About this file

This is an Intent to Award Sole Source document issued by the South Carolina Department of Corrections (SCDC) for maintenance, repair, parts, software, programming, troubleshooting, upgrades, design, additions/expansions, and fabrication/welding services for a Homogenizing and Pasteurization HTST (High Temperature Short Time) System installed at the Wateree Dairy Farm. The scope of work requires all services to meet USDA Grade A Food Plant and DHEC Regulations. The contract is structured as a one-year initial term beginning June 5, 2023, and ending June 4, 2024, with four automatically renewable one-year options for a potential total of five years. The response period deadline for the sole source submission is June 5, 2023, at 10:00 a.m. SCDC previously advertised Solicitation #5400015233 for repair and parts services through the South Carolina Business Opportunities (SCBO) portal but received no responses other than from the intended awardee.

The sole source award is designated for MG Newell Corporation, as the company designed, built, and installed the original system and is identified as the only manufacturer or distributor capable of maintaining the equipment. The justification for sole source procurement is documented in the file, and the notice will be posted on the SCBO portal for a minimum of five to ten business days as required by South Carolina Code 11-35-1560. Interested parties may submit protests within five business days of notice posting or submit formal protests within fifteen days, with all protests directed to the Chief Procurement Officer at the Materials Management Office. Vendors responding to this solicitation must provide full legal business name, authorization signatures, state vendor number, home office address, notice address, and documentation of authorization to perform all required work.
