Items of Note for Contractors

1. Clarification of Solicitation Attachments

a. IBM13C0004 was completed July of 2014. Information is included as aid to

Contractors of what was previously performed onsite.

b. Attachments represent all soil and groundwater data available by Agency

2. Davis Bacon project

a. Applies to all subcontractors.

b. Certified payrolls required for all workers, including truck drivers (unless owner-operator).

c. Owner-operators have special reporting requirements.

3. SF-1413 forms are required for all subcontractors. This includes service providers but not suppliers.

4. Review requirements for Safety and Health Officer. Section 01.35.00 1.11.

5. CPR and first aid required for all employees onsite, including subcontractors. Section

01.35.00 1.17.

6. Quality Control Systems Manager must be an engineer and shall have no other duties on the project. Section 01.45.00 1.9.

7. Testing laboratories shall be unaffiliated with the Contractor and with any part of the design of this project. Section 01.45.00 1.11 B.

8. All engineering test results shall be signed and sealed by a professional engineer. Section

01.45.00 1.11 B.

9. Review premobilization submittals: Section 01.11.00 3.1.

10. All surveys shall be performed by or under the direction of a professional surveyor.

(Multiple specification references)

11. Benchmarks must be surveyed in prior to construction and reset properly after construction. Yellow pipe must also be carefully surveyed and reset.

12. Surveys are required during construction: prior to site disturbance, after excavation, after backfill of each type of material, and upon completion of the project.

13. American Dam Island is available as staging area. Existing items on Island must be protected during construction, especially during fencing work. A road through Island must remain open at all times.

14. Contractors cannot bring materials, trucks, personnel, etc. through the Compound.

15. Equipment and vehicles over pickup size cannot go over canal bridge.

16. EPWU will be relocating their sewer line over the next year. Work from Station 22+00 through EOP cannot begin until October 2017. Contractor is responsible for removing sewer line and appurtenances within USIBWC's chain link fenced area.

IBM16B0003 Page 2 of 2 American Canal Upper Reach

18. Excavate a minimum of 3 feet for soil remediation. Final surface must include at least 2 feet of new fill. Straight excavations against existing structures, etc.

19. Clean fill requirements. See Section 31.05.13.

20. Soil remediation fill is general fill, TxDOT flex base, and aggregate road surfacing

(Section 31.24.10). While these fills each have different requirements, Contractor is not required to use three different materials; one material may be able to meet all requirements.

22. Soil remediation extends from canal bridge to USIBWC fence near Paisano.

23. Existing pedestrian bridge shall be removed and reinstalled. A new pedestrian bridge shall also be installed.

24. Contractor expected to coordinate with Border Patrol agents daily. Keep them up to date on where excavations are and safe path through construction area.

Question Received Before Prebid Conference

Q1: Since dewatering will be necessary for construction, is the water contaminated to a point that can’t be dumped to the PSB line or river?

A1: USIBWC has provided information on groundwater testing as Solicitation Attachment J.11

(GW Data MW-1 data 2012-2014.xlsx) and Appendix D of Solicitation Attachment J.10 (Design

Report Am Canal Lining 20160712.pdf). Additionally, Contractors were directed to www.recastingthesmelter.com for information about remediation of ASARCO in Section

00.31.26. On this website are groundwater testing results performed as part of their remediation.

Their last tests of groundwater from American Dam Island are dated March 2015. USIBWC cannot say whether the water pumped during construction will be contaminated or not.

El Paso Water Utilities can be contacted about using their sewer line. Water that meets the Clean

Water Act may be discharged to the Rio Grande.

1. Clean Water Act requires NPDES which requires a stormwater permit.

2. TCEQ TPDES General Permit TXR150000 allows discharge of "uncontaminated ground water or spring water, including foundation or footing drains where flows are not contaminated with industrial materials such as solvents" (Part II Section A 3.(g)).

3. 30 TAC §307.6(c)(1) includes Table 1 which lists Criteria in Water for Specific Toxic

Materials. Water meeting Table 1's Freshwater Acute Criteria is an uncontaminated discharge per TCEQ.
