PERFORMANCE WORK STATEMENT (PWS)

1.0 INTRODUCTION

1.1 Mission. Military Surface Deployment and Distribution Command’s (SDDC) mission is to provide surface transportation to meet Department of Defense’s (DoD) national security objectives in peacetime and wartime. As such, SDDC is responsible for the management and oversight of shipments requiring Transportation Protective Service (TPS). TPS includes full service transportation in the Continental United States (CONUS), Alaska and Canada for DoD truckload and less-than-truckload shipments of Arms, Ammunition, and Explosives (AA&E), AA&E Hazardous Material (HAZMAT), classified, sensitive and controlled cryptographic items.

1.2 Background. Historically, SDDC fulfilled its TPS requirements utilizing voluntary tenders of service offered by approved DoD Transportation Service Providers (TSP). Based on DoD guidance, SDDC is transitioning the acquisition of TPS, moving via motor transportation, from tenders of service to Federal Acquisition Regulation (FAR)-based contracts.

1.3 Scope. Transportation service to meet DoD and other Government agencies’ TPS needs.

TSPs on contract, hereafter referred to as contractors, shall provide all personnel, equipment, tools, materials, supervision and other items and services necessary to provide transportation services within and between the CONUS, Alaska, and Canada for the movement of AA&E, AA&E Hazardous Material (HAZMAT), Classified (Secret and Confidential), Sensitive and

Controlled Cryptographic Items and other material requiring movement with TPS. Contractors shall provide these services in accordance with the terms of the contract, to include this

Performance Work Statement (PWS), and all applicable federal, state, and local regulations.

Where the contract levies more stringent requirements, the contract requirements shall prevail.

1.4 Transportation Protective Service (TPS). Contractors shall ensure the transportation protective services ordered by Transportation Officers (TOs) / Ordering Officers (OOs) are provided for each shipment within the scope of the contract.

1.4.1 TPS includes the following services. These services are further described in Appendix D –

Protective Services and Accessorials:

2.0 GENERAL REQUIREMENTS

2.1 Brokering/Trip Leasing.

2.1.1 Brokers, freight forwarders, and logistics companies are not authorized to handle or accept any shipments moving with CIS, DDP, PSS, SNS, DCS, and/or 675. Handling and solicitation of DoD sensitive conventional AA&E, classified (SECRET and Confidential), sensitive and controlled cryptographic items, Class 1 Division 1.1 thru 1.6, sensitive munitions are also prohibited. Clearing documentation through customs may be permitted.

2.1.2 Brokerage (as defined in 49 Code of Federal Regulations (CFR), Part 371.2) of AA&E will not be permitted.

2.1.3 Trip leasing of any TPS shipments will not be permitted.

2.2 Transportation Facilities Guide (TFG).

2.2.1 Contractors shall review the TFG for installation policies regarding the minimum requirements for normal operating hours, installation closures, or any other important information. Contractors can access the TFG at the Electronic Transportation Acquisition (ETA) website https://eta.sddc.army.mil/.

2.2.2 Failure to review the TFG for installation policies and delivery requirements may result in non-payment of detention, demurrage and/or storage charges.

2.2.3 Failure to review the TFG for installation operating hours may result in late shipments.

2.2.4 Contractors should use TFG guidance in effect at the time of shipment pickup.

2.3 Transportation Protective Service Compatibilities.

2.3.1 Contractors providing protective services compatible with each other will be paid for both services. Contractors providing protective services incompatible with each other will be paid only for the most expensive service.

2.4 Assistance to Contractors by Government Personnel.

2.4.1 For the purpose of promoting safety, expediting transportation, and delivering shipments of explosives and other dangerous articles, the Military Services may extend any technical assistance and aid considered necessary in connection with moving, salvage, demolition, neutralization, or other disposition of such Government-owned shipments being transported or stored by contractors.

2.4.2 Upon contractor request for assistance, government employees may be provided in unusual or emergency circumstances for the benefit of the contractor. DoD personnel act and perform in these instances as government employees in an advisory capacity to directly benefit the contractor. DoD personnel assigned to assist the contractor will retain their status as employees of the United States Government and, as such, are entitled to all of the benefits afforded U.S.

government employees as provided by law. In no event shall DoD recognize or submit to any action for property damage in connection with such assistance furnished By DoD employees, when actual labor supervision or other services are performed upon contractor request. It is not the intention of this provision that DoD employees shall compete with private industry where services can be readily provided by the private sector.

2.4.3 When a contractor requests DoD personnel to provide assistance, the TO will prepare a self-addressed letter in the form of a request for DoD service that must be signed by an authorized contractor representative. The letter shall state the contractor acknowledges responsibility for performance of the services requested from DoD, and performance of the services by DoD personnel does not relieve the contractor of liability. When assistance is given under emergency conditions in which delay might contribute to further hardships or possible disaster, the letter can be prepared and signed after the service is performed.

2.4.4 Contractors will not be billed or held responsible for any service performed by DoD personnel that was not specifically requested by the contractor, such as dispatching of representatives to observe transfer of loadings or to suggest corrective measures in connection with seal breakage, shifting of loads or braces, accidents, or other adjustments. Collection of sums of money for services actually rendered will be in accordance with user charges identified in DoD Financial Management Regulations.

2.4.5 Secure Holding Areas are identified in the TFG. However, during an emergency, the contractor can coordinate with SDDC Defense Transportation Tracking System (SDDC DTTS) to locate a Secure Holding Area.

2.5 Non-Applicable Charges / Contractor Liability.

2.5.1 Contractors shall not charge any detention, demurrage or storage charges against any DoD sponsored shipment when the delay is caused by the contractor.

2.5.2 Freight will be delivered in the same condition as received at origin. Any damage or loss will be the responsibility of the contractor unless due to a force majeure situation.

2.5.3 Shortages in outturn, undue delays, misdeliveries, damage or loss of cargo arising or resulting from factors stated above will not be held against the contractor.

2.6 Government Cargo Recovery Effort (GOCARE) Program for DoD Astray Freight.

2.6.1 Contractors who are unable to obtain delivery instructions shall follow the procedures set forth below:

2.6.1.1 Freight without identifying marks or those bearing conflicting marks will be opened by the contractor to ensure contents are DoD owned.

2.6.1.2 Contractors will contact GOCARE at telephone number referenced in Appendix H –

Emergency Notification Information or email at usarmy.scott.sddc.mbx.go-carriers@mail.mil.

2.6.2 Information on identifying and forwarding GOCARE Program (astray) freight is available at http://www.sddc.army.mil/GCD/default.aspx (Click on GOCARE Guidelines).

2.7 Weight Limitations.

2.7.1 Contractors shall inform the shipper of weight limitations and verify the weight on any vehicle, loaded by or on behalf of DoD, does not exceed limitations imposed by any state or municipality in which the shipment will be transported.

2.8 Movement of DoD Vehicles.

2.8.1 Once DoD vehicles are tied down or otherwise secured in place on the conveyance, the contractor may not move the loaded vehicles without consent of shipper, unless in the event of an emergency. This provision does not prohibit the contractor from loading additional freight and will not constitute a request for Exclusive Use of Trailer/Dromedary (EXC).

2.9 Security Clearance Requirements.

2.9.1 DDP and PSS shipments with TPS services shall only be provided by contractors holding a valid Facility Security Clearance (FCL) at the level of SECRET or higher issued by the Defense

Security Service (DSS). Contractor employees who have access to or handle TPS shipments, or have advanced knowledge of the shipments’ contents or transportation routes, will have an

Interim SECRET or a final SECRET eligibility determination depicted in the Joint Personnel

Adjudication System (JPAS).

2.10 Driver Identification/Qualification Requirements.

2.10.1 All drivers transporting DoD shipments under this contract will have in their physical possession positive identification that verifies their affiliation with the contractor named on the

Bill of Lading (BL).

2.10.2 Drivers who transport any DoD freight will have in their physical possession a valid commercial driver’s license, medical qualification card, employee record card or a similar document that contains the driver’s photograph and complies with Department of Transportation

(DOT) regulations. All documents will be in English and tamper proof. Contractors are responsible for ensuring drivers who transport DoD freight on their behalf are legally qualified, and possesses all necessary documentation.

2.10.3 Rules contained in the National Industrial Security Program Operating Manual DoD

5220.22-C, Section III will apply to contractors cleared to handle SECRET shipments. For more information, see Washington Headquarters Services Executive Services Directorate at:

2.10.4 Contractors shall ensure only qualified and licensed drivers operate a commercial motor vehicle. Any driver engaged in transporting DoD freight shall comply with all legal requirements, including federal statutes and regulations and DOT/State and Federal regulations.

Contractors shall ensure drivers transporting AA&E comply with Title 18, USC, Part I, Chapter

44, Section 922.

2.10.5 Contractors shall not allow any driver in its employ to move DoD vehicles (e.g., HMMWVs, trucks, etc.) unless the individual has been properly trained and certified by DoD to drive the vehicle.

2.11 Driver Instructions.

2.11.1 Contractors shall ensure drivers of commercial vehicles transporting explosives or other dangerous articles for military departments over public roads comply with instructions contained in 49 CFR, Part 397, Parking and Driving Rules.

2.12 Inspection of Vehicles.

2.12.1 Contractors shall permit consignor/consignee to inspect vehicle prior to loading/unloading of DoD freight and annotate deficiencies on DD Form 626-Motor Vehicle

Inspection. Contractors must correct any deficiencies found at the time of inspection and take all steps necessary to safely transport the shipment. Vehicles determined to have deficiencies that are not correctable at the time of inspection will not be loaded and Vehicles Furnished but Not

Used (VFN) will not apply.

2.12.2 For shipments of AA&E, consignor will inspect the motor conveyance according to DD

Form 626, Motor Vehicle Inspection (Transporting Hazardous Materials) in accordance with 49

CFR.

2.13 Sealing of Vehicles.

2.13.1 EXC shall apply to all shipments that prohibit loading of additional cargo.

2.13.2 Conveyances sealed by shipper or contractor will not be interpreted as requiring EXC.

When EXC or TPS is not ordered, seals applied by the shipper may be removed by the contractor and/or subsequent shippers, however, in each instance new seal numbers must be annotated on the BL.

2.13.3 Contractors may remove seals in an emergency or at stop-off points only if authorized by the TO, but those seals must be replaced with an equivalent seal. If stop-off(s) is/are requested by shipper, the contractor will obtain additional seals from the TO to replace seals broken at known stop-off locations. When the seal is replaced, the contractor is required to use a DoD-approved seal and must annotate the new seal number on the BL.

2.13.4 Contractors shall ensure vehicles utilized as AA&E conveyances are sealed with a serialized bolt seal (NSN: 5340-01-260-9935) at the bottom hasp by the shipper. That bolt seal shall meet the requirements of Federal Specification FF-S-2738, tested and approved by the DoD

Lock Program. In addition, the 5/16-inch (NSN: 5340-01-542-7347) and the 3/8-inch (NSN:

5340-01-542-7359) World Bolt Container Seals, manufactured by Tyden Brammall have been tested and approved for use on conveyances used for shipping AA&E.

2.13.5 Contractors authorized to provide TPS must equip each vehicle used to transport AA&E with at least one extra approved serialized bolt seal. In the event of an emergency or inspection, the contractor must comply with the request of the on-scene commander or law enforcement agent to break the seal on the conveyance. In such instances, SDDC DTTS shall be provided with the name, agency and badge number, if applicable, of the enforcement agent conducting the seal break. Upon completion, the load shall be resealed with a serialized bolt seal, and SDDC

DTTS shall be notified of the new seal numbers, and the information shall be annotated on the

BL.

2.14 Transporting Animals/Pets and Passengers.

2.14.1 Animals/Pets. Contractors transporting DoD freight will inform vehicle inspectors or military police of the presence of animals/pets in vehicle cab when entering a DoD installation.

Animals/pets will be leashed, secured, or caged prior to arrival at the installation as well as at vehicle inspection and animal/pets must meet all installation requirements, including up-to-date vaccinations.

2.14.2 Passengers. Passengers not in compliance with Security Clearance Requirements are not allowed in the vehicle cab while transporting DoD sensitive conventional AA&E or classified

(SECRET or Confidential) shipments. For other types of shipments, passengers must meet all installation requirements for entry.

2.14.3 For security reasons, and when in agreement with contractor, a DoD employee may be allowed to ride in the cab of the vehicle.

2.15 Capacity Loads.

2.15.1 Shipments are considered capacity loads (also known as “loaded to full capacity”, “loaded to capacity”) when it occupies the full visible capacity of a vehicle (as more fully defined in paragraphs 2.15.2.1 through 2.15.2.3 below). Shipments are to be considered as capacity loads if:

2.15.1.1 It occupies 90 percent of the cargo carrying capacity, as defined by either volume or weight.

2.15.1.2 Due to the unusual shape or dimensions of the cargo, or because the characteristics of the freight necessitates segregation or separation from other freight, the vehicle is filled so that no additional cargo can be loaded.

2.15.1.3 It fills a vehicle so that no additional cargo can be loaded.

2.15.2 For the purposes of this section, a “vehicle” is defined as:

2.15.2.1 A van trailer of not less than 40-feet in length and not less than 2,700 cubic feet capacity;

2.15.2.2 An open top trailer of not less than 40-feet in length, or;

2.15.2.3 A flatbed, stepdeck, lowboy, or removable gooseneck trailer of not less than 40-feet in length.

2.15.3 Contractors are prohibited from billing a shipment as a capacity load if the equipment requested by the shipper, or provided by the contractor, fails to meet the definitions shown in paragraph 2.15.2 above. In no event shall more than one vehicle per shipment be loaded to less than full capacity. Any vehicle loaded to less than full capacity will be assessed charges as if it were a separate shipment.

2.15.4 Charges for each vehicle loaded to full capacity will be based on either the truckload charge, when Rate Qualifiers PL, PM, or PV are used, or the highest truckload minimum weight and accompanying truckload rate applicable to the equipment ordered and loaded. Line haul charges will not be calculated using a minimum weight greater than 45,000 pounds. Shipments rated using line haul charges based upon Rate Qualifier PQ will be calculated using the greater of the actual weight or 40,000 pounds minimum weight.

2.15.5 This rule does not apply to charges based on the following rate qualifiers: DH, DL, DZ, PJ, PG, ST, and PY. Additionally, this rule does not apply to the following equipment types:

AO1 – AO8 (assorted straight trucks), AD (Dromedary Box without mechanical restraining devices), AD6 (Dromedary Box with mechanical restraining devices), A10 (410 Dromedary Box without mechanical restraining devices), A16 (410 Dromedary Box with mechanical restraining devices), or A20 (Motor Vehicle Transport Trailer). In the event that additional dromedary rate qualifiers and/or dromedary equipment codes are developed, this rule shall not apply to them as well.

2.15.6 This rule shall not apply to charges based on the following equipment types: AA1, AF1, AY1, AY2, AV1, AG4 and AZ1. If shipper inadvertently awards a shipment that exceeds

20,000 pounds or 28 linear feet of loading space on the above listed equipment, contractor is entitled to bill a shipper using a minimum weight of 20,000 pounds or the actual weight whichever is greater. In no circumstances may a contractor substitute a vehicle that is smaller than what is requested by the shipper.

2.15.7 It is the responsibility of the contractor (where practicable) to ensure the safe and efficient loading of freight (e.g. stacking items when appropriate, etc.) on the vehicle.

2.15.8 Capacity load will not restrict the contractor from adding additional freight to equipment and will not be interpreted as a request for exclusive use of the trailer or dromedary.

2.16 Dromedary Boxes.

2.16.1 When transporting DoD freight in a regular dromedary box or 410 dromedary container, the box/container will be:

2.16.1.1 Securely fastened to the chassis of a truck, tractor or flat bed trailer,

2.16.1.2 Demountable and capable of being handled with a forklift truck, and;

2.16.1.3 Protected by a plymetal shield and equipped with doors that can be locked and sealed.

2.16.2 Exclusive use of Trailer or Dromedary as described in Appendix D – Protective Services and Accessorials, shall be required for any shipments of:

2.16.2.1 White phosphorus or initiating or priming explosives, wet:

2.16.2.2 Diazodinitrophenol,

2.16.2.3 Mercury fulminate,

2.16.2.4 Guanyl,

2.16.2.5 Nitrosaminoguanylidene hydrazine,

2.16.2.6 Lead azide,

2.16.2.7 Lead styphnate,

2.16.2.8 Nitromannite,

2.16.2.9 Nitrosoguanidine,

2.16.2.10 Pentaerythrite tetranitrate,

2.16.2.11 Tetrazene,

2.16.2.12 Lead mononitroresorcinate.

2.16.3 Dromedary boxes must conform to one of the specifications in the following table:

2.17 Overages and Shortages.

2.17.1 Contractors shall report overages and/or shortages to the shipper via telephone or email within 24 hours of discovering the overage/shortage.

2.17.2 Contractors shall supplement the oral or e-mail notice with written correspondence regarding the shipment discrepancy.

2.18 Prearranged Scheduling of Vehicle Arrival for Loading and Unloading.

2.18.1 When requested, contractor will prearrange schedules for arrival of vehicles to load or unload shipments. Detention: Vehicles with Power Units (DEP) and Detention: Vehicles without Power Units (DET) in Appendix D – Protective Services and Accessorials will apply, subject to the following provisions:

2.18.2 Shipper requests for prearranged scheduling may be made orally, in writing, or via the

Internet (where appropriate).

2.18.3 Prearranged schedules for arrival of vehicle may be on a one-time, periodic, or continuous basis. In the event a continuous prearranged scheduling agreement is made, that agreement may be terminated by either party providing notice either orally, in writing, or via the

Internet within 24 hours to the other party.

2.18.4 In the event a contractor vehicle arrives prior to an appointment, free time shall not commence until the scheduled arrival time, or at the time when actual loading or unloading begins, whichever is earlier.

2.19 TPS Incident Response Responsibilities.

2.19.1 In cases of accidents or incidents involving TPS cargo that may result in serious injury, death, or national media attention, contractors have the following responsibilities:

2.19.2 Report accidents or incidents to SDDC DTTS immediately via panic button and follow up telephonically with SDDC DTTS as soon as possible. Contractor shall continue to send required messages to SDDC DTTS. During incidents involving serious injury or incapacitation of driver/driver team, contractor shall immediately notify SDDC DTTS of the incident by phone.

2.19.3 Contractor must have capabilities in place to answer and respond promptly to telephone calls from SDDC DTTSSDDC DTTS at all times. The contractor must be able to accept calls or allow messages when telephone calls are placed by SDDC DTTSSDDC DTTS, and must respond to SDDC DTTSSDDC DTTS within five minutes of any telephone messages left by

SDDC DTTSSDDC DTTS. This five minute time period is measured from the time SDDC

DTTSSDDC DTTS leaves the message.

2.19.4 For accidents and incidents involving response by local and/or state first responders, the contractor must comply with the directions and/or requests of the on-scene commander or local law enforcement agent responding to the incident. Contractor shall ensure first responders are aware of risks associated with any hazardous materials, to include explosives.

2.19.5 Contractor, in accordance with all applicable federal, state and local regulations, is responsible for coordinating use of towing equipment, Material Handling Equipment (MHE), and other required services for handling hazardous materials and munitions. Contractor must ensure any commercial towing or MHE company employed is aware of associated risks, is appropriately licensed to handle hazardous materials, to include explosives, and is in compliance with all applicable federal, state and local laws. Contractor is responsible for all charges incurred when using such commercial services. If both the contractor and the on-scene commander or local law enforcement agency are unable to obtain appropriate commercial support, the contractor will request DoD support through SDDC DTTS.

2.19.6 See paragraph 2.13 for procedures on sealing of vehicles and seal breakage.

2.19.7 Contractor shall ensure drivers at an incident or accident scene follow corporate policy with regard to media requests.

2.20 Hazardous Materials Routing Mileage.

2.20.1 When rates are based on distance for shipments involving hazardous materials that require placarding, IAW 49 CFR, Part 172.504, contractors shall utilize the applicable mileage as calculated by Defense Table of Official Distances (DTOD) Hazardous Materials Routing

Module.

2.21 Terminal Security Standards for Secure Holding of AA&E.

2.21.1 Terminal Security Standards for secure holding of Arms, Ammunition, and Explosives shall be either DoD installation/activity or an SDDC approved contractor owned secure holding facility, and such facilities may be utilized for a maximum of 100 hours for the temporary parking of commercial contractor motor vehicles that are transporting Categorized AA&E or classified materials. In no event shall this Secure Holding relieve the contractor of any liability relating to the safe transport of the shipment. Furthermore, in no event shall this provision be interpreted to mean that DoD assumes any responsibility or liability for either the shipment or the equipment of the contractor. Due to the special security standards for these special shipments, the terms and conditions of providing Secure Holding Area shall in no event be inconsistent with any provision of the contractor contract of carriage. The Secure Holding Area accorded is strictly temporary. Contractors are advised that shipping documents will be thoroughly examined at the entrance of a DoD installation/activity to prevent entry of any unauthorized shipments onto that installation/activity. Upon verification of those shipping documents at the entrance of the installation/activity, contractor vehicles shall be directed to proceed to a Secure Holding Area located within appropriate security area.

2.21.2 No Security Risk Code (SRC) I or II shipments shall be allowed in contractor terminals under any circumstance.

2.21.3 Any shipment entered into an approved contractor terminal or DoD secure holding area shall be the responsibility of the last person signing the DD Form 1907. The original driver is responsible for the custody and contents of AA&E shipments from origin to destination, unless that shipment is properly transferred to a new driver or terminal personnel who accept responsibilities by signing the DD Form 1907.

2.22 Terminal Security Standards for Secure Holding of Non-AA&E Shipments.

2.22.1 Contractor conveyances that contain SRC for non-AA&E TPS shipments may be temporarily parked for a maximum of 100 hours or less within a DoD secure holding installation/activity or SDDC-approved commercial contractor owned secure holding facility.

2.23 Transloading TPS Shipments.

2.23.1 Any shipment (including SRC I and II LTL shipments) requiring PSS will move point-to-point as a dedicated shipment, and under no circumstances will such shipment be transloaded or consolidated. See paragraphs 2.23.3 through 2.23.5.2 regarding transloading due to an accident.

2.23.2 Any shipment requiring SNS and DDP will not be transloaded or otherwise consolidated by contractor personnel, except under the following limited circumstances:

2.23.2.1 Consolidation of LTL shipments of SRC III, IV and Uncategorized AA&E will occur only at an SDDC-approved contractor-owned secure holding facility by contractor personnel qualified in accordance with all relevant requirements set forth in 49 CFR. Under no circumstances shall transloading and/or consolidation of TPS shipments occur at any other location (e.g., non-approved contractor-owned or leased facility, DoD-owned activities/installations, rest stops or truck stops, public locations, etc.). Under this subparagraph, contractor equipment must have been previously approved by DoD personnel to move under existing BL and DD Form 626 (Motor Vehicle Inspection Transporting Hazardous Materials).

Emergency procedures shall comply with Paragraph 2.23.4 below.

2.23.2.2 Transfers of dromedary boxes shall only occur at an SDDC-approved, contractor secure holding facility that is specifically equipped and approved to handle dromedary box transfers.

Dromedary boxes will be transferred by contractor personnel who are fully qualified in accordance with the requirements of 49 CFR. In no event shall a contractor or contractor personnel be authorized to break any seals on dromedary boxes during transloading. Breaking seals on dromedary boxes will only be authorized in the event of an emergency.

2.23.2.3 When transloading occurs, the contractor will immediately notify SDDC DTTS—via a

“C” message and the owning military Service as identified in Appendix D – Protective Services and Accessorials.

2.23.2.4 The circumstances set forth in paragraphs 2.23.2.1 and 2.23.2.2 will only be permitted on contractor equipment previously approved by DoD personnel moving under an existing BL and DD Form 626 (Motor Vehicle Inspection Transporting Hazardous Materials).

2.23.3 Contractor personnel are prohibited from personally handling TPS shipments unless circumstances occur within parameters set forth in paragraphs 2.23.2.1 and 2.23.2.2 above, or paragraph 2.23.4 set forth below.

2.23.4 In the event of an emergency or accident, as defined by 49 CFR, Part 390.5, contractors may perform the following functions while in transit when authorization is obtained from SDDC

SDDC DTTS when the emergency/accident occurs and onsite first responders (to include

Explosive Ordnance Disposal [EOD] personnel, Quality Assurance Specialists of Ammunition

Surveillance [QASAS], Ordnance Officers, Weapons Officers, and/or Explosives Safety

Officers, firefighters or police), in coordination with owning military Service for whom the shipment is being transported:

2.23.4.1 Transfer truckload TPS shipments from one conveyance to another; or

2.23.4.2 Transfer dromedary boxes, containing TPS shipments, from one conveyance to another;

or

2.23.4.3 Unload and transfer the contents of a dromedary box containing TPS shipments; and

2.23.4.4 For all functions performed under paragraphs 2.23.4.1 through 2.23.4.3, the contractor shall replace seal(s) and annotate the new seal number(s) on BL.

2.23.5 When transloading a TPS shipment during an emergency or accident, and the equipment or driver is changed after leaving origin:

2.23.5.1 Drivers and trailers shall meet or exceed the requirements of DD Form 626 (Motor

Vehicle Inspection Transporting Hazardous Materials) and 49 CFR, and;

2.23.5.2 Contractors shall immediately notify SDDC DTTS—via a “C” message, and the owning military Service, as identified in Appendix D – Protective Services and Accessorials, when transloading occurs.

2.24 Transporting Class 1 (Explosives) in a Temperature Controlled Conveyance.

2.24.1 Contractors shall ensure motor vehicles comply with 49 CFR, Part 177.834 (l) (1) prior to loading Class 1 explosives in a temperature controlled conveyance that has the capability of producing heat.

2.24.1.1 Motor vehicles equipped with a cargo heater of any type may transport Class 1 explosives only on the condition precedent that the cargo heater is rendered inoperable by draining or removing the cargo heater fuel tank and disconnecting the heater’s power source.

2.24.1.2 An inspection of the heating unit to ensure that it is inoperable or disconnected is required, unless the shipment is being transported under a DOT special permit, exemption or

Competent Authority Approval (CAA) that waives the inspection or allows the heating unit to remain connected.

2.24.1.3 If the cargo heater is operational, the vehicle may be rejected until the heating unit is disconnected.

2.25 Electronic Commerce/Electronic Data Interchange (EC/EDI).

2.25.1 Contractors shall comply with the DoD EC/EDI Program. EC is the electronic exchange of routine business documents between trading partners. EDI is a type of EC. EDI is the computer-to-computer exchange of routine business documents in machine-readable form. EDI utilizes publicly defined standards of the American National Standards Institute (ANSI).

2.25.2 To participate in the DoD EC/EDI program, all commercial trading partners (e.g.

contractors, vendors) shall execute an EC/EDI Trading Partner Agreement (TPA) and comply with applicable DoD instructions, standards, and conventions. The EC/EDI Trading Partner

Guide for Defense Transportation is available under “Freight/Cargo, Air/Land, and TPA” on

SDDC’s web site at www.SDDC.army.mil. DoD EDI implementation conventions are available at: http://www.transcom.mil/dteb/.

2.25.3 Participation in the EDI program requires compliance with published ANSI ASC X12 standards and DoD EDI implementation conventions when electronically exchanging transportation or transportation-related data with DoD transportation components or their agents.

The commercial EDI trading partner shall be capable of:

2.25.3.1 Electronically exchanging shipment, rate, and award information;

2.25.3.2 Securing freight payment services for the DoD using U.S. Bank Freight Payment service;

2.25.3.3 Receiving Electronic Funds Transfer (EFT); and

2.25.3.4 Providing delivery and/or shipment status reports to U.S. Bank Freight Payment and/or

United States Transportation Command (USTRANSCOM) (and its component commands) through DoD EC Infrastructure.

2.25.4 Commercial vendors/contractors who exchange EDI transactions with DoD transportation components or their agents may exchange business data through third-party value-added-networks (VANs), or directly, which shall be compatible with the DoD system or DoD

EDI.

2.25.4.1 The contractor shall provide an electronic data transaction set meeting ANSI

Accredited Standards Committee (ASC) X12 EDI standards. The contractor shall provide an

ANSI ASC X12 transaction set (TS) 214, Motor Carrier Shipment Status Message.

2.25.4.1.1 To view the latest version of the DoD 214A Implementation Convention, visit the

2.25.5 Contractors shall be EC/EDI compliant prior to the start of contract performance.

2.25.6 USTRANSCOM, on behalf of DoD, is responsible for collecting logistical data to support the in-transit visibility of all DoD shipments from origin to destination. This visibility is for peacetime, contingencies and exercises and includes tracking movements of freight. The contractor shall provide 214 transactions electronically to the GEX. 2.25.12 Contractors are required to use SDDC DTTS Program Manager (PM) approved satellite vendors who can provide satellite position message, alerts and driver's message signals to SDDC

DTTS through the Intelligent Road and Rail Information Server (IRRIS).

2.26 Surge/Contingency Support.

2.26.1 When directed by the Contracting Officer, contractors shall support surge/contingency operations and respond with required resources to meet the time frames of surge/contingency requirements. Surge/contingency requirements may not be distributed evenly throughout the performance period. Rather, they are focused, sporadic events that can last a few weeks to months.

2.27 Fuel Surcharge.

2.27.1 SDDC’s Domestic Freight Fuel Surcharge TR-12 FRA Policy 27 Mar 13 shall be applicable to this contract. SDDC’s fuel policy is located at http://www.sddc.army.mil/GCD/Fuel%20Surcharge/Forms/AllItems.aspx.

2.28 Line Haul Rates and Accessorial Charges.

2.28.1 Contractors shall submit their line haul rates and accessorial charges in SDDC’s Bidding

Interface for Delivery Solicitation (BIDS) tool located at https://eta.sddc.army.mil. Approved line haul rates and accessorial charges will be established as not to exceed (NTE) rates/charges.

2.29 Rate/Accessorial Adjustments.

2.29.1 After contract award and prior to the performance start date, contractors may decrease their line haul rates and accessorial charges below the negotiated NTE rate/charge. After an initial decrease, contractors may increase or decrease their rates/charges as long as the rates do not exceed the NTE rate. All decreases or increases will be effective the next calendar day following the date of submission. The rate on file at shipment acceptance shall be applied to the shipment.

2.30 SDDC Suspension/Non-Use.

2.30.1 In the event SDDC suspends or places a contractor in non-use status for failing to maintain its eligibility as an approved DoD or TPS carrier, the Contracting Officer will place the contractor in non-use status on the contract until reinstated by SDDC.

2.31 Delivery Exception.

2.31.1 Contractors shall utilize one of the event codes listed in paragraphs 2.25.8 through

2.25.10.9 when a shipment does not arrive at its destination in a timely manner due to no fault of the Contractor.

2.32 Dedicated Truck Lanes.

2.32.1 The Government reserves the right to add dedicated truck lanes at any time during the period of performance.

2.33 Proof of Delivery (POD).

2.33.1 Contractors shall obtain proof of shipment delivery on the BL from the receiver’s representative to certify the delivery obligation has been met.

2.33.2 The POD shall identify the following information:

2.33.2.1 Receiver’s printed name

2.33.2 Contractors shall collect, retain and provide upon request hard copy or electronic POD.

(COR) sufficient proof of delivery as required for the Government to complete an audit of the contractor’s shipments.

2.35 Non-DoD Tracking Devices.

2.35.1 Non-DoD tracking devices will not be used to track contractor vehicles carrying DoD

TPS cargo. No third parties, other than DoD-approved contractors transporting TPS cargo, shall monitor/track TPS truck movements.

2.36 Wait Time Charges.

2.36.1 Contractors may submit a linked e-bill for Wait Time charges when the following occurs:

2.36.1.1 Contractor arrives at the destination facility during valid hours of operation per the

TFG, and:

2.36.1.1.1 Is turned away at the facility entry point due to facility closure, change in hours of operation, or commodity restriction not properly annotated on the facility’s TFG page; or

2.36.1.1.2 Enters the facility but cannot complete delivery due to change in hours of operation or unavailability of Government personnel.

2.36.2 To receive compensation for authorized wait time, contractors shall complete the Wait

Time Authorization Form (Appendix N) and attach it to the linked e-bill in the Third Party

Payment System (TPPS).

2.37 Information Assurance

2.37.1 Requirement for Contractor Information Assurance (IA) Report

The Contractor shall provide an Information Assurance Report to describe their environment that safeguards DOD non-public information resident on or transiting the contractor's unclassified information systems from unauthorized access and disclosure. Protection measures applied should consider the risks (i.e. consequences and their probability) of loss, misuse, unauthorized access, or modification of information. The report shall address the SANS (SysAdmin, Audit, Network, Security) Institute's Twenty Critical Security Controls for Effective Cyber Defense:

Consensus Audit Guidelines (http://www.sans.org/critical-security-controls) and be provided in accordance with the attached template at Appendix C to the PWS. The contractor is encouraged to provide additional information above and beyond what is outlined in the SANS guidelines to enhance the government’s understanding of their information security posture. The report will be updated 30 days prior to exercise of an option period, if applicable.

2.37.2 Cyber Security Incidents

2.37.2.1 Reporting Requirements. The contractor shall report to the following two Government organizations as soon as possible upon discovery of any suspected cyber intrusion events that affect DOD information resident on or transiting the contractor's unclassified information systems.
