Upon the basis of the following justification, I, as the contracting officer, hereby approve this brand-name justification for the proposed contractual action pursuant to FAR 16.505(a)(4), as the particular brand-name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

2. NATURE/DESCRIPTION OF ACTION(S): This action is to procure and replace the Telestream Vantage system’s K20 LightSpeed server hardware including all the required software and support maintenance. DMA acquired the Telestream Vantage System under the procurement contract HQ0028-12-D-0011-0046, award date on 29-September, 2014. The LightSpeed servers acquired on 2014 had been scheduled end-of-life (EoL) and end-of-support (EoS) by Telestream, the original equipment manufacturer (OEM).

3. DESCRIPTION OF SUPPLIES/SERVICES: The LightSpeed servers are specialized designed and licensed for Vantage System high performance computing server hardware. The specialized hardware and Telestream software licenses are for Vantage application software performing media analyzing, encoding and decoding in a wide variety industry supported audio and video formats. The LightSpeed servers are the key components for the Vantage system performing media transcoding, media content analyzing, media processing and work flow automation. The Vantage systems have been deployed and implemented at four DMA regional locations – DMA HQ Fort Meade at Maryland, DMA Broadcast Center at Riverside California, DMA AFN Sembach at Germany, and DMA AFN Yokota at Japan. The four regional Vantage systems have been fully integrated with Vantage automated workflow process for DMA media products’ transcoding and transporting media via DMA Enterprise global network. The Vantage system has been providing regional and cross regional media processing to support DMA missions. To maintain the Vantage systems’ operations, DMA needs to acquire the replacement server hardware along with required operating system software and maintenance support. DMA will utilize internal resources to replace and configure the LightSpeed servers; therefore, this procurement action does not require to acquire external professional services for the server replacement. The estimated total cost for Lightspeed servers’ hardware and software including a base year and 3 option years support maintenance is XXXXX. The term for the base year period of performance is from 28 May 2020 to 27 May 2021. The 1st option year coverage is from 28 May 2021 to 27 May 2022, 2nd option year is from 28 May 2022 to 27 May 2022 to 28 May 2023, and 3rd option year is from 28 May 2023 to 27 May 2024.

4. SUPPORTING RATIONALE FOR BRAND-NAME JUSTIFICATION: A brand name item is essential to the Government’s requirement. Market research indicates other computer server manufacturers’ similar products are not compatible with Vantage software and Vantage software license. The Telestream LightSpeed servers are the only products licensed in supporting Vantage video processing acceleration in Vantage Transcode products, Vantage Post Producer, and H.264 transcoding with graphics processing unit (GPU) and multicore central processing unit (CPU). If the Telestream LightSpeed servers are not able to acquire, the Vantage system will be operating at high risk of exceeding the server hardware’s life expectancy and without replacement parts to repair or maintain the established operations. If non Telestream LightSpeed servers are acquired, the incompatibility between Vantage software and other manufacturers’ products would impact the overall Vantage system’s operation in reliability, stability, and performance.

The minimum government requirements are to acquire the replacement servers which are fully compatible with current and future versions of Vantage software, supporting Vantage software licenses in Vantage Transcode products, Vantage Post Producer, and H.264 transcoding with GPU and multicore CPU.

5. COST/PRICE FAIR AND REASONABLE DETERMINATION: NASA SEWP has already negotiated contracts to help ensure that prices of supplies, fixed price services, and rates for services offered at hourly rates are fair and reasonable; therefore, no additional fair and reasonable determination is required when using Part 16. Additionally contracting may negotiate to ensure best pricing has been determined.

6. MARKET RESEARCH: Informal pricing information was received from multiple Telestream resellers. Many of the Telestream resellers are in SBA database and NASA SEWP provider queries. From the research only one vendor with GSA schedule.

Market research on Telestream products and resellers occurred between 1 September 2019 and 31 October 2019.

DMA has invested and built media transcoding and transporting workflow automation on Vantage system’s software and hardware over time based on DMA’s business requirements. Since the maturity of cloud based software as a service (SaaS) and DoD cloud computing initiative, DMA has been exploiting cloud technologies and services as an alternative in transforming the on premise Vantage system to cloud computing system.

DMA will continue to evaluate the existing and any new DMA media transcoding and transporting requirements to ensure DMA’s mission can be met for open market competition. The Government will continue to monitor the market to determine if there are changes that would enable future competitive actions.

9. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): No approved acquisition plan has been accomplished. The requirement of DFARS 207.102 regarding requirements for a written commercial item determination has been met. This procurement is exempt from a formal written acquisition plan as it does not exceed the DFARS 207.103 written acquisition plan threshold
