DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND

ATLANTIC

6506 HAMPTON BLVD

NORFOLK, VA 23508-1278

IN REPLY REFER TO:

J&A No. NA 20-21

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity:

The agency is the Department of the Navy. The contracting activity is the Naval Facilities Engineering Command (NAVFAC) Atlantic, Norfolk, Virginia.

2. Description of Action Being Approved:

Task Order N6247020F4014 was issued to provide Utilities Inventory Condition Assessment Program (UICAP) services at the Naval Research Laboratory. This sole-source justification requests approval to award a modification to task order N6247020F4014 in the amount of $75,744, under contract N62470-15-D-4002, to CDM Federal Programs Corporation (CDM Smith), 10560 Arrowhead Drive, Suite 500, Fairfax, Virginia, without full and open competition to complete the asset inventory Phase of the Statement of Work and to extend the contract completion date, which will enable the AE to complete the remaining deliverables.

3. Description of Required Supplies/Services:

The intent of this scope is to produce a preventive maintenance program for thermal, gas, electric, water, wastewater, and compressed air utilities at NRL. In order to achieve this goal, UICAP phases I through IV are to be performed in four (4) Phases: Phase I – Inventory & Condition, Phase II – Risk Assessment, Phase III – Real Property Inventory Reconciliation, and Phase IV – Standard PM Program Development and Implementation.

Critically, per the task order statement of work, these phases are to be completed sequentially and the AE was unable to complete Phase I within the bounds of the task order as originally proposed. During the proposal phase, the Navy estimated that assets would be found at NRL based upon existing Maximo data, and the AE priced their proposal accordingly; however, during performance the AE identified that there were several more utility assets than listed within the original task order and notified the Government that the total count of assets was approximately assets, and that they were thus unable to complete a full inventory of all utility assets in order to provide a complete UICAP.

4. Statutory Authority Permitting Other Than full and Open Competition:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2), as implemented by Federal Acquisition Regulations (FAR) 6.302-2- Unusual and Compelling Urgency.

5. Rationale Justifying Use of Cited Statutory Authority:

Contract N62470-15-D-4002 was awarded to provide Utilities Engineering and Management Support AE services to NAVFAC Worldwide throughout the base period and 4 option years, the last option year of which expired on 03 February 2020. Task Order N6247020F4014, which supports the U-ICAP program’s efforts at the National Research Laboratory (NRL), was executed on 31 January 2020, and the task order’s period of performance initially spanned from 31 January 2020 to and including 31 August 2020. A brief timeline of events follows:

The project manager (PM) submitted an electronic contracts request (ECR) for this modification on 22 June 2020 that included a request for an extension to the period of performance to allow for the collection of additional utility assets.

The contract specialist (CS) issued a request for proposals (RFP) on 23 June 2020, and the contractor submitted a proposal on 2 July 2020.

The Government and CDM conducted two sessions of negotiations, one on 22 July 2020 and the other on 11 August 2020, during which call the parties reached an agreement in principle on terms for this modification to add assets for collection.

The CS began work on the action after receiving a final revised proposal from CDM, and a Post- Negotiation Memorandum was signed on 18 August.
