About this file

This document is a Method of Operation (MOO) for Contract M4018, a Road Right of Way Maintenance Equipment cooperative purchasing agreement established by the State of New Jersey Division of Purchase and Property. The contract extends through May 15, 2029, with the possibility of three one-year extensions. Seven contractors have been awarded contracts under this cooperative purchasing program through Sourcewell: Alamo Group Municipal Mowing Solutions LLC, ATMAX Equipment Co., Diamond Mowers LLC, Energreen America Inc., Land Pride (a division of Great Plains Manufacturing Inc.), Montage Enterprises Inc., and Green Climber NA. Each contractor holds both a Sourcewell contract number and an NJSTART contract number for procurement purposes.

The contract encompasses three primary line items: equipment purchases with percentage discounts off list prices ranging from 5% to 25% depending on the contractor and brand; delivery costs including expedited delivery, return shipping, and restocking fees negotiated case-by-case; and hourly or task rates for services including operator training, installation, maintenance, repair, and site consultation. Equipment offerings include agricultural machinery, lawn mowers, tractors, forestry equipment, landscape machinery, and specialized right-of-way maintenance equipment such as boom mowers, flail mowers, and remote-controlled equipment. Using agencies must document their selection process and demonstrate that contractor selection is based on price and terms most advantageous to the agency's needs. Contractors may utilize dealers, distributors, and subcontractors subject to New Jersey compliance requirements and written approval from the assigned Procurement Specialist.

Equipment, Products, or Services may be added or removed from the Hot List at any time through a Sourcewell Price and Product Change Form, as defined in Article 4 of the Sourcewell contract. Hot List program and pricing may also be used to discount and liquidate close-out and discontinued Equipment and Products as long as those close-out and discontinued items are clearly identified as such. Hot List Pricing is published under the Sourcewell contract and is made available to all Using Agencies.

At the time of auditing, the Using Agency will be required to demonstrate that the establishment of the purchase requirements is free from any bias or inclination against or in favor of any Contractor. Using its purchase requirements, current price list (as published on the Sourcewell website), Contract discount, and the hourly rate/task rate (if applicable), a Contract user shall determine the final purchase price for each Contract for a given price line item.
