SBU - CONTRACTING AND ACQUISITIONS

JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

FAR Part 6.3

1. Identification of the agency and the contracting activity:

The Department of State, Office of Acquisition Management, Security Branch is conducting this acquisition of other than full and open competition for 250 TB Hyper

Converge Storage Solution on behalf of the Bureau of Diplomatic Security

(DS/CTS/CMO/CO).

2. Nature and/or description of the action being approved.

A stand-alone purchase order will be awarded to FCN, Inc. of Rockville, MD. The total estimated cost is .

3. A description of the supplies or services required to meet the Department’s needs.

Two complete turnkey rack solutions that provide a scalable platform for server management and growth. This server solution shall provide the necessary computational and storage capabilities to replace the existing servers and storage. In addition, this server solution shall provide a simplified plug and play growth capability. This will allow the supporting team to add additional computational or storage capacity as needed. The solution shall virtualize all assets. The solution must support the encryption of all data-at-rest, eliminate single points of failure on networking, storage, and the database server and provide the ability to do in-place upgrades which will reduce downtime. As the

Application Support mission grows, the proposed server solution shall easily scale in terms of server performance and storage capacity with the addition of more storage or compute nodes (SOW attached).

4. An identification of the statutory authority permitting other than full and open competition. This acquisition is conducted under the authority of 41 U.S.C. 3304, as implemented by FAR 6.3 and substantiated by the following:

☒ FAR 6.302-2 – Unusual and compelling urgency.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.

(SBU) In addition to a written technical proposal, the selected company for award, along with three other offerors recently provided a price proposal, and two others provided a live demonstration as part of a competitive open requirement under Solicitation

#19AQM19Q0159. However, due to procurement-related problems, of which there is currently no remedy, the Government was unable to reach an award status, and thus forced to cancel the solicitation. There is no time left this fiscal year to re-solicit proposals (which includes a live demonstration from every offeror), and make an award. The Government has determined that based on the urgent nature of the requirement described below, and the time constraints making a competitive action impossible, that it must go to award now on a sole source basis with the intention of re-competing the requirement when the need for the products/solution arises again.

(SBU) The solution meets several critical technical needs and a purchase order must be awarded on or before 9/30/19. First, the solution is replacing a legacy system that is at end of life and at risk of failing.

This award must be made to protect operations.

6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

This JOFOC will be made available through www.fbo.gov within 30 days of the contract award as required by FAR Part 5.

7. A determination by the ordering activity Contracting Officer that the anticipated cost to the Government is fair and reasonable.

The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on adequate price competition recently conducted. By signing the JOFOC, the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable.

8. A description of the market survey conducted (see Part 10) and the results or a statement of the reasons a market survey was not conducted.

A market survey was not conducted for this unusual and compelling urgent requirement, but a competition was recently held, which yielded technically acceptable solutions and competitive pricing. For reasons expressed above, the Government was not able to award under that competition.

9. Any other facts supporting the use of this justification.

N/A

10. A listing of any sources that expressed a written interest in the acquisition.

Four (4) proposals were received in response to the solicitation that is being canceled.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The Government anticipates competing this requirement when the products reach end of life.

File details come from the government source that posted it.
