About this file
This document is a Simplified Acquisition Procedures (SAP) Determination Memorandum for a sole source acquisition over the micro-purchase threshold but not exceeding the simplified acquisition threshold of $250,000. The memorandum provides justification for limiting competition to a single source for the purchase of various band instruments for the 42nd Infantry Division of the New York Army National Guard.
The key details are: 1) The customer is requesting a Yamaha baritone saxophone, as well as several Engelbert Schmid, Patterson, Paxman, and Shire Stephens Series 1 French horns. 2) The unique characteristics of these specific instruments, such as detachable screw bells, three water keys, and hand-hammered bells, are required to meet the customer's needs per Army Regulations AR 220-90. 3) Market research was conducted, but other brands do not meet the necessary specifications. 4) The acquisition is a brand name requirement, and award will be based on the lowest offer from a small business registered in SAM.gov. 5) Funds are not presently available, and no contract will be awarded until appropriated funds are made available. Quotes must be valid through September 30, 2024.
