definite quantity, or requirements): ____ _
□ Other (specify): ____ _
□ Completion Form □ Term form
• Acquisition identification number.
c. Total estimated dollar value and performance/delivery period.
12 months plus 4 Option Years
4. Identification of the statutory authority permitting other than full and open com petition.
Dhis acquisition is conducted under the authority of 41 United States Code (U.S.C.) 253(c)( 1) as set forth in Federal Acquisition Regulation (FAR) 6.302- 1
□ This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.
□ This acquisition is conducted under the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C. 428a).
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
a. Name and address of the proposed contractor(s).
Carl Zeiss Microscopy, LLC., at 1 Zeiss Drive, Thornwood, NY, 10594- 1939 is the proposed sole source contractor and manufacturer.
b. Nature of the acquisition and proposed unique qualifications of the contractor(s).
The Zeiss LSM880 Airyscan FAST confocal microscope uses proprietary technology to capture high quality electronic images of live cells and other biological systems moving at high speeds. This confocal microscope is unique because it uses patented technology (Patent#8705172) to improve overall performance, allowing for increased sensitivity, resolution, and speed. Microscope: The Axio Observer. 7 microscope has fully integrated environmental control units in the microscope. Photomultiplier detection unit: The LSM880 has a 34-channel detection unit which consists of a calibrated 32-element Gallium Arsenide Phosphide (GaAsP) array PMT with typical QE >45 % (peak) and two calibrated flanking single PMT detectors;
the whole Quasar detector is peltier cooled. Laser: The laser system has a software integrated linear modulation of laser power from 0.001 to 100% for all laser lines between 458 and 633nm is supported and can be critical to reach the low light level imaging powers that are required for sensitive experiments. Up to 8 laser lines can be used simultaneously. Software: The System Self-Maintenance Tool is an easy-to-use software along with a calibration objective for maintaining optimal system performance by automated calibration routines.
6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies
An notice of intent will be posted on FedBizOpps as required by FAR Subpart 5.2
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
This system consists of many parts, most of which are manufactured in Germany. The cost of the service contract reflects the added costs of obtaining the parts and using repair technicians who have undergone extensive training by the manufacturer, Carl Zeiss Micrscopy.
8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Market research shows that none of the mandatory sources such as NIH Stock, NIH Surplus, DSEIS, CREx, DLR, and Ability One offer service for the LSM880 Airyscan FAST confocal microscope.
9. Any other facts supporting the use of other than full and open competition.
The LSM880 Airyscan microscope is a specific platform that uses patented technology. The only persons qualified to perform PM and remedial services on the system are those specifically trained and approved by Carl Zeiss Microscopy, the manufacturer. Members of the lab are not qualified to service this microscope. Only parts approved for the system may be used-no generic parts are available. The laser system requires personnel who are specially trained in class 3b and 4 laser safety.
10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.
No other sources have expressed an interest, in writing, in the proposed acquisition.
