Justification for Other Than Full and Open Competition Department of Labor
Office of Administrative Services and Management, Business Operations Center, Wirtz Labor Library
Access to and use of Online Computer Library Center (OCLC) Cataloging and Interlibrary
Loan Subscriptions
(1) Nature and/or description of the action being approved.
Online Computer Library Center (OCLC) is a membership-based organization that is the sole source provider of cooperative tools, services, and resources available to libraries around the world. OCLC, with subscription-based access, allows members to access databases and tools to provide services, such as cataloging and interlibrary loan participation, that would otherwise be too time-intensive or costly for a non-member library. No other collaborative information-sharing network for libraries exists.
OCLC is of particular value to smaller libraries, such as the Department of Labor Wirtz Library, where information shared between libraries eases the workload of a small staff and increases the availability of resources to patrons.
(2) A description of the supplies or services required to meet the agency's needs (including the estimated value including all options).
Description:
The vendor (OCLC) shall provide access to the

• WorldShare ILL Subscription: Access to a system that allows libraries around the world to transmit interlibrary loan requests to one another
Estimated Value – The Government cost estimated for the total five (5) years is $122,049.99.

(3) An identification of the statutory authority permitting other than full and open competition.
_X__ FAR 6.302-1-- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
OCLC is the only provider available. OCLC is a recognized and trusted provider in the library field and is utilized by all major libraries.
(4) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
For each of the below features, OCLC is the only provider available. OCLC is a recognized and trusted provider in the library field and is utilized by all major libraries.
• Cataloging and Metadata Subscription: Access to a database of item and serial catalog records allows libraries to upload catalog records that other institutions may then “copy” and import into their system. A majority of these types of records are generally produced and/or reviewed by the Library of Congress’s cataloging division. Having access to this tool allows the Library to incorporate expert detailed catalog records into its catalog that then improve patron access when searching for materials.
• WorldShare ILL Subscription: An interlibrary loan service utilized by libraries around the world allows member libraries to easily request books, journal articles, and other materials from any other member library. This service is of great import when a library does not have an item requested by a patron. The cost of the subscription to gain access to the service is significantly less expensive than the purchasing of individual items (books, journal articles, etc.) throughout the year.
(5) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
No exceptions under 5.202 apply and a notice can be posted.

(6) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
OCLC’s price is fair and reasonable, but the library will continually evaluate the market annually for competing products, if they should ever emerge.
(7) A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted.
This product is incredibly unique and is relied upon heavily by most libraries around the globe.
Over 72,000 libraries in 170 countries utilize OCLC’s services and contribute to its status as the world’s greatest holder of shared databases and bibliographic information for libraries. OCLC drives library development, and its tools currently utilized by the Wirtz Labor Library are mission-critical given the small staff of the library and the Department’s necessity to have access to a nearly limitless array of information.
OCLC is non-profit, content- and platform-neutral, and libraries pay for access to services via a membership that they may then incorporate into their own systems. No other large-scale service participated in by thousands of libraries exists.
(8) Any other facts supporting the use of other than full and open competition, such as:
(i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
Market research determined that OCLC is the only suitable provider for this requirement.
(ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
The Government cost estimated for OCLC’s services is $122,049.99 over the course of five years. This amount is based on a five-year quote received from OCLC assuming a 5% yearly increase. The amount is on trend with previous costs paid for the same service to date.
(iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
Not applicable.
(9) A listing of the sources, if any, that expressed in writing, an interest in the acquisition.
OCLC is the only provider of these services, and thus no other sources are available.
(10) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The agency will continually review its use numbers for its databases and will evaluate the market annually for competing products.
