About this file

This document is a Justification and Approval (J&A) for a sole source procurement of Missile Tube Umbilical Penetrator Inserts from Teledyne Technologies Company. The Naval Undersea Warfare Center Division Newport (NUWCDIVNPT) intends to award a Firm Fixed Price (FFP) purchase order to Teledyne Technologies on a sole source basis for this requirement, which is estimated to satisfy the need for at least the next two years.

The J&A cites the need to avoid a significant delay in delivering parts to the Fleet, as it would take over 2 years to qualify a new vendor. The Government determined the anticipated cost to be fair and reasonable based on historical pricing from past procurements with Teledyne. While the Government is considering exploring alternate vendors in the future, the current requirement is sufficient to bridge the gap in the near term. The procurement is unrestricted, with a NAICS code of 332721 and a small business size standard of 500 employees.

Event Schedule Delay

Mold Fabrication and

Test

2 months

New material test and evaluation

4 months

Total 6 months

The Government estimates this requirement satisfies the need for at least the next two years.

Based on the above, the additional cost and schedule delays associated with approving a new vendor missile tube penetrator insert for these parts cannot reasonably be anticipated to be offset by potential savings from competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The Naval Undersea Warfare Center Division Newport (NUWCDIVNPT) has historically posted the intent to award a Firm Fixed Price purchase order on a sole source basis to Teledyne Technologies

Company on SAM.GOV (formerly Federal Business Opportunities). NUWCDIVNPT will do so again, and invite all responsible sources to submit a capability statement for the consideration of the

Government to determine whether to conduct a competitive procurement. To the knowledge of the technical code and Contracting Office, no other sources have expressed interest previously.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

Once this determination is made, paragraph 7 need only contain the above statement. No additional information is required.

Significant quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements and will be sought again. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Future Competition.

The Government is currently contemplating two different acquisition strategies going forward either of which might result in dissolving this sole source requirement. They are as follows:

Due to the risk of a sole source the program is discussing exploring industry for another vendor product to qualify. However, due to the current Fleet needs over the next 5 years and the qualification time line as discussed above it would take over 2 years to get new parts qualified and to the Fleet.

The present requirement is sufficient to bridge the gap if the program elects to go in this direction.
