About this file

These are the minutes from an Industry Day held on January 15, 2025, in Seattle, Washington for the JBLM DES Microgrid project being managed by USACE Louisville District. The project involves constructing a microgrid system at Joint Base Lewis-McChord powered by two 6MW natural gas generators, a 6MW/6MWh energy storage system, and a 150kW solar array to provide continuous power to I Corps, Garrison and DES Headquarters during grid outages.

Key details discussed included: City Light & Power (CLP) will be the prime contractor through a sole source award and will handle procurement of major equipment and subcontractors; a Project Labor Agreement (PLA) will be required with local unions; Buy American Act requirements apply; the project is funded through FY24 MILCON; and Seattle District will provide day-to-day oversight while Louisville maintains COR responsibilities. The microgrid must support approximately 5MW of load, power critical facilities for 14 days when islanded, and comply with historic district requirements. CLP indicated they plan to competitively bid all equipment and subcontract a majority of the work once they receive the RFP.

Executive Secretary of Southbound trade Union born in Indiana stationed in Ft. Lewis….

Joined labor union specializing in concrete and underground wiring infrastructure Union Activities: Merged Thurston County, Grays Harbor, Lewis County, northern portion of Pacific County and Pierce County.

Represent 18 construction unions as a conglomeration plus the carpenter unions, Carpenter Unions are not a part of the conglomeration but will be part the PLA as well.

“Current PLA under the Sound Transit Development Project - 15 jobs going under that PLA all over $35M. Additionally, we do have other concurrent active PLAs.”

Job classes I represent: Boiler operators, Brick makers, drywall installers, elevators installers, glazers, HVAC, painting, plumbers, sheet metal.

I do have a PLA I have used on JBLM that has been awarded, PLA was 15 pages total, not a monster document as industry would assume. That current PLA speaks to solicitation, then goes out to all craft workers, one agreement that ties all workers in on the site. Specific class laborers will be phased in when their work is needed.

National Labor relations Act – US federal law that protects the right of private sector employees to organize into unions, engage in collective bargaining, and take collective action like strikes

+Mandatory items subject to bargain agreement.

+Permissive items are the items of negotiations that the unions would like to see in the
agreement.

What are Pre-hire Union Agreements?

A contract between an employer and a union that establishes employment conditions before any workers are hired.

Pre-hire agreement commonly used in the construction industry is the only industry that can negotiate a pre-hire agreement.

9A Agreements 9A agreement is where a union must demonstrate that a majority of employees in a bargaining unit support the union. The owner/employer cannot negotiate with union the workers must organize themselves.

Question in the room: Is there a distinction between linemen and electricians in a PLA?

Answer from Jared Ross: “I will say I have heard that, there are no lineman work in any PLA unless the owner and union agree to it. There is a distinction between lineman and electricians. Power linemen are not party of the building trades.”

--from Erik Nowak in chat: I have a project right now with a PLA and lineman. The lineman are not included.

Question in the room: Is the owner CLP?

Answer: CLP is the project holder. The union will be interacting directly with CLP and not the subcontractors.

Follow-up from William Gevedon: “Enforcement of the PLA under the contract will be enforced through the Contracting Officer.”

13:11 Q&A

Room Question: Will the NEC be overseeing Installation?

*unable to hear answer

Room Question: Is there a preference where the Microgrid Control System is located?

*Unable to hear answer

Room Question: Will this project have typical requirements for QC and SSHO?

Answer: These two elements are in place and will not change.

Room Question: Does CLP usually do work with USACE or through DLA?

USACE Answer: Funding not through DLA *I did not catch all of the answer….

Room Question: Where is this on JBLM?

Answer: Aerial picture reshown. *did not catch the answer….

Room Question: Due to proximity to historic downtown, are there requirements for appearance based on historic district proximity?

USACE Answer: We plan to make the net line(?) more opaque so that it not as easy for those in the downtown area to see; to obscure the site from view by adding a sightline of trees.

Room Question: *missed the question… Answer: They are project specific PLAs.

Room Question: Microgrid controller. Is the microgrid controller going to be handled internally by CLP?

CLP Answer: Procurement for microgrid controller will be CLP’s responsibility.

Room Question: With CLP providing the relay settings, would the contractor be loading those settings in or would CLP/s relay techs be doing the work?

CLP Answer: CLP will load the relay settings to the controller. *missed the rest of the answer

Room Question: Generators and Switchgears, it's all outside so would enclosures be provided by the manufacturer? Will they be containerized?

CLP Answer: Containerized with skin(?) enclosure. The HVAC units are shipped separate and will have to be attached to the switchgear and generator structures.

Room Question: Are there any local FAS's or regulations that apply to this project?

USACE Answer: Will need follow-up

Chat Question: Will the Continuing Resolution (CR) have any impact of the procurement?

USACE Answer: This was a FY24 MILCON project and funding is locked in, from that perspective there should not be any additional impact from a CR on those funds.

Chat Question: Will you be emailing out a copy of the slide the Q&A after this meeting?

USACE Answer: Yes, we will be sending out a copy of the slides and Q&A.

Chat Question: Has the Power Study already been completed with relay settings or will that be part of the contract?

CLP Answer: As the system owner and as part of this project, CLP did run power system analysis that is interfacing with the substations, and generator capabilities. Currently, no final vendor selections have been made, and as of right now, the specific generator make and models have not been definitized. The generator capabilities study will need to be fully vetted and finalized first. Feasibility study has been done as part of preliminary study. CLP will be doing the procurement of generators and CLP will formulate the relay settings and select the subcontractors.

Chat Question: Regarding the solicitation, will the solicitation be inclusive of the entire scope of work to build the microgrid. Follow-up Question: Will CLP be solicitating subcontractors during procurement or wait a while to get subcontractors?

USACE Answer: The solicitation will cover the entire scope of work of the Microgrid project; however CLP will have a sub-contractor or two. CLP will own the entirety of the project.

Follow-up from CLP: We do plan to sub-contract a majority of the work. CLP will handle the switching and outages to ensure laborers a safe work environment.

Question: Any additional information on gas supply for the generators? What is available for it?

CLP Answer:*missed the answer

Question: Will CLP be solicitating subcontractors during procurement or wait a while to get subcontractors?

Answer: *missed this answer

Room Question: Sole sourcing consideration of any component and by purchasing via Sourcewell?

CLP Answer : Any and all equipment will be competitively bid.

Room Question: Is CLP currently soliciting?

CLP Answer: We are not currently soliciting until CLP receives the RFP. We will begin our solicitation once we have the RFP. Today is for building relations and gleaning interest for industry who would like to work with CLP on this project.

Chat Question: How is the procurement of the Generators, Switching Gear, Transformers, Etc going to be handled?

Answer CLP: CLP would issue the RFQs and RFPs for equipment and sub-contractors, then issuing purchase orders after soliciting the bids. No specific vendor shortlist, if there are interested parties in supplying equipment, reach out to CLP.

Room Question: *missed the beginning question on labor and touching tools… Follow-up: Touching tools was mentioned? Touching tools that will not be permanent on site? Is that accepted?

Jared Ross Answer: Union membership is only required for laborers that will be “touching tools”; Superintendent can be onsite, but they can touch the tools.

Chat Question: TAS countries? *Unintelligible from speaker USACE Answer: *Missed the answer

Chat Question: Are there DoD requirements for BESS battery OEMs?

USACE Answer: Buy American Act; it will be the trade agreement clause to open parameters for acceptable sources of supply and it will apply. Subcontractors will need to research their sources of supplies. Furthermore, there is a requirement that limits or emphasizes photovoltaic equipment outside of the Buy American act.

Room Question: Who will have admin oversight of this contract?

USACE Answer: Stated that Seattle District will be supporting day-in day-out geographic location work for this project. It is a partnership between Louisville and Seattle. COR will be in Louisville's office.

Room Question: *Could not hear question, but was about SB participation USACE Answer: JBLM is a standalone project. Based on the nature of it being sole source, a subcontracting plan will be required. LRL does not set the socio-economic goals. CLP must meet and show the government acceptable levels of support and uses of socio-economic concerns on this contract, in order for Small Business to participate in government contracts at the maximum extent practicable.

Room Question: Regarding contracted union work…type of workers. *Couldn’t hear the question… Jared Ross Answer: If an open shop bids on the project they have the legal right to sign their members up and it is their right to assign apprentices. We make sure apprentices have an opportunity to gain on the job experience on projects.

Chat Question: For the potential subcontractors attending virtually, how do we get the attendee list?

USACE Answer: Please in the chat input your business contact information and it will be disseminated out with today’s Industry day slides.
