CONTRACT MANAGEMENT

Notwithstanding the Contractor’s responsibility for total management during the performance of the contract, the administration of the contract will require maximum coordination between the Government and the Contractor. The following will be the Government point of contact during the performance period:

CONTRACT ADMINISTRATOR: Kelly Bell, kelly.e.bell@usmc.mil, (703)432-1082

CONTRACTING OFFICER’S REPRESENTATIVE (COR): TBD

EEO COMPLIANCE

The Executive Order 11246 prohibits federal contractors and federally–assisted construction contractors and subcontractors, who do over $10,000 in Government business in one year from discriminating in employment decisions on the basis of race, color, religion, sex, or national origin. The Executive Order also requires Government contractors to take affirmative action to ensure that equal opportunity is provided in all aspects of their employment.

The National Pre-Award Registry provides information concerning Federal Contractors, that have been reviewed by the Office of Federal Contract Compliance Programs (OFCCP). These Federal Contractors have been found to be "In Compliance" with the Equal Employment Opportunity (EEO) regulations that the OFCCP is mandated to enforce. The information contained in the Registry is for a past two-year period from the date searched. The Registry is updated nightly and facilities reviewed more than 2 years ago are removed as new ones are added.

OFCCP Pre-Award Clearance must be conducted and a favorable finding returned before an award can be made for this solicitation.

ECMRA

Enterprise-Wide Contractor Manpower Reporting Application (ECMRA). The Contractor shall report ALL contract labor hours (including subcontractor labor hours) required for performance of services provided under this contract for CAOCL Language and Culture Training and Education Support Services via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: https://doncmra.nmci.navy.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at: https://doncmra.nmci.navy.mil

REQUIRED INSURANCE

The Contractor shall procure and maintain during the entire period of performance under this contract the following minimum insurance found in FAR 28.307 and in accordance with FAR 52.228-5:

(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (See FAR 28.305(c) for treatment of contracts subject to the Defense Base Act.)

(b) General liability.

(1) The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(2) Property damage liability insurance shall be required only in special circumstances as determined by the agency.

(c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

WORKING ON GOVT INSTALLATIONS

IDENTIFICATION OF CONTRACTOR EMPLOYEES

The Contractor shall provide each employee with an identification badge, which identifies by photograph the individual as an employee of the Contractor. These badges shall be worn at all times and presented for examination upon the request from the Contracting Officer (KO), COR, QA Personnel, Military Police or any other Government official with a need to see the badge.

ENVIRONMENTAL NON-COMPLIANCE

Should the Contractor or any subcontractor be found to be in non-compliance with any of the State, County, or Local regulations, all penalties, fines, costs and/or fees assessed against the US Government, Department of the Navy, United States Marine Corps, or the Contractor shall be paid by the Contractor with no change in contract price.

SECURITY AND REGULATIONS

The site of the work is on a military reservation and all rules and regulations issued by the Commanding Officer, Marine Corps Base Quantico, Virginia, or other base assignments covering fire, safety, environmental, sanitary requirements, admission to the installation, conduct of operations and so forth, shall be observed by the Contractor.

Rules, regulations, directives, and requirements which are issued during the contract term by USMC military command authorities, under their responsibility for law and order, administration and security on the Installation shall be applicable to all contractor personnel or representatives who enter the installation or who travel on government transportation. This requirement shall not be construed or interpreted to establish any degree of government control, which is inconsistent with the intent of a non-personal services contract. Contractor personnel or representatives shall be subject to checks as may be deemed necessary to assure that their presence on the Installation does not violate these requirements. No employee will be permitted on the Installation when such a check reveals that his presence would be detrimental to the security of the Installation or the accomplishment of work. In addition, the Contractor shall be subject to the requirements of Marine Corps Base Order (MCBO) 4200.3, entitled "Contractor Screening Policy". Copies of current regulations may be obtained from the KO.

The Contractor is fully responsible for the performance and conduct of his employee at all times while on post performing under this contract. The Contractor shall not allow any employee to perform work under this contract while under the influence of alcohol, drugs or any other incapacitating agent. Military police and any other enforcement personnel on base have the right to deny entry to base or remove from base any contractor employee for misconduct, which endangers the health or safety of people or property, or for any reasons of security. In addition, the Base Commander may bar any individual from entering the post under the authority of 18 U.S.C. 1382. Removal from base of a contractor employee in accordance with the above shall not relieve the Contractor from the requirement to meet all of the terms and conditions of the contract.

SAFETY AND ACCIDENT PREVENTION:

In performing work under this contract the Contractor shall:

PERFORMANCE WORK STATEMENT

Center for Advanced Operational Culture Learning (CAOCL)

CAOCL Language and Culture Training and Education Support Services

1. GENERAL: This is a non-personal services contract to provide language, regional expertise, and culture (LREC) training and education support services. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, computer software, supplies, transportation, tools, materials, supervision, and other items necessary to perform LREC training and education support services as defined in this Performance Work Statement except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2 Background: The Marine Corps’ Center for Advanced Operational Culture Learning (CAOCL) ensures Marines are equipped with operationally relevant regional, culture specific, culture general, and foundational language instruction to support effective planning and operations in the joint, combined, and expeditionary environment. CAOCL is chartered under DoD Directive 5160.70 and is a subordinate activity under the Marine Corps University (MCU). The CAOCL staff executes pre-deployment training programs (PTPs), provides direct support to the operating forces, provides operationally focused programs in individual and collective training, conducts social science research, supports service-mandated LREC institutionalization requirements, and conducts Professional Military Education (PME) based upon mission scenarios and identified needs, as well as the need to prepare Marines for anticipated and emergent contingencies.

CAOCL’s approach to education and training covers four content areas: language, regional, culture specific, and culture general knowledge and skills, collectively referred to below as LREC (language, regional expertise, and culture). For the purposes of this PWS, the term “LREC SME” refers to personnel with subject matter expertise in CAOCL’s four content areas combined with a thorough, current understanding of the region and cultures in their designated area. LREC SMEs are recognized country and regional experts with significant first-hand experience living and working abroad as well as thorough and current knowledge of a designated area. Such experts must be able to combine knowledge and experience to support tactically and operationally relevant training and education efforts across CAOCL’s programs and initiatives by conducting independent research, writing and revising course materials and other products, and delivering periods of instruction.

CAOCL annually provides LREC pre-deployment training to well over 40,000 Marines and Marine units deploying worldwide for missions that span the range of military operations. CAOCL training solutions range from one hour briefs to four-week classes to field assessments, and focus on LREC aspects that will enhance Marines’ capabilities in a specific mission and locale.

CAOCL’s principle education program is the Regional, Culture, and Language Familiarization (RCLF) Program, which is a career-length program designed to instill, develop, and sustain basic LREC capabilities in our career Marines. The end state of this program is to provide a basic foundation to enhance cross-cultural competence within the general purpose force through a familiarization with culture general concepts, regional context, culture specific information, and tactical phrase usage in a regional language. CAOCL also provides LREC instruction, support, and staff exercise participation for several Marine Corps University schools and other Marine Corps formal schools and offers LREC related electives in support of MCU.

CAOCL is chartered to provide LREC institutionalization across the Doctrine, Organization, Training, Materiel, Leadership, Personnel and Facilities (DOTMLPF) pillars. To that end, CAOCL is responsible for drafting and/or reviewing departmental, joint, interagency, and service-level LREC documents for equity and concurrence. Additionally, CAOCL is responsible for maintaining the LREC Training and Readiness Manual.

1.3 Objectives: A comprehensive, flexible solution is needed to respond to emerging global USMC requirements and changing situations such as emerging threats and opportunities across the globe. In order to respond to operational needs, LREC SMEs and operational support functions are required in order to prepare forces for deployment. CAOCL relies heavily upon these services to support its evolving mission. The main objective of the program is to ensure Marines deploy with an operational understanding of the local military and partner cultures and regional dynamics relevant to the mission with select Marines being language-enabled, in order to facilitate mission success.

1.4 Scope: The scope of this effort is for the provision of operational, technical, logistical, and programmatic support of CAOCL mission requirements. Principal support areas under this effort include all facets of program planning and execution required to create, update, and maintain an operationally focused LREC program. Critical capabilities within this effort include providing professional foreign LREC training and education programs and services that improve the cross-cultural effectiveness of Marines. Additional capabilities include the requirements to conduct translational social science research program analysis, assessment, and policy support, as well as the ability to provide Curriculum Development and Instructional Systems Design in accordance with established training and education standards, SMEs in operationally relevant culture general concepts and skills from social and behavioral science with sufficient knowledge of military missions who can integrate culture general in CAOCL’s education and training materials.
