KINSHIP FOSTER CARE AMENDATORY ENDORSEMENT

This endorsement modifies insurance provided under the following:

COMMERCIAL GENERAL LIABILITY COVERAGE FORM

SEXUAL OR PHYSICAL ABUSE OR MOLESTATION COVERAGE FORM

BUSINESS AUTO COVERAGE FORM

SOCIAL SERVICE AGENCY PROFESSIONAL LIABILITY COVERAGE FORM

A. This Endorsement applies to any claim against any insured or additional insured, under any of the above-referenced policies or coverage forms, if that claim arises from alleged negligence or other fault in waiving the requirement of a fingerprint clearance card for a kinship foster care parent pursuant to A.R.S. § 8-509.

B. EXCLUSION FOR CLAIMS ARISING FROM WAIVER OF FINGERPRINT CLEARANCE CARD

1. None of the above-referenced policies or coverage forms shall provide coverage for the State of

Arizona or its departments, agencies, boards, commissions, universities, officers, officials, agents or employees (collectively, “the State”) for any claim that arises from alleged negligence or other fault in waiving the requirement of a fingerprint clearance card for a kinship foster care parent pursuant to A.R.S. § 8-509. We will have no duty to defend or indemnify the State against any such claim. The only exceptions to these exclusion is set forth in subparagraph D, below.

2. In the context of any claim arising from alleged negligence or other fault in waiving the requirement of a fingerprint clearance card for a kinship foster care parent pursuant to A.R.S. § 8-509 that is made against any insured or additional insured other than “the State”, the above-referenced policies or coverage forms shall not provide coverage, since “the State” is obligated to defend and indemnify SSCIP members against such claims. To the extent “the State” fails to defend the insured, we will defend the insured against the claim pursuant to subparagraph D, below.

C. LIMITED EXCLUSION FOR CLAIMS ARISING FROM WAIVER OF FINGERPRINT CLEARANCE CARD

AND FROM NEGLIGENCE OF ANOTHER INSURED

This subparagraph applies to claims that arise, in part, from alleged negligence or other fault in waiving the requirement of a fingerprint clearance card for a kinship foster care parent pursuant to A.R.S. § 8-509 but also arise, in part, from the acts or omissions of the Named Insured or from injury or damage resulting from the Named Insured’s operations performed for “the State.”

1. In the context of any such claim, we will have no duty to defend “the State,” but we will owe a duty to indemnify the State for its vicarious liability for the Named Insured.

2. We will defend and indemnify any other insured(s) against such claims, subject to the terms and conditions of subparagraph D, below.

D. SUBLIMITED COVERAGE FOR KINSHIP FOSTER CARE CLAIMS -- DEFENSE WITHIN LIMITS

The “Limits of Insurance” section of each of the above-referenced policies is amended to include the following subparagraphs:

SSKINSHIP (08/23) Includes wording © ISO Properties, Inc., used with permission Page 2 of 2

In any claim or claims arising from alleged negligence or other fault in waiving the requirement of a fingerprint clearance card for a kinship foster care parent pursuant to A.R.S. § 8-509, the limit of coverage is $500,000.

This Limit of Insurance is the most we will pay for claims to which this endorsement applies, regardless of the number of:

a. Insureds;

b. Claims made or "suits" brought; or

c. Persons or organizations making claims or bringing "suits".

$500,000 also is the Aggregate Limit for claims to which this endorsement applies. This Aggregate Limit is the most we will pay for the sum of any covered medical expenses, covered damages, and “defense expenses.”

Any “defense expenses” we pay in any claim or “suit” we defend will reduce the Limit of Insurance that applies to claims to which this endorsement applies.

All other terms and conditions in the above-referenced policies or coverage forms remain the same.

An agreed settlement means a settlement and release of liability signed by us, the insured and the claimant or the claimant's legal representative.

4. Other Insurance

If other valid and collectible insurance is available to the insured for a loss we cover under this Coverage Part, our obligations are limited as follows:

a. Primary Insurance

This insurance is primary except when b. below applies. If this insurance is primary, our obligations are not affected unless any of the other insurance is also primary. Then, we will share with all that other insurance by the method described in c. below.

b. ExcessInsurance

This insurance is excess over:

(1) Any of the other insurance, whether primary, excess, contingent or on any other basis:

When this insurance is excess, we will have no duty under this coverage to defend the insured against any "suit" if any other insurer also has a duty to defend the insured against that "suit". If no other insurer defends, we will undertake to do so, but we will be entitled to the insured's rights against all those other insurers.

When this insurance is excess over other insurance, we will pay only our share of the amount of the loss, if any, that exceeds the sum of:

(a) The total amount that all such other insurance would pay for the loss in the absence of this insurance; and

(b) The total of all deductible and self-insured amounts under all that other insurance.

We will share the remaining loss, if any, with any other insurance that is not described in this Excess Insurance provision and was not bought specifically to apply in excess of the Limits of Insurance shown in the Declarations of this Coverage Part.

c. Method ofSharing

If all of the other insurance permits contribution by equal shares, we will follow this method also. Under this approach each insurer contributes equal amounts until it has paid its applicable limit of insurance or none of the loss remains, whichever comes first.

If any of the other insurance does not permit contribution by equal shares, we will contribute by limits. Under this method, each insurer's share is based on the ratio of its applicable limit of insurance to the total applicable limits of insurance of all insurers.
