LIMITED SOURCES JUSTIFICATION
Determination Memorandum for Acquisitions Over $3,500 but not Exceeding the SAT
All solicitations and orders shall be competed unless a justification to limit competition using an exception in FAR Part 8, 13, or 16, as applicable to the acquisition, is approved by the Contracting Officer. When the customer describes an item or service, which limits the availability to one source or a particular brand name, there must be a technical explanation describing why only that specific one will meet the government’s requirement. Statements must be detailed and identify the harm that would come to the government (e.g. lack of capability or safety impact). The customer MUST COMPLETE all questions below, as applicable.
PURCHASE REQUEST OR REQUISITION NUMBER ESTIMATED AMOUNT
1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES AND THE INTENDED USE.
2. THE CIRCUMSTANCE THAT REQUIRED LIMITING SOURCES TO A SINGLE MANUFACTURER OR SERVICE PROVIDER. (See FAR 8.405- 6(a)(1)(i) and (b)(1) for exceptions that apply to orders under GSA schedules. See FAR 13.106-1(b)(1)(i) for open market purchase exceptions. See FAR 16.505(b)(2)(i) for exceptions that apply to orders against multiple award contracts.)

NAVSCIATTS is requesting upgrades to the current fleet of Patrol Boats - Light (PBLs) used for on-going Naval Special Warfare Riverine training. Extensive training has resulted in damage that requires attention in order to avoid destruction of the vessel. These repairs include replacement of the Boats Keel Guards and replacement of the navigation systems that have reached the end of their useful life. The replacement of the keel guards will protect the hulls from debris and water intrusion, allowing training to continue and ensure training can be conducted safely. Having a functional navigation system is a requirement for all training boats per maritime regulations and will ensure safe navigation during training.
IAW FAR 13.106-1(b)(1)(i) Only one source is reasonably available
Boston Whaler is the original manufacturer of the PBLs, but no longer provides support for these vessels. However, a licensing agreement has been reached with United States Marine Inc. (USMI) to provide technical specifications which will allow them to design and fabricate the required replacements/upgrades. As these boats are custom made for NSW no replacement parts exist in the commercial marketplace. This licensing agreement will allow USMI access to the proprietary drawing owned by Boston Whaler required to produce the required hardware and ensure the vessel will operate as originally intended. The required technical specifications are proprietary to Boston Whaler and attempts to re-engineer the parts by another vendor would result in a duplication of cost and result in unacceptable delays to the training schedule. Furthermore the work would be done without the oversight of Boston Whaler which may result unsafe repairs, thus USMI is the only capable source for this requirement.

NSWC will continue to monitor the market place for competitive options to support these requirements as well as to remain informed of changes in technology.
