QUESTIONS WITH ANSWERS

1) Please confirm we need to provide current market pricing for each CLIN# specified in the bid documents?

a. The quoted pricing should be a price you are able to deliver under for the year. We are including clause “52.216-2 Economic Price Adjustment-Standard Supplies” into the solicitation and contract. This will allow for some flexibility in pricing. Please see the particular clause for details, all provisions and clauses can be found at https://www.acquisition.gov/ .

2) Please confirm pricing will not be fixed for the term of the contract?

a. Pricing will be fixed for each CLIN with the flexibility of clause 52.216-2.

3) Please confirm for the contract we need to use our best current market price for each line item at the time of the bid?

a. Please see comments above.

4) Will we need to use Times New Roman on all bid documents?

a. Yes.

5) Please confirm how long this contract will be for?

a. One base year with the possible execution of four option periods. 52.217-8 is also included that allows for the contract to possible be extended by 6 months.

https://www.acquisition.gov/

6) Please confirm there will be no BPA this time and only one vendor will hold this contract?

a. The Government anticipates awarding a single vendor Indefinite Delivery Indefinite Quantity

(IDIQ) contract.

7) Please confirm will there be a separate fee charge to preform visual inspection on all tanks? Stated on page

16 of 60 #2.

a. No. This will be part of the vendor’s requirement upon award of the contract.

8) Can the Government please give more clarification on page 18-60: Solicitation provisions

a. Please visit https://www.acquisition.gov/ for full details on clauses and provisions

9) Can the Government please state when the award will be published? What is the timeline to award this solicitation?

a. The Government anticipates this requirement to be awarded and announced on or before 6

December 2019

10) Can the Government please state what documents will be needed for the technical request?

a. Please refer to Addendums 52.212-1 and 52.212-2.

11) Can the Government please state when the award will be published? What is the timeline to award this solicitation?

a. Please see question 9) above.

12) Can the Government please confirm price submitted for this contract will not be the price for the duration of this contract?

13) I was hoping to get more information about the expected frequency of deliveries to the Marine Corps

Mountain Warfare Training Center in Bridgeport, CA.

a. When temperatures are colder it will be monthly for most locations. When temperatures are warmer it may be closer to every other month.

14) How will scheduling for deliveries to the smaller tanks be handled? Can the vendor deliver when the smaller tanks are low based usage, degree days and other factors with system generated tickets or will the end user only issue task orders with specific gallons?

a. Scheduling will be arranged on an as needed basis. In the past, this has been done on a monthly basis. The vendor can only deliver once a funded task order has been issued for the specified amounts.

15) Will orders for the large base camp tanks be requested in 9,000 gallon quantities or more?

a. No. Sometimes orders will be less than 9,000 gallons. Orders for the bulk delivery locations will never be less than 1,000 gallons.

a. The Government will not order less than 1,000 gallons at a time for the bulk tanks. However, we cannot change Task Order minimums. There may be Task Orders issued for only lesser amounts/bobtail deliveries that do not include deliveries to the bulk tanks.

17) Will only one vendor be selected for the whole contract?

a. Yes, please question 6) above.

52.216-2 ECONOMIC PRICE ADJUSTMENT--STANDARD SUPPLIES (JAN 1997)

(a) The Contractor warrants that the unit price stated in the Schedule for ___ [offeror insert Schedule line item number] is not in excess of the Contractor's applicable established price in effect on the contract date for like quantities of the same item. The term "unit price" excludes any part of the price directly resulting from requirements for preservation, packaging, or packing beyond standard commercial practice. The term “established price” means a price that (1) is an established catalog or market price for a commercial item sold in substantial quantities to the general public, and (2) is the net price after applying any standard trade discounts offered by the Contractor.

(b) The Contractor shall promptly notify the Contracting Officer of the amount and effective date of each decrease in any applicable established price. Each corresponding contract unit price shall be decreased by the same percentage that the established price is decreased. The decrease shall apply to those items delivered on and after the effective date of the decrease in the Contractor's established price, and this contract shall be modified accordingly.

(c) If the Contractor's applicable established price is increased after the contract date, the corresponding contract unit price shall be increased, upon the Contractor's written request to the Contracting Officer, by the same percentage that the established price is increased, and the contract shall be modified accordingly, subject to the following limitations:

(1) The aggregate of the increases in any contract unit price under this clause shall not exceed 10 percent of the original contract unit price.

(2) The increased contract unit price shall be effective (i) on the effective date of the increase in the applicable established price if the Contracting Officer receives the Contractor's written request within 10 days thereafter or (ii) if the written request is received later, on the date the Contracting Officer receives the request.

(3) The increased contract unit price shall not apply to quantities scheduled under the contract for delivery before the effective date of the increased contract unit price, unless failure to deliver before that date results from causes beyond the control and without the fault or negligence of the Contractor, within the meaning of the Default clause.

(4) No modification increasing a contract unit price shall be executed under this paragraph (c) until the Contracting

Officer verifies the increase in the applicable established price.

(5) Within 30 days after receipt of the Contractor's written request, the Contracting Officer may cancel, without liability to either party, any undelivered portion of the contract items affected by the requested increase.

(d) During the time allowed for the cancellation provided for in subparagraph (c)(5) of this clause, and thereafter if there is no cancellation, the Contractor shall continue deliveries according to the contract delivery schedule, and the

Government shall pay for such deliveries at the contract unit price, increased to the extent provided by paragraph (c) of this clause.
