Payment Procedures May 28, 2013
Page 01.20.00-2 USIBWC Contract IBM13C0004 the Government until USIBWC-FSD acknowledges and date stamps the progress payment.
(1) A hard copy of the pay estimate, with original signatures, shall be provided to the
COR. This is usually done at the next progress meeting.
(2) The electronic pay estimate sent to USIBWC-FSD shall be in pdf format.
B. The Government Inspector and the Contractor's Superintendent or CQCSM shall meet prior to the Contractor's submittal of their pay estimate and discuss billable quantities. It is expected that the Inspector and the Contractor will reach concurrence on the billable quantities. Once quantities are agreed upon, both individuals shall sign the Draft 119B containing the established quantities. Both parties shall keep copies of the signed document for their records.
1.3 USIBWC PAY ESTIMATE PROCEDURES
The Pay Estimate procedures shall be discussed in detail with the Contractor at the
Preconstruction Conference. The Contractor shall submit complete pay estimate packets including all required supporting documents in order to receive timely payments. A complete pay estimate includes all of the items detailed in this Specification. All IBWC forms will be provided to the Contractor at the Preconstruction Conference.
A. Cover Letter
The cover letter shall include the Contract number, Contract name, pay estimate number, pay estimate period and total earnings to date. The cover letter shall also include the full amount requested along with any pertinent information related to this pay estimate. The cover letter shall include a list of retention held by the Contractor from each subcontractor and supplier. The list shall include pay estimate number, retention for this period, releases for this period and total retention.
B. IBWC Form 119-Payment Estimate-Contract Performance
IBWC Form 119 is the Contractor's invoice to the Government. All other forms provided are backup data. The Contractor shall verify that the header data is correct and then sign this form to certify that this is a valid payment against the Contract.
C. IBWC Form 119B-Pay Estimate Quantities
All items detailed on the Schedule of Values shall be listed on Form 119B. This form is what is used by the Government to pay the Contractor. This report needs to be accurate and up-to-date.
(1) Whenever possible, the Contractor shall bill in whole number increments.
(2) Place the words "stored materials" in the Schedule of Values item description for which stored materials have been billed. Additionally verify that when stored materials have been completely incorporated into the project, that the words "stored materials" are deleted.
USIBWC Contract IBM13C0004 Page 01.20.00-3
(3) Contractors often want to charge a unit of "1" with a unit price matching the invoice for stored materials. This is incorrect. A line item's unit price cannot change; this is a
Contractual value. The unit must be adjusted so that "unit" times "unit price" =
"invoiced amount." Many times this results in strange units with several decimal places.
D. IBWC Form 152-Pay Item Breakdown
All Contract line items shall be listed on Form 152. All columns shall be filled out to represent the current project status.
(1) Place the words "stored materials" in the Schedule of Values item description for which stored materials have been billed. Additionally, verify that when stored materials have been completely incorporated into the project, that the words "stored materials" are deleted.
(2) Ensure that the scheduled progress, actual progress and days ahead/behind on the bottom of Form 152 are completed.
E. IBWC Form 154-Subcontractors' Payment Breakdown
The Contractor must fill out this form in its entirety. The Contractor shall ensure that SF-
1413s have been provided to the COR for all subcontractors listed on this form.
F. IBWC Form 239-Schedule of Materials
This form is only required in a pay estimate if the Contractor is requesting or has requested payment for stored materials. It is a general policy of USIBWC to allow payment for stored materials which will be incorporated into the final work provided that the materials are properly stored at the jobsite, have been addressed by a submittal evidencing compliance with the Contract and are supported by invoices indicating the project (by name or Contract number), material description, quantity and cost of each type of material.
(1) All materials to be authorized for payment, both onsite and off, must be inventoried and be accounted for continuously until incorporated into the work.
(2) The Contractor must submit copies of invoices and other evidence of payment with the initial request for payment of stored materials.
(3) The Schedule of Values items being billed for stored materials on Forms 119B and
152 must have the words "stored materials" placed in the Schedule of Values item description.
G. IBWC Form 245-Summary of Dollars
The Contractor shall complete this form in its entirety. This form is used as a check against the other forms. The Contractor shall verify that the dollar amounts match Form
119 and Form 239.
Page 01.20.00-4 USIBWC Contract IBM13C0004
H. IBWC Form 148-Log of Photographic Documentation
All photos provided by the Contractor shall be accurately listed. The photographs, files and Form 148 are not considered to be a submittal.
I. IBWC Form 153-Monthly Exposure and First Aid Report
A separate Form 153 shall be submitted for every Contractor and subcontractor on the jobsite. This is required for all Contract periods when workers are onsite.
J. IBWC Form 161-Actual Weather and Working Conditions Report
Weather days documentation is to be performed each month as part of the pay estimate processing. The Contractor and the Government Inspector should agree on the number of adverse weather days each month. Upon acknowledgment of the Notice to Proceed and continuing throughout the Contract on a monthly basis, the Contractor shall record actual adverse weather days on a calendar day basis (including weekends and holidays).
(1) The Contractual basis for granting time extensions due to inclement weather is in
Contract Clause 52.249-10, entitled Default (Fixed-Price Construction).
Administration of the Default Clause is prescribed in Time Extensions for Unusually
Severe Weather --IBWC (May 2013). This special condition provides a listing of monthly anticipated adverse weather calendar days for the geographical location of the project. For each month, the number of adverse weather calendar days are to be noted on the documentation form until the number of anticipated calendar weather days is expended. After the anticipated calendar days are expended, then adverse weather working days are recorded as lost days due to weather. At the end of the monthly documentation, this total number of working days lost (due to adverse weather) is converted on the record form into calendar days for granting a time extension. The conversion factor is determined as a ratio of the number of days in a week (7) to the number of workdays in a week. For example, if a Contractor works a normal 5-day workweek, the conversion factor is 7/5; if a Contractor works a 6-day workweek, the conversion factor is 7/6.
(2) The "Ant. Delay" line of IBWC Form 161 shall be filled in with the Monthly
Anticipated Adverse Weather Calendar Days as listed in Contract Clause entitled
Time Extensions for Unusually Severe Weather in the Contract.
(3) In recording whether a day is lost due to adverse weather, it is important to realize that a whole day is lost if work is prevented for 50% or more of the day and the work is critical to timely completion of the project.
(4) If documentation justifies a time extension due to adverse weather, the COR will forward the documentation record to the COR. The Contractor cannot assume that just because IBWC Form 161 is completed that these days are automatically added to the Contract. A Contract modification must occur before the time is officially added to the Contract.
USIBWC Contract IBM13C0004 Page 01.20.00-5
K. IBWC Form 156A-RFI Log
A complete and up-to-date RFI Log shall be submitted with the Contractor's pay estimate. Specification 01.31.00 details the requirements of the RFI Log. This RFI Log is not considered to be a submittal.
L. IBWC Form 147-Submittal Register
A complete and up-to-date Submittal Register shall be submitted with the Contractor's pay estimate. Specification 01.33.00 details the requirements of the Submittal Register.
This Submittal Register is not considered to be a submittal.
M. Progress Schedule
An updated progress schedule shall be submitted with the Contractor's pay estimate.
Specification 01.32.00 details the requirements of the Progress Schedule. This schedule is not considered to be a submittal.
N. Other Documents
The Contractor shall ensure that all Daily Contractor Quality Control Reports (IBWC
Form 163), Preparatory Inspection Checklists (IBWC Form 162), Initial Inspection
Checklists (IBWC Form 166), Weekly Toolbox Safety Meetings (IBWC Form 164), Concrete Test Results Summaries (IBWC Form 158), Concrete Placement Cards (IBWC
Form 158B) and other safety, environmental and quality control test reports have been provided to the COR for the time period covered by the pay estimate. Failure of the
Contractor to submit required quality control, safety and environmental data to the
Government can result in non payment or retainage by the Government of up to ten percent (10%) of the pay estimate.
1.4 FINAL PAYMENT
The Government shall pay the final amount due to the Contractor under this Contract after the completion and acceptance by the Government of all work, after the Contractor submits a final pay estimate, and after the Contractor submits a release of all claims against the Government
(reference FAR 52-232-5(h)).
1.5 CERTIFIED PAYROLLS
While certified payrolls are not specifically part of the Contractor's pay estimate package, the
Contractor's pay estimate can be denied or held up due to failure to submit certified payroll.
A. The Contractor shall submit weekly, for each week in which any Contract work is performed, a copy of all payrolls. The payrolls submitted shall set out accurately and completely all of the information required to be maintained under 29 CFR 5.5(a)(3)(i), except that full social security numbers and home addresses shall not be included on weekly transmittals. Instead, the payrolls shall only need to include an individually identifying number for each employee (e.g., the last four digits of the employee’s social security number).
Page 01.20.00-6 USIBWC Contract IBM13C0004
B. During weeks in which no Contract work is performed by the Contractor or any subcontractors, a Nonperformance Payroll Report (IBWC Form 151B) shall be submitted.
C. The required weekly payroll information may be submitted in any form desired. The prime Contractor is responsible for the submission of copies of payrolls by all subcontractors. Optional Form WH-347 is a Wage and Hour form available to
Contractors on…
