SOLE SOURCE JUSTIFICATION INFORMATION SHEET
Because we are spending tax dollars, Federal procurement regulations strongly encourage full and open competition in the purchase of good and services. I encourage you to utilize a competitive process for your purchases utilizing “Best Value” analysis, which allows you to consider price and other technical factors. If you believe an item is the best available in the marketplace, it should be procured through a competitive not sole-source process. If you use a competitive procurement process, this form is not necessary.
If you still think that we can consider only a single source, we must utilize Federal
Acquisition Regulations (FAR), which allows sole source procurement in seven different circumstances. Please circle or otherwise indicate which authority you intend to use. For additional information see: http://www.arnet.gov/far/
(1) FAR 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements” i.e., demonstrates a unique and innovative concept or demonstrates a unique capability of the source to provide the particular research services proposed, offers a concept or services not otherwise available to the Government, unacceptable delays in fulfilling the agency’s requirements, unique supplies or services available from only one source or only one supplier with unique capabilities
(2) FAR 6.302-2 “Unusual and compelling urgency.”
(3) FAR 6.302-3 “Industrial mobilization; engineering; developmental, or research capability or expert services”
(4) FAR 6.302-4 “International Agreement”
(5) FAR 6.302-5 “Authorized or required by Statute”
(6) FAR 6.302-6 “National Security”
(7) FAR 6.302-7 “Public Interest”
FAR 6.301 (c) states that contracting without providing for full and open competition shall not be justified on the basis of (1) lack of advance planning by the requiring activity, or (2) concerns related to the amount of funds available (e.g. funds will expire) to the agency or activity for the acquisition of supplies or services. Please note that contracting without full and open competition or competition after exclusion of sources, is a violation of statute, unless permitted by one of the aforementioned exceptions.
1. Description of supplies, equipment or services to be provided.
This blanket purchase agreement will cover student, faculty, and staff lodging at a number of military bases. Medical students rotate for ~ 1 month rotations at military teaching hospitals during much of their 3rd and 4th year.
2. Estimated Value. (All actions over $25,000 must be advertised in the FEDBIZOPS unless the requirement can be satisfied through a GSA Federal Supply Schedule. This adds 15 to 30 days to the procurement time.)
Initial funding will be $280,000 although this will expand as new sites are added.
3. What are the circumstances that support the selected exception to the requirement for full and open competition?
IHG has an exclusive contract from the US Army to manage on base lodging that is being utilized through this contract. Using on base lodging with messing capabilities significantly reduces per diem expenses and costs to the government. The US Army determined which lodging operator to use through a competitive process.
4. If citing FAR 6.302-1, what unique capabilities does the proposed supplier possess which make it the only one capable of satisfying these minimum requirements?
a. What is the unique feature of this item/source?
Lodging location and the ability for military members to obtain their meals at the required government messing facility offers convenience and per diem cost savings. Proximity of lodging on base also facilitates on call access to students.
b. Why is this unique feature necessary?
This lodging location is on the military base that the medical students are required to work and utilize government messing (dining).
c. What other manufacturers' products or services did you consider?
None
