Problem Statement

• Removing Attachment 10 from USC8 has created confusion between contract language and the Customer Advisory for establishing reasonable RDDs. Customer feedback for USC-9 resulted in requests for improved transit times.

Industry Feedback

• More realistic RDDs

• Consensus that the RDD matrix needs to be refreshed

RDD Construction (Contd.)

Analysis

• 60 months of PAT ITV from 2013 – 2017

• Analyzed the spread between EDI transactions

• Aggregated the data by lanes for booking purposes

• Calculated means and standard deviations for 1) the spread between all EDI transactions and 2) each type of movement term (P2P, D2P, D2D, P2D)

Change

• Provide detailed RDD Matrix to customers, derived by TCJ4 analysis of 5 years of historical EDI data.

Update as needed to provide guidance to customers for suggested transit times by lane.

• Update IBS with the top 80% of lanes based on volume (~ 35 lanes)

• Only for D2P and D2D due to system limitations

Performance Measures and Composite Score

Problem Statement

• Data demonstrates increase in untimely and inaccurate EDI submissions

• Improve BVN at booking to better portray lane performance. Composite scores currently have equal consideration granted to lane and world scores.

Industry Feedback

• Difficulty in submitting timely EDIs in austere AORs

• Increase lane score weight

Change

• Increased EDI timeline from 24 hours to 48 hours

• Adjusted EDI submission/timeliness weighting from 80/20 to 50/50

• Increase Lane Score weight to 90% in BVN formula to drive increased performance on individual lanes

Performance Measures and Composite Score

Performance Score (Lane and World Score) = (RDD % * .75) + EDI Score % (.25)

EDI Score = (. 5 * Submission %) + (.5 * Timely %)

Composite Score (CS)= Lane Score * (.9) + World Score* (.1)

BVN = $ / CS

One-Time-Only Performance Factor

Problem Statement

• Currently there are no performance measures taken into account when awarding OTOs, however, OTO performance does count toward the overall BVN.

• Current process negatively impacts competition.

Industry Feedback

• Incorporate BVN into the OTO process.

Change

• BVN to be applied when awarding OTOs in accordance with Exhibit 4.

D-RAP

Problem Statement

• Per the D-RAP Business Rules, there are several items listed as not compensable/excusable delays

• Significant amount of RDD extensions for non-government caused delays approved by the

D-RAP Auto-Approval Process

Industry Feedback

• Standardization for processing D-RAPs across the OCCAs

• Industry open to RDD extensions via CPP

Change

• Government evaluation period will move from 4 days to 10 days (if no action by OO then auto approval) and no RDD extension

• If RDD is missed due to the fault of the Government, carriers can submit documentation in

CPP at the end of the month for review and exclusion.

Claims Timeline

Problem Statement

• FAR 33.206(a): Contractor claims shall be submitted, in writing, to the contracting officer for a decision within 6 years after accrual of a claim, unless the contracting parties agreed to a shorter time period.

• Current claims submission deadline (6 yrs) requires both the Carriers and Government to spend immense resources researching claims data (REA/TDR) in which the information has degraded or may not be available.

Industry Feedback

• Commercial standard is one year

• Agreeable to 3 year claims timeline

Change

• Claims limitation for both government and contractor claims shortened to 3 years

Period of Performance

Problem Statement

• Current contract structure (one-year base plus two one-year options) places immense administrative burden on the Government and Contractors by requiring all parties to undergo the acquisition process every 18 months, in addition to the yearly rate refresh process.

Industry Feedback

• Majority in favor of longer period of performance

• Industry expressed need for large scale issues or meaningful changes to be resolved on a more frequent basis
