A Contract net line will be instituted since, in most cases under the Sourcewell contracts, the proposed Contractors are offering varying discounts off of the list price, depending on the manufacturer, product and volume. The percentage discounts offered by the proposed Contractors under the Sourcewell contract will be added to the Contract line description in NJSTART. The percentage discounts will be applied to the price lists published on the Sourcewell website under each Contractor’s Sourcewell contract.

Contract Line 2: Each Contract consists of a net line for delivery charges (including expedited delivery charges, if applicable), return shipping charges or restocking fees.

Using Agencies will negotiate delivery charges and return shipping charges with the Contractor prior to the issuance of a purchase order.

Contract Line 3: Each Contract consists of a net line for the hourly rate or task rate for services. These services include, but are not limited to, agency training (operator, technician, etc.), installation, inspections, maintenance and repair services, and site consultation/survey/design services (consultation may apply to equipment layout/placement, to ensure that the lifts and equipment will fit in the Agency facility and to ensure that the equipment ordered is the proper style, type and capacity for the intended application).

Using Agencies will obtain a Quote from the Contractor for any of these services prior to the issuance of a purchase order.

5.0 Contract Selection Process:

Contract users shall make purchases from that Contractor whose Contract terms and conditions are most advantageous, price and other factors considered. Using Agency shall initiate a Contract purchase on an as-needed basis by preparing clear and unambiguous requirements for the goods and/or services to be ordered, based solely upon the Using Agency’s needs. At the time of auditing, the Using Agency will be required to demonstrate that the establishment of the purchase requirements is free from any bias or inclination against or in favor of any Contractor. Using its purchase requirements, current price list (as published on the Sourcewell website and/or in NJSTART), and Contract discount, a Contract user shall determine the final purchase price for each Contract for a given price line item. The Contract user must document all phases of its Contract selection process for each purchase under any Contract resulting from this Bid Solicitation.

All documentation shall be preserved and presented to auditors upon request. This Bid Solicitation is designed to establish convenience Contracts only and not to replace the Contract selection process outlined above.

The Division's Contract Compliance and Audit Unit (CCAU) may conduct an audit of any Contract user's purchase transactions and documentation at any time during and after the Contract term.

The report shall include the reasons for selecting a particular Contract and identify the Contract user, parts description, State Contract and line #, quantity purchased and total purchase order price.

6.0 Delivery Timeframes and Delivery Charges:

Contractor deliveries shall be made in strict accordance with the instructions from the Using Agency.
