lifetime buy for the Ground Based Operational Surveillance System (G-BOSS) program to procure thirty-eight (38) HHSS in Fiscal Year (FY) 2018 with an option to procure up to twenty-two (22) HHSS in FY2019.

The Government has previously procured HHSS part number 26662-201; however, this part number is obsolete. Part number 26662-202 is considered a variant thereof and is considered form, fit, and function replacement of part number 26662-201. The differences in the 26662- 201 and 26662-202 variants include: the video processor board, mid wave optics, internal mounting, and software updates. Procurement of the HHSS includes a Recon III camera, a laser range finder, and a 2.5X extender.

The requirement of thirty-eight (38) HHSS in FY2018 was identified and started in FY2017;

however, part number 26662-201 became obsolete during the award of contract NOO 164 l 8DJQ99. The additional requirement to procure twenty-two (22) HHSS in FY2019 is the result of an increased demand and an increase in failures of the G-BOSS Light surveillance systems occurring outside the continental United States. The HHSS is a sensor that integrates into the G-BOSS Light surveillance system. On 15 August 2017 FSI Program Manager Chuck Clark stated part number 26662-201 configuration of the HHSS is obsolete for new production and FSI would produce limited quantities over a two-year timeframe of part number 26662-202 variant which is form, fit, and function compatible with the original version (Part Number 26662-201 ). Thereafter, FSI modified an existing part number 26662- 201 system into part number 26662-202 configuration. The Government successfully evaluated part number 26662-202 configuration integrated in the G-BOSS Light System on

28 February 2018. The Government evaluation confirms form, fit, and function compatibility.

The HHSS is a handheld, dual-thermal channel, multi-sensor target acquisition and target gee-location device. The HHSS includes a high performance, cooled large format indium antimonide focal plane array, with a mid-wave infrared (IR) camera, and an uncooled long wave 320x240 micro bolometer IR camera. Multi-sensor capability includes a laser range finder module, global positioning system, digital magnetic compass, and target gee-location software.

The HHSS is used in theater for detection and risk assessment of improvised explosive devices and other insurgent threats to ground-based troops engaged in major combat operations, irregular warfare, military support of stability, security, transition and reconstruction activities, and homeland defense and civil support operations.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

Estimated Dollar Value($) FY18 FY19 Total

O&M $2,916,666 $2,566,667 $5,483,333

PMC $1,516,667 $1,516,667

Total $4,433,333 $2,566,667 $7,000,000

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C.2304 (c)(l) Only one responsible source.

5. Rationale Justifying Use of Cited Statutory Authority

An award of the HHSS to any source other than FSI, the original equipment manufacturer, will cause unacceptable delays in fulfilling the agency requirements for HHSS. There are currently G-BOSS Light surveillance systems fielded and the Government estimates an increased requirement of G-BOSS Light surveillance systems to support full fielding of Approved Acquisition Objective including requirements in the middle east and Afghanistan. In addition to the fielded systems there are used in training, engineering, information assurance testing and to trouble shoot reported field issues. Due to the austere locations these units are operated in the G-BOSS program maintains a I 00 percent sparing model. The HHSS recent history experience twenty-four (24) repairs annually. Additionally, the majority of the current systems were procured in 2010 as a result the repair cost is increasing annually closer to the beyond economic repair threshold for the program.

The Government is in the process of awarding a competitive contract with an anticipated award date first quarter of FY2019 for the G-BOSS Light Optical Camera (GBLOC) to replace the HHSS. The GBLOC must be delivered and integrated into the G-BOSS system before the GBLOC can be fielded. After integration, the GBLOC will be subjected to functional testing, environmental testing, operational testing and laser safety certification

followed by logistics documentation updates and delivery of production units. The technical activity estimates twenty-four (24) months required from the date of contract award to the GBLOC fielding. This is an unacceptable delay that will result in failure of G-BOSS Light surveillance systems to execute its mission of providing situational awareness through surveillance and assessment of threats. Failure of this mission will place personnel at risk of loss of life from improvised explosive devices during security operations and other insurgent activities including irregular warfare. In addition, the G-BOSS program has insufficient spares to support the repair turnaround time and replacement of Beyond Economic Repair systems. It is imperative that additional systems be procured to meet existing outside contiguous United States surveillance and security needs.

The following is the estimate time required to develop another source.

I Estimate Time I ment environmental/functional/ ooerati onal)

HHSS Technical documentation HHSS Laser Safety approval (overlap with documentation) HHSS oroduction deliver Total 24 moot

The Government estimates the time required for another vendor to modify an existing commercial system or develop a new system to meet the HHSS performance specifications would be at least twenty-four (24) months. The current Government requirements do not allow a twenty-four (24) month delay for another source to develop, test, and field a different system configuration.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed sole source contract was synopsized on the Federal Business Opportunities (FEDBIZOPS) website on 2 July 2018 and only FSI expressed an interest in this requirement. No additional market research for this requirement was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than FSI to provide the required supplies and services.

However, extensive market research was conducted for the competitive follow-on replacement contract (GBLOC). The GBLOC requirement (N0016418RJV28) was synopsized on FEDBIZOPS on 31 January 2018 and a Request for Information (N0016417SNB51) was issued on FEDBIZOPS on 14 February 2017. The result of market research concluded that FSI and Optics 1, Inc. (Optics!) were able to meet the GBLOC requirement. However, the technical activity confirms that Opticsl is unable to overcome the twenty-four (24) month delay to develop, test, and field a different system configuration compatible with G-BOSS Light surveillance systems.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. Significant quantities of this requirement (Part Number 26662-201) have been purchased from this offeror in the past and pricing information was received on those procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

As discussed in Paragraph 3, this is a lifetime (one-time) buy for the HHSS. The Government is in process with a full and open competition contract action to procure a replacement system under solicitation NOO 16418RJV28, GBLOC. Solicitation NOO 16418RJV28 is anticipated to be awarded first quarter of FY 2019.
