C. The Supplement Agreement to CBA 2009-3229, Revision 1, which includes revised wages and fringe benefits, is hereby incorporated as attached (covers VA0376 sand VA0839).
D. Page 6 of the 1449 is hereby deleted in its entirety and replaced with the attached to reflect CLIN 0010 as 3 months in duration.
E. Questions will only be considered from interested parties (i.e. Small Businesses with a Top Secret security clearance in NAICS 561612).
F. The following questions and answers are provided for informational purposes only:
Q1. I am writing to inquire whether it would be possible to obtain a Microsoft Word version of the Statement of Work for this solicitation. The version that is part of the solicitation appears to have been scanned and cannot be converted to the Word format.
A1. This document is only available in PDF format.
Q2. Amendment 1, Paragraph R indicates that weapons storage is available at some of the sites in the solicitation. Which sites allow for weapons storage? Will the government allow on site weapons clearing barrels?
A2. All sites have weapons storage onsite or within a close proximity. Clearing barrels will be allowed on site or within a close proximity.
Q3. Are contractors required to store weapons at sites that allow for weapons storage?
A3. Yes.
Q4. Are contractors required to provide their own safes at the sites where weapons storage is required to be on site?
A4. Yes.
Q5. Exhibit 8C requires 9mm weapons. What are the incumbent PSOs carrying?
A5. See Amendment 01, paragraph K.
Q6. Will any office space be provided for the CM, Supervisors, Training, or Quality Control Personnel? If yes, at what site(s) will office space be provided?
A6. At a minimum office space will be provided for the Supervisors (not for Training, QC or CM personnel) at the following sites: VA0905, VA0376, VA0907 and VA0908.
Q7. Reference SOW Section 13 and Exhibit 9E – PIV Cards. Neither the applicable SOW section nor the Exhibit identify the PIV enrollment location. Will the Government please identify the location for PIV enrollment?
What are the locations where PIV cards are produced and issued?
A7. Bren Mar, Virginia.
Q8. Do the current PSOs already have PIV cards?
A8. No.
Q9. The weapons training exhibits makes several references to shotgun training, including a shotgun course of fire. However, it does not appear as though shotguns are required on the contract (no mention of shotguns in Exhibit 8C). Are officers to be trained and qualified with shotguns? Are offerors to provide shotguns for use in performance?
A9. Shotguns are not required.
Q10. If shotgun training is required, what type of shotgun and ammunition is required to be used for training?
A10. Shotguns are not required.
Q11. Section B, CLIN 0010, pg.6 Period of Performance for CLIN 0010 is listed as 01/01/2012 – 03/31/2012.
The transition period of performance for CLIN’s 0001 -0009 for the remaining buildings is stated as 10/01/2011 – 03/31/2012. Please clarify whether CLIN 0010 is correct as written or if it should have a period of performance of 10/01/2010 – 03/31/2012.
A11. See paragraph D of this amendment.
Q12. Section B pgs 4-6 & Statement of Work Section 2.1, pg 9 Section B CLIN’s 0001 – 0010 for non-recurring transition costs has 6 months stated for the quantity of months, however Section 2.1 of the Statement of Work specifies no more than 90 days for transition/phase-in. Will the government please clarify if the transition/phase-in period is 6 months or 90 days (3 months)? Is the initial six months designated for PSO phase-in/transition of the contract and actual full period of performance begins with the 54 month CLIN? Will the awardee assume all guard posts during the initial six month period or after the completion of the six month transition period?
A12. CLINs 0001 – 0010 are designated as a six month period so that non-recurring transition costs can be recouped within the first six months of the contract rather than throughout the entire period of performance (i.e. 60 months). This is separate from the actual time period for the transition between the awardee and incumbent contractor, which is specified as a maximum of 90 days (i.e. the date the contract is signed until October 1, 2011).
Actual performance begins 10/01/2011.
Q13. For costing purposes, when does the government consider the annual escalation to be incorporated into the pricing proposal, twelve months after the initial 6 month transition period or twelve months after the beginning of the 54 months CLIN?
A13. See Amendment 01, paragraph J.
Q14. CBA-2009-3229 The referenced CBA contains three sections of wages and benefits separated by government activity location which is listed in the footer of the document. Will the government please confirm that CBA-2009-3229, which covers buildings VA0376 & VA0839, corresponds to the wages and benefits in the CBA?
The (1800 S Bell)/Army (1901 S Bell) CBA addendum is the old one there is a newer version? The Master CBA with ITPEU does not have economics beyond 31 Oct 2011 but CBA is effective through Oct 2012. Will FPS provide the addendum to the CBA? Will the government provide the CBA/Wage Determination documents that are currently in effect at this time; or, is it the intent of the government for all offerors to use the pay & fringe rates listed in the AWD CBA provided with the solicitation?
A14. See paragraph C of this amendment.
Q15. Amendment 1 replaces Section 12.1.2.1 in its entirety. This amendment contradicts breaks and lunch periods as listed under the three CBAs included in the solicitation. Please advise whether this verbiage relates only to those employees covered under the SCA WD included in the solicitation.
A15. Section 12.1.2.1 of the Statement of Work is the minimum requirements for breaks under this solicitation.
Q16. Exhibit 8E, Statement of Work, Section 14.2 (page 109) This exhibit indicates that radios are not required on the contract. Would the Government consider cell phones with push-to-talk functionality as a sufficient method of communication in lieu of radios?
A16. A sufficient method of communication in lieu of radios is not necessary as radios are not required on the contract.
Q17. At this time we currently do not possess TSFC however it has been our experience that DHS would be willing to sponsor a qualified firm selected for a contract requiring a clearance. Could you please address FPS’ policy regarding sponsorship of a TSFC and whether FPS would consider award to a firm needing sponsorship?
A17. FPS will only sponsor for a secret clearance, not a top secret clearance.
Q18. I was able to locate the following incumbent information, but were there ever any contract numbers assigned?
A18. The following are the contract numbers for the incumbent contractors:
Frontier Systems Integrators, LLC - HSCEEC-08-A-00021 Master Security Company – HSCEEC-08-D-00004 SecTek, Inc.- HSCEEC-08-A-00004 C & D Security – HSCEEC-09-D-00012 USEC Security Incorporated – HSCEEC-08-A-00001 Ares Group – HSCEEC-08-A-00007 Coastal International Security, Inc. - HSHQEC-10-D-00005
Q19. Also, it looks like the Frontier Systems contract is a BPA with no value assigned. Is there an overall anticipated ceiling value for the upcoming contract?
A19. No.
Q20. I am a little confused on how Collective Bargaining Agreements work. So any clarification you are willing to provide is appreciated.
A20. See Amendment 01, paragraph J.
Q21. We are interested in submitting a proposal, but do not have a Top Security clearance. Does the lack of the clearance eliminate our company from the competition?
A21. Offerors shall possess a Top Secret facility clearance prior to the date and time established for submission of offers.
Q22. There are several inconsistencies with post exhibit addresses and CBA addresses. Will FPS clarify post locations per exhibit against those listed in various CBAs?
A22. As already indicated in the solicitation:
CBA 2009-3229, Revision 1 - Collective Bargaining Agreement between Master Security and the Industrial, Technical & Professional Employees Union (AFL-CIO) (covers VA0376 and VA0839)
CBA 2009-2981, Revision 1 - Collective Bargaining Agreement between Frontier Systems, Inc. and the United Government Security Officers of America Local #209 (covers VA0837)
CBA 2010-3503 - Collective Bargaining Agreement between C & D Security and the National Union of Protective Services Associations (covers VA0905 and VA0323)
CBA 2010-3842 - Collective Bargaining Agreement between USEC Service Incorporated and the Industrial Technical & Professional Employees Union (AFL-CIO) (covers VA1287)
CBA 2010-4064 - Collective Bargaining Agreement between Sectek, Inc. and the Security, Police and Fire Professionals of America (SPFPA) (covers VA 0907 and VA0908)
Wage Determination No.: 2005-2103, Revision 10 dated 06/15/2010 (covers VA0251 and VA1450)
Q23. The CBA between NASPO and SecTek does not lists a location that correlates to the post exhibits. Will FPS validate the post exhibit locations against the various CBAs so offerors may correctly apply wages and benefits? S.O.W page 331 of 457 lists CBA between SecTek and SPFPA but is followed on page 332 Addendum to Appendix A and not a complete CBA. Will the government provide the complete CBA?
A23. See paragraphs A and B of this amendment.
Q24. Question: SOW Section 5.1.2.4. This version of the RFP, unlike previous versions of FPS solicitations, no longer allows an applicant with 2 years of college or an Associate’s Degree to be eligible for employment without also having at least 3 years of guard/military experience or a law enforcement academy certificate. Please confirm that it is FPS’ intent that individuals with 2 years or more of college alone (with no guard, military, or law enforcement experience) are no longer eligible for employment as PSOs on this contract.
A24. The solicitation is clear on its face.
Q25. Question: Which if any of the following requirements from the new SOW are PSOs on the current contract certified on?
Basic Training (Exhibit 3A) Weapons Training and Certification (Exhibit 3B) Government Provided Training Exhibit 3C, 4G, 4H) Recurrent Training (Exhibit 4J) ARC or AHA First Aid ARC or AHA CPR/AED Medical Questionnaire and Physical Abilities Test (Exhibit 7) Supervisor Training (Exhibit 4F)
A25. See Amendment 01, paragraph K and L.
Q26. The seniority for building VA0837ZZ was not included. Please provide the seniority list for this building.
A26. The Seniority List for this site is currently not available and will be provided in accordance with FAR 22.1020.
Q27. Do all of the incumbent PSO certification files meet the new requirement to have copies of all of the contractor provided basic training with appropriate Exhibit or certificate of completion (64 hour basic, 40 hour weapons, 40 hour refresher) along with certificates for the FPS provided training and testing (Orientation, X-ray/Magnetometer)?
A27. See Amendment 01, paragraph K.
