Single Source Justification (Simplified Acquisition)
Section A: General Contract Information
Contracting Activity: 502nd CONS JBSA Lackland AFB, TX
Project/Program Name: CIMR Air Purifiers
Section B: Description of the Supplies/Services Required
This requirement is for the purchase of 180 Continuous Infectious Microbial Reduction (CIMR) air purifiers for the 737 Training Group (TRG) for the Basic Military Training (BMT) at JBSA-Lackland, TX. The 737 TRG seeks to acquire portable counter COVID-19 air systems (Air Purifiers) for BMT that will help protect people against aerosolized or vaporized pathogens. The CIMR air purifiers will be placed throughout the 737 TRG RH&T and ATC buildings which house trainees during basic military training.
Section C: Justification for Soliciting from a Single Source
CIMR air purifiers are brand name type air purifiers. The following justifies the use for CIMR type air purifiers:
The 180 air purifier devices for this requirement must meet the following characteristics to be acceptable: (1) is certified by the United States Department of Labor, Occupational Safety and Health Administration as safe to use and does not emit ozone, (2) must utilize pathogen-scavenging technology that provides a continuous level of protection using ionized compounds added to the ambient air that are re-purposed to actively target and counteract aerosolized or vaporized pathogens (i.e. COVID-19, etc.) in an enclosed space up to 2,000 square feet, (3) can be moved by a single person, (4) can be plugged into a standard United States household electric outlet, (5) can operate in a classroom or office setting without disrupting it, (6) can be turned on and left on for hours without further human interaction, and (7) can be maintained in a manner similar to any other standard office equipment. Please note: these are the name characteristics that required for the Maxwell CIMR air purifier IDIQ contract, FA3300-20-D-0005. During a phone call with the Contracting Officer (CO) for the IDIQ contract FA3300-20-D-0005, it was determined that this IDIQ could not be used as it was capped out.
Per the market research document, dated 13 August 2021, that was conducted for the Maxwell AFB CIMR air purifier IDIQ contract, FA3300-20-D-0005, the determination that products using "pathogen-scavenging technology" that "provides a continuous level of protection using ionized compounds re-purposed to target aerosolized or vaporized pathogens" was made during this process. The CIMR system currently in use on Maxwell AFB (purchased under previous contracts FA3300-20-P-0033 and FA300-20-P-0029) and the Aerus Medical Guardian were the only products identified by the customer during the market research phase. Section D: Efforts to Obtain Competition
Per the market research document, dated 13 August 2021, for the Maxwell AFB CIMR Air Purifier IDIQ contract, FA3300-20-D-0005, competition for CIMR Air Purifiers is available.
During the market research phase of IDIQ contract FA3300-20-D-0005, a Sources Sought was posted to beta.SAM.gov on 20 July 20 with a closeout date of 24 July 20. Air Dynamics Industrial Corporation (Small Business Manufacturer, 3EXT1) and Hi Tech Air and Water Purification Systems, LLC (Small Women Owned Business, CAGE 44J78) responded and stated they could meet this requirement. Internet searches revealed another contractor - Company Clean Incorporated (Small Business, CAGE 7LX72), that could potentially meet the requirement. Company Clean provides the Aerus Medical Guardian product identified in AU's preliminary research. Successful completion of historical contracts (FA3300-20-P-0033 and FA3300-20-P-0029) and customer technical verification indicated that High Tech Air and Water Purification Systems could meet the requirement. They were additionally emailed on 29 July and confirmed that they could indeed meet the Government's need. On July 29, additional supporting documentation was requested of Air Dynamics Industrial Corporation and the supporting documentation was sent to the customer for review. After reviewing Air Dynamics Industrial Corporation's product sheets, and correspondence with the customer, it was determined that the company was capable of meeting this requirement. Product information for Company Clean Incorporated was sent to customer on 30 July to confirm whether or not they could meet this requirement. Customer confirmed via email that they could indeed meet the requirement.
All three potential vendors are small businesses and were contacted to determine whether they manufactured their own products or would be submitting the products manufactured by a small business for consideration. Air Dynamics Industrial Systems Corporation confirmed that they are a small business that manufactures its own product. Hi Tech Air & Water Purification Systems, LLC confirmed that
Single Source Justification (Simplified Acquisition) they are a small business selling the products of a small business manufacturer. Company Clean did not respond. Having confirmed that two companies providing the product of a small business manufacturer are available, a small business set-aside is recommended.
Based on the results of market research, there was adequate vendors available via the open market to meet this requirement. It is expected that two or more responsible small businesses will submit priced offers in response to the solicitation. That requirement was recommended 100% small business set-aside via beta.SAM.gov.
An updated SBA Dynamic Search was conducted on 7 January 2021 for NAICS code 333413. Below are results of the SBA Dynamic search:

Based on the market research conducted for the Maxwell AFB IDIQ contract FA3300-20-D-0005 and the Dynamic Search, dated 7 January 2021, the same recommendation is made for this requirement. Please see the market research report for this requirement.
Section E: Steps to Preclude Future Single Source Awards
As stated in Section D (Efforts to Obtain Competition) of this document, competition in available for this requirement. The 502nd Contracting Squadron will do its diligence to conduct market research for all future air purifier requirements.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
