1.5 EXISTING CONDITIONS

A. USIBWC Contract IBM13C0004 removed, tested, and replaced contaminated soil at

American Dam Field Office, including along American Canal.

1. Under this Contract, soil was excavated down two (2) feet and then tested for arsenic, lead, and cadmium. If the levels of arsenic exceeded 24 mg/kg, if the levels of lead exceeded 500 mg/kg, or if the cadmium exceeded 52 mg/kg, then an additional foot of soil was excavated and the exposed soil was retested. If that test showed any exceedances, the soil was excavated another foot although no further testing was performed.

B. The record drawings, construction specifications, testing grids, and test results for

IBM13C0004 are available to the Contractor for the purposes of understanding the existing conditions of the project area.

1.4 MEASUREMENT AND PAYMENT

The work performed by the Contractor under this Section shall not be paid for directly, but shall be included in the various Bid Items under this Contract.

1.5 GENERAL

A. The Project’s environmental assessment, titled "Final Environmental Assessment for

Replacement of the Old American Canal Located in El Paso, Texas," dated December 6, 2001, was prepared for USIBWC by ENCON International, Inc.

B. The Finding of No Significant Impact (FONSI) was published in the Federal Register on

March 7, 2002. It can be downloaded at: http://www.gpo.gov/fdsys/pkg/FR-2002-03-

07/pdf/02-5395.pdf

C. A historical analysis of the American Canal is presented in "Controlling Water on the

Border: the American Canal System, International Boundary and Water Commission, El

Paso, Texas" by Neal W. Ackerly, dated November 1999. An addendum was provided to this report in August 2000 by Parsons Engineering Science, Inc. and was entitled

"Supplemental Report - Controlling Water on the Border: the American Canal System, International Boundary and Water Commission, El Paso, Texas."

D. These documents list environmentally and culturally sensitive areas that need to be protected from any disturbances of construction activities. The environmentally and culturally sensitive areas that were identified on the document are identified below.

1. Culturally Sensitive Areas

Properties adjacent to this construction area are recognized as historically significant.

2. Biological Resources

Work should be schedule to occur outside of the bird breeding season whenever possible. Migratory birds may be present within the project area; birds, nests, and eggs are to be protected and avoided during construction. The breeding and nesting season is identified in Section 01.57.13. If work continues into the bird breeding/nesting season the areas proposed for disturbance shall be surveyed in order to avoid the inadvertent destruction of nests and eggs.

3. Natural Resources

Equipment cannot be parked, staged, or used under large, mature trees. Keeping equipment away from the large, mature trees will prevent incidental damage to the tree and prevent compression of the root ball.

1.6 PRESERVATION OF CULTURAL AND NATURAL RESOURCES AND THE

ENVIRONMENT

A. If the Contractor initiates changes to the Contract and USIBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.

http://www.gpo.gov/fdsys/pkg/FR-2002-03-07/pdf/02-5395.pdf http://www.gpo.gov/fdsys/pkg/FR-2002-03-07/pdf/02-5395.pdf

September 6, 2016 Environmental Information

USIBWC Solicitation IBM16B0003 Page 00.31.24-3

B. Culturally Sensitive Areas

If a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way, cease all work immediately, secure the site from further disturbance and possible vandalism, and notify USIBWC. The site, building, or location will be investigated and evaluated by USIBWC.

1.7 OTHER CONSIDERATIONS

The Contractor is required to ensure that all Environmental Permits, Issues, and Comments

(EPIC), which are included within the Contract Documents are followed and implemented to ensure potential impacts are avoided.

1.8 USE OF GEOLOGIC MATERIALS ON A FEDERALLY FUNDED PROJECT

A. To ensure preservation of historical and archaeological data, when the Contractor, the

Construction Contractor, or any subcontractor proposes to use a borrow pit/source/quarry for soil, rock, or gravel, the source must first be compliance confirmed by the COR to ensure compliance with Section 106 of NEPA (36 CFR 800).

B. Submit a map showing the location of proposed sites to the COR at least forty five (45) days in advance of use.

C. Take no action to use or alter the proposed location until written approval for site use is received from the COR.

D. If the quarry or borrow site already provides materials for NMDOT, TxDOT, USACE, or other governmental agency, a copy of the environmental approvals from said agencies may be provided to the COR.

The work performed by the Contractor under this Section shall not be paid for directly, but shall be included in the various Bid Items under this Contract.

1.4 ASARCO INFORMATION

A. Portions of the American Canal are immediately adjacent to the ASARCO (American

Smelting and Refining Company) and USIBWC’s property has been contaminated by metals such as arsenic, cadmium, lead, and selenium, which have migrated from the

Smelter. The dangers of lead and arsenic contamination in soils and groundwater are well-known, and the contamination in the El Paso area is well documented.

B. ASARCO executed a State Enforcement Order with the Texas Commission on

Environmental Quality (TCEQ) in 1996 relating to the ASARCO Smelter, but has still not implemented corrective actions to eliminate the offsite migration of metals from the

ASARCO property. Continued contamination from the ASARCO property has required

USIBWC to address the dangers of lead and arsenic in carrying out its responsibilities at the American Dam and adjacent areas.

C. Personnel working in the area shall be advised to utilize personal protective equipment and implement dust suppression techniques, such as soil wetting. It is prudent that the

Existing Hazardous Material Information September 6, 2016
